Defendants Lin Xuwei, Bao X, and Fei X bought citizens' personal information from defendant He Gao and sold it.

Around January 2019, defendant Fei X wanted to buy citizens' personal information in order to sell POS machines, and then got to know defendant Lin Xuwei. After consultation, the two invested 350,000 yuan to purchase 5 million pieces of pos machine citizen personal information (including names, mobile phone numbers, etc.). Due to insufficient funds, Fei xxx wants to purchase the above-mentioned citizens' personal information through price increases.

Between January 2 and 4, 2019, defendants Lin Xuwei and Bao X went to Wuhan City, Hubei Province, to jointly discuss with defendant He Gao the purchase and sale of the above-mentioned citizens' personal information. After a total of 370,000 yuan was paid to Lin Xuwei, of which 350,000 yuan was directly transferred by Si X according to the requirements of Fei X. Lin Xuwei transferred the above 350,000 yuan to He Gao, who then provided more than 2 million pieces of the above-mentioned citizens' personal information to Lin Xuwei through a USB stick. After that, Lin Xuwei will successively provide the above data to Fei Moumou. Because the above data is less than 5 million, Lin Xuwei returned 50,000 yuan to Fei Moumou.

After Fei xxx purchased the above-mentioned citizens' personal information, he provided 1.8 million pieces of citizens' personal information, together with more than 200,000 pieces of his own citizens' personal information (including mobile phone numbers and other contents), to Mr. Si. Because Fei xxx failed to provide the citizens' personal information to Si xxx in the agreed amount, Fei xxx agreed to refund 100,000 yuan to si xx, but has not been refunded.

On January 3, 2019, defendant Bao X, with the consent of Lin Xuwei, sold about 300,000 pieces of the above-mentioned citizens' personal information purchased from He Gao to Guan X, and collected 50,000 yuan from Guan X, and Lin Xuwei received 20,000 yuan.

Defendant Lin Xuwei sold and provided futures and POS machine citizens' personal information to Wang Xiangyang, and sold POS machine citizen personal information (including names, mobile phone numbers, and other content) to Feng X and Wan X through Wang Xiangyang and others.

Since August 2018, defendant Lin Xuwei has sold thousands of futures citizens' personal information to Wang Xiangyang, and provided Wang Xiangyang with about 1 million pieces of citizens' personal information purchased from He Gao. Wang Xiangyang paid a total of 30,000 yuan.

Between June and October 2019, defendant Lin Xuwei sold a total of about 600,000 pieces of citizens' personal information to Feng through defendant Wang Xiangyang on four occasions, and Feng paid a total of 99,500 yuan to Lin Xuwei and Wang Xiangyang. Lin Xuwei received 94,000 yuan, and Wang Xiangyang received 0.55 million yuan.

Between June and September 2019, defendant Lin Xuwei twice sold a total of about 1.5 million pieces of citizens' personal information to Mr. Wan through defendant Wang Xiangyang, and Mr. Wang, with the introduction and assistance of defendant Mr. Chen, paid Mr. Wan a total of 110,000 yuan. Lin Xuwei got 80,000 yuan, Wang Xiangyang got 20,000 yuan, and Chen Got 10,000 yuan.

Defendant Wang Xiangyang also separately sold POS machine citizen personal information (including names, mobile phone numbers, etc.) to Feng X, Zhang Qiu, and others between June and September 2019.

In September 2019, defendant Wang Xiangyang twice sold about 380,000 pieces of citizens' personal information to Mr. Feng, and Mr. Feng paid a total of 21,000 yuan.

Between July and September 2019, defendant Wang Xiangyang repeatedly sold about 2.01 million pieces of citizens' personal information to Zhang Qiu, and Zhang Qiu paid a total of 38,880 yuan.

Defendants Zhong Shiwan, Zhang Qiu, and Xiao X began to jointly resell citizens' personal information (including mobile phone numbers and other content) around the beginning of 2019, Zhong Shiwan and Zhang Qiu were mainly responsible for contacting buyers and sellers, and Xiao X was mainly responsible for receiving, sorting out and sending citizens' personal information. Xiao Moumou obtained the corresponding commission according to the total amount of the sale, and Zhong Shiwan and Zhang Qiu shared all profits equally.

Defendant Zhang Qiu has repeatedly purchased a total of about 2.01 million pieces of personal information from Wang Xiangyang. Between June and November 2019, defendant Zhang Qiu repeatedly sold 20,000 to 30,000 pieces of citizens' personal information to Mr. Xie, and Mr. Xie paid a total of 10,600 yuan.

Between June and November 2019, defendant Zhong Shiwan sold a total of more than 560,000 pieces of citizens' personal information to Mr. Cheng, who operated a POS machine sales company, on several occasions, for a total of 390,452 pieces after weight removal. Cheng xxx, Sun xxx, and others paid a total of 277,500 yuan.

For example, the Dongxian People's Procuratorate held that the defendants He Gao, Lin Xuwei, Wang Xiangyang, Zhong Shiwan, Zhang Qiu, Bao xx, Fei xx, Xiao xx, and Chen xx violated the relevant provisions of the state by illegally obtaining, selling, and providing citizens' personal information to others, and the circumstances were particularly serious, and their conduct violated the provisions of the first and third paragraphs of article 253-1 of the Criminal Law of the People's Republic of China, the facts of the crime were clear, the evidence was credible and sufficient, and they should be investigated for criminal responsibility for the crime of infringing on citizens' personal information.
