Cao Yi, the former chairman of China Railway Eighth Bureau Group Co., Ltd. The "Criminal Judgment of the First Instance of Cao Yi's Bribery Crime" recently released by the China Judgment Documents Network disclosed this information. The court found that Cao Yi alone or in collusion with others accepted nearly 30 million yuan, more than half of which was sent by Li Mou, the legal representative of Chengdu Chuanmao Construction Engineering Co., Ltd. (hereinafter referred to as Chuanmao Company). At the same time as accepting bribes, Cao Yi also entrusted Li to manage the money.

Public information shows that Cao Yi, male, Han ethnicity, born in March 1957, From Fugou, Henan, has a postgraduate degree on the job. He has worked in the railway system for a long time, serving as the general manager, vice chairman and chairman of the eighth bureau of China Railway, and was transferred to the inspector of the eighth bureau of China Railway in December 2014 and retired in April 2017.

According to the above-mentioned first-instance judgment, more than two years after retiring, Cao Yi voluntarily surrendered to the Sichuan Provincial Supervision Commission on December 2, 2019, was taken into lien measures on the same day, and was criminally detained and arrested in June 2020.

In July 2020, the Nanchong Municipal People's Procuratorate indicted Cao Yi on suspicion of accepting bribes.

The Nanchong Intermediate People's Court found that from 2005 to 2014, Cao Yi took advantage of his position as deputy secretary of the party committee, standing committee member of the party committee, general manager, chairman of the board of directors of the Eighth Bureau of China Railway to seek benefits for others in undertaking engineering projects, supply and marketing of air conditioners, etc., and accepted 29.65 million yuan alone or in collusion with others from 2006 to 2018, of which the actual income of individuals was 27.15 million yuan.

The Paper (www.thepaper.cn) combed through the first-instance judgment and found that Cao Yi had accepted 16.5 million yuan from Li Mou, the legal representative of Chuanmao Company, accounting for more than half of the total number of bribes he accepted. The judgment shows that Cao Yi has repeatedly used the convenience of his position to provide assistance for the construction projects of Li's related enterprises. The projects involved include: the tj-1 standard project of the Harbin-Dalian passenger dedicated line of the Eighth Bureau of China Railway, the swzq-8 standard project of the Shijiazhuang to Wuhan passenger dedicated line of the Eighth Bureau of China Railway, the construction of the second line of the Suining-Chongqing line, the project in front of the introduction of the New Lanyu Railway into Chongqing Hub By the Eighth Bureau of China Railway, and the Jiucun Tunnel and its ancillary projects in the southeast section of the Kunming Ring Expressway of the Eighth Bureau of China Railway.

The judgment also introduced that in the second half of 2010, Cao Yi accepted the entrustment of Chen Jian, then a member of the party group and deputy procurator general of the Chengdu Railway Branch of the Sichuan Provincial People's Procuratorate (handled in a separate case), and took advantage of his position to provide assistance for the procurement of materials for the project after the Guiyang Renovation Freight Center Station of the Eighth Bureau of China Railway co., Ltd. was won by Kefei Logistics Company, and Xiao Jianwu borrowed the qualification of Sichuan Feiya Construction Co., Ltd. to win the bid for the labor service project of the project. In December of the same year, Cao Yi and Chen Jian jointly accepted 5.5 million yuan from Xiao Jianwu, of which Cao Yi personally received 3 million yuan.

In addition, Ma Mou, the legal representative of Chengdu Tailai Construction Labor Service Co., Ltd., and Tang Mou, the legal representative of Sichuan Zhichao Construction Co., Ltd., also paid bribes of 5.05 million yuan and 2 million yuan to Cao Yi respectively. Cao Yi took advantage of his position to provide assistance to the above two people and related companies to undertake the construction project.

The Nanchong Municipal Intermediate People's Court held that the defendant Cao Yi, as a state functionary, took advantage of his position to provide assistance to relevant units and individuals in matters such as engineering projects, and illegally accepted property alone or in collusion with others, and his conduct constituted the crime of accepting bribes and should be punished according to law. At the same time, Cao Yi voluntarily surrendered and truthfully confessed his crime, which was a voluntary surrender, and could be given a mitigated or mitigated punishment in accordance with law. If they voluntarily return all the stolen funds, they may be given a lighter punishment. Cao Yi voluntarily and truthfully confessed his crime, admitted the facts of the alleged crime, was willing to accept punishment, and could be given a lenient treatment in accordance with law.

On September 29, 2020, defendant Cao Yi was sentenced to 10 years' imprisonment and fined RMB1.5 million in the first instance for accepting bribes. The sentence runs from December 2, 2019 to December 1, 2029. All stolen funds returned shall be confiscated and handed over to the State Treasury.
