The mystery of 60 acres of contracted land being "drifted"
At the beginning of November, some villagers in the Xuedong Group of Chengbei Village, Lingcheng Town, Suining County, reported to the newspaper's reader hotline (025-84701119) that nearly 60 mu of contracted land for 32 villagers was originally leased to the village to open a timber market and place building materials, and the timber market was relocated in October last year, and in March this year, the same place suddenly built a building materials city.
The whole village has not yet issued a land "confirmation certificate"
On November 7, the reporter rushed to the North Village of Lingcheng Town, Suining County, only to see that 9 buildings in the "Jinling Building Materials City" had been out of the ground or were laying foundations. The surrounding area is full of billboards, with the words "Residential shops are combined into one" and "Lingcheng's first new comprehensive market integrating home, operation, investment and business" and so on. The text on the billboard shows that the total investment of the project is 550 million yuan, covering an area of 57.1 acres, and the annual sales are expected to be 250 million yuan after completion in September 2020, and the main investment body of the project is Jiangsu Runling Industrial Co., Ltd.
At the sales office, a sales lady enthusiastically led the reporter to the sand table model and said: "Our shops are all 3 stories high, the smallest area is 130 square meters, the first floor can be used as a façade, and the second floor and the third floor can be inhabited." Sales manager Wei Dapeng told reporters that the sales of building materials city shops are very hot, and more than 20 building materials merchants have booked façade houses.
"I heard that you have a conflict with the villagers whose land was expropriated, and the property rights of the shops have not been finalized?" The reporter asked.
Manager Wei shook his head repeatedly, "How come?" It's been taken care of. The shop has formal property rights, 40 years, commercial land. ”
"Our contracted land has quietly become commercial land, how can we say that there is no contradiction?" Villagers Xue Yapei, Xue Peituan, Xue Peijie, etc. in Chengbei Village do not recognize the sales staff of Building Materials City.
In March 2001, the contracted land of these 32 villagers was transferred by the village committee to the Lingbei Building Materials Market, with an annual rent of 500 yuan per mu, and the contract was signed for 10 years.
Lingbei building materials market later became a wood garden market specializing in timber, with more than 100 timber dealers at the most, and only more than 40 households left in 2018. During this period, the annual rent of 500 yuan per mu of land and the government's farming subsidy were issued normally, and the 32 villagers did not renew the land lease contract with the village committee.
In 2015, the surrounding villagers successively got the red copies of land rights confirmation, but no household in chengbei village was issued, and village cadres always prevaricated on the grounds of "not doing a good job" and "not sending it to the whole village". It was not until March this year that the construction of Jinling Building Materials City was carried out, and at the repeated request of the villagers, the village issued an unpublished "Schematic Map of the Second Round Contracted Land" to the 32 households in May, saying that this was "equivalent to confirming the warrant".
"Other villagers in this village don't even have this 'confirmation of rights paper.'" Xue Yapei said, "Not only that, since the establishment of the 'Chengbei Village Muyuan Market Renovation Command' in Lingcheng Town in July 2018, after the relocation of the timber market, some people said that the contracted land of 32 of our households was expropriated." But when we inquired everywhere, we all said we didn't know. ”
The land of Chengbei Village "drifts" to the Lingcheng community
On November 8, the reporter accompanied villagers Xue Peilu and Xue Chengkai to the Suining County Natural Resources and Planning Bureau to apply for information disclosure.
The staff enlarged the land map of Lingcheng Town, compared it a little bit, and Xue Peilu and others found that the land of their 32 households was numbered "2018-110" plot, which belonged to Lingcheng Community in Lingcheng Town, and the "owner" was Jiangsu Runling Industrial Co., Ltd. Moreover, the nearly 60 mu of land was converted from "rural collective construction land" to "state-owned construction land" on January 22, 2018.
"How did the land in Chengbei Village become a Lingcheng community?" Who first converted our contracted land into 'rural collective construction land' and then into 'state-owned construction land'?" In the face of villagers' questions, the staff repeatedly said, "Wait for the information to be made public."
According to the data, the "2018-110" plot was converted into the 6th batch of village and town construction land in the province in 2017, and was publicly "bidded, auctioned and listed" on December 4, 2018, and was bid by Jiangsu Runling Industrial Co., Ltd. for 27.8 million yuan.
The reporter also rushed with the villagers to the Lingcheng Town Land and Resources Institute. "Your land has long been converted into construction land!" Ni Bo, a cadastral archivist at the institute, said affirmatively.
"When will our land be transformed? Can you check it out on your computer?" The villagers pleaded.
"I've only been working in the institute for a few years, and I can't find everything on this computer." Ni Bo said that according to Suining County's compensation standards for land acquisition, there are no green shoots on the nearly 60 mu of land, which belongs to "construction land", and can only compensate more than 20,000 yuan per mu. "Now, we refer to the standards of the surrounding villages and give you more than 50,000 yuan per acre of compensation, which is already very high!"
Unconvinced, the villagers again came to the Suining County Natural Resources and Planning Bureau on November 11 to apply for information disclosure. Liu Section Chief of the Cultivated Land Protection Section explained: "Chengbei Village is separated from Lingcheng Community by one street, and the land in Chengbei Village becomes Lingcheng Community, and we can 'patch' in the system to solve it." As for the review of cadastral archives, according to the relevant provisions of the government's application for information disclosure, it will be replied within 20 working days. ”
Expropriation and then compensation is suspected of violating the law
On November 11, Wang Wei, director of the Lingcheng Land and Resources Institute, told the relevant villagers that the nearly 60 acres of land had indeed been expropriated, and the land requisition money had already been paid to the township government account, and the specific figure was inconvenient to disclose.
Subsequently, the reporter contacted Wei Lizhong, secretary of the party branch of Shangcheng North Village, by phone. He said: "If you want to get compensation, these 32 households need to sign the land acquisition agreement first." In the village, it is necessary to verify how much land each household has to do in order to make a watch and divide the money. ”
"What happened to the change in the nature of the land? Do you know?" The reporter asked. Wei Lizhong replied that he was not clear, "Anyway, the compensation fee of three or four million yuan has already been paid to the town government account, and in the future, the distribution will be directly to the farmer's card, without going through the village." ”
On November 17, the reporter called to ask Liu Hongye, deputy director of the Lingcheng Land and Resources Institute, that the contracted land had been converted into rural construction land before 2017, why could farmers still get the second round of land contract confirmation certificate after that, and there was also a farming insurance subsidy every year? If the land supervision department does not know about the violations such as changing the nature of the land twice, first requisitioning and then compensating, how can the peasants' right to know and the right to income be guaranteed?
"China implements a strict land use management system, and in the process of land acquisition, it is necessary to disclose land acquisition information and compensation and resettlement plans in accordance with the law. Construction can only be started if the villagers' representatives sign, carry out the expropriation in accordance with the law, and implement the expropriation in full place, such as the land compensation fee and the resettlement subsidy fee, can the construction of the soil be started, otherwise it is suspected of violating the law.
