Falling into the bottomless abyss because of gambling

Born in Shanghai, Wang received his LLM from the University of East Anglia in 2002 and worked as a lecturer at a private university after returning to China, and later as a legal adviser to a state-owned enterprise in Shanghai. On June 16, 2018, Wang Ji could not wait to rush back to Wuxi, and surrendered himself to the nearby Anfu County Public Security Bureau in Jiangxi Province, ending a life of more than five years of exile.

Case characterization is the focus

In September 2018, the Supervision Commission of Wuxi City, Jiangsu Province, designated the Yixing Municipal Supervision Commission to file an investigation against Wang. During the investigation, the Yixing Municipal Procuratorate accepted the invitation of consultation and sent personnel to intervene in the case in advance. After carefully reviewing the relevant evidentiary materials, the procurator handling the case repeatedly discussed with the investigators of the Supervision Commission whether Wang Yi used his position to commit crimes in this case, and whether he was a state functionary, which also concerned the qualitative issue of the entire case.

The procurator handling the case proposed to the investigators that the organizational procedures for the promotion and appointment and removal of Wang Ji from the company where he joined the company could not be determined to meet the requirements of the relevant judicial interpretations, and the personnel who were approved or made by the organization responsible for managing and supervising state-owned assets in the state-funded enterprise or made a research decision on behalf of the person engaged in organization, leadership, supervision, operation, and management work in the state-owned holding company. From the perspective of doubts benefiting the defendant, it is also inappropriate to determine that Wang Ji belongs to the state functionary. Therefore, Wang's criminal acts cannot be separately identified as embezzlement, embezzlement, and bribery, but should be regarded as misappropriation of funds, embezzlement of office, and bribery of non-state employees. In the end, the Supervision Commission adopted the opinions of the procuratorial organs.

On March 5, 2019, the Yixing Municipal Procuratorate accepted the case in accordance with the law, and on the same day, it took compulsory measures of criminal detention against Wang Qi, and on March 19, it approved his arrest in accordance with the law.

After investigation, from the end of 2009 to the beginning of 2013, the defendant Wang Ji took advantage of his position to embezzle a total of more than RMB7.35 million of the company's funds for personal use while serving as the director of the legal and intellectual property management department of China Resources Microelectronics Co., Ltd., and did not repay it for more than three months; Taking advantage of his position, deliberately exaggerating the expenditure of work expenses, arbitraged 1.5 million yuan of the company's funds through false invoicing by others, and illegally appropriated more than 390,000 yuan of them for himself; Taking advantage of his position, in the process of handling the company's legal affairs, he sought benefits for others and illegally accepted bribes totaling RMB700,000 from others.
