Yesterday, the reporter learned from the Tianjin Municipal Market Supervision Commission that in order to establish and improve the trading norms and behavioral norms of market entities in the network industry and strengthen the standardization of e-commerce, the Beijing Municipal Market Supervision and Administration Bureau, the Tianjin Municipal Market Supervision and Administration Commission, and the Hebei Provincial Market Supervision and Administration Bureau jointly revised and issued a new "Service Contract for online commodity trading platforms in the Beijing-Tianjin-Hebei region (A kind of book)". The model text is applicable to the use of online trading platform operators and operators within the online trading platform when signing platform service contracts on the matter of entering the platform.

Compared with before the revision, the new model contract text further improves the rights and obligations of both parties to the contract in terms of qualification review, cost settlement, quality assurance, distribution and transportation, intellectual property protection, etc., and adds many new "constraints".

Among them, the Contract clarifies that platform operators shall not fabricate transactions or fabricate user evaluations; shall not use methods such as misleading displays to pre-position praise, post-bad reviews, or evaluations that do not distinguish between different goods or services; shall not use methods such as false spot, fictitious reservations, and false rush purchases to carry out false marketing; must not fabricate traffic data such as clicks and attention, as well as fictitious transaction interaction data such as likes and rewards as false or misleading commercial publicity.

In addition, the Contract also requires that online commodity trading platforms must not "choose one of the two", and must not force or use technical means to restrict or prohibit business operators within the platform from carrying out the same type of business activities on other platforms. Business operators within the platform shall provide consumers with search results for goods or services based on their personal characteristics such as interests, hobbies, consumption habits, browsing history, and so forth, and at the same time provide consumers with options that do not target their personal characteristics in a conspicuous manner, respecting and equally protecting the lawful rights and interests of consumers.
