From August to December 2020, defendant Zhou illegally obtained the account ID and password of other people's camera devices that had been cracked through QQ purchase or exchange, and added them to a certain app of his mobile phone, illegally controlling other people's cameras to spy on other people's privacy.

By the time of seizure, Zhou had illegally controlled a total of 43 camera devices (each device contained multiple cameras, a total of 235).

In March 2021, Zhou voluntarily surrendered after receiving a phone call from the police. After the case was brought to justice, Zhou truthfully confessed the above-mentioned criminal facts.

The court held that Zhou violated state regulations by exercising illegal control over the computer information system, the circumstances were serious, and his behavior had constituted the crime of illegally controlling the computer information system. The charges charged by the public prosecution were convicted.

Recently, the Haicang court made a first-instance judgment, finding defendant Zhou Mou guilty of illegally controlling computer information systems, sentencing him to 6 months imprisonment and a fine of 3,000 yuan. In addition, the main computer and mobile phone of the crime tool seized in the case shall be confiscated in accordance with law.

The judge said that according to the regulations, if there are 20 or more computer information systems, it is a "serious circumstance" and sentenced to fixed-term imprisonment of not more than 3 years or criminal detention, and shall also be fined or fined individually; if the number reaches 100 or more, it is a "particularly serious circumstance" and is sentenced to fixed-term imprisonment of not less than 3 years but not more than 7 years and a fine.

The judge reminded that in the Internet era, many families will choose to install cameras at home, but when purchasing and installing, the general public should pay attention to: first, choose regular channels to buy trustworthy brand intelligent camera equipment; second, pay attention to the placement, do not install in private spaces such as bathrooms and bedrooms, such as cameras with rotation functions, pay attention to the shooting range of rotation; third, set advanced protection passwords, use security networks, and upgrade patches in time; in addition, do not expose the camera IP address at will.
