At about 17:00 on January 16, 2020, defendant Tian and his wife Liu had a quarrel at their home on the 7th floor, when Liu was standing by the window, and when Tian took the Guanyin Buddha statue and threw it at his wife, the Guanyin Buddha statue smashed the window glass, and some of the broken Guanyin Buddha statue flew out of the window. Although defendant Tian's high-altitude projectile behavior did not cause serious consequences, his behavior has constituted the crime of endangering public safety by dangerous means. The facts charged by the public prosecution organs are clear, the evidence is credible and sufficient, and the charges are established.
Defendant Tian X voluntarily confessed his crime during the public security organs' investigation, which is a voluntary surrender, and the punishment may be mitigated in accordance with law. Defendant Tian X actively compensated the victim for economic losses, and obtained forgiveness, he may be given a lighter punishment as appropriate. Defendant Tian voluntarily admits guilt and accepts punishment, and may be given a lenient punishment. On the basis of the facts, circumstances, and degree of harm of defendant Tian X's crime, and in accordance with the provisions of articles 114, 67, paragraph 1, and 47 of the Criminal Law of the People's Republic of China, and article 15 of the Criminal Procedure Law of the People's Republic of China, defendant Tian X was convicted of the crime of endangering public security by dangerous means and sentenced to fixed-term imprisonment of one year and six months.
