Implement "first certificate and then verification" for 108 enterprise-related business license matters

How to simplify the approval of access and solve the problems of "easy to apply for licenses" and "access is not allowed to camp"? Since July 1 this year, the Guangdong Provincial Market Supervision Bureau has implemented a full-coverage list of enterprise-related business license matters throughout the province, and has included 523 enterprise-related business license matters set by the central government and 4 enterprise-related business license matters set by Guangdong into the scope of reform, and has been classified and promoted in accordance with various methods such as implementing notification commitments and optimizing approval services.

Among them, in terms of the implementation of the notification commitment, in Zhongshan City, Guangzhou Panyu District and other places to increase the reform and innovation of food, special food, drugs, medical device business licenses, the first batch of 11 types of certification materials to implement the notification commitment, the on-site verification to be implemented within 15 working days after the issuance of the certificate. The approval cycle in the field of food business has been compressed from 10 working days to 1 working day to complete, so as to achieve "access is quasi-operation".

In terms of optimizing the examination and approval service, the 108 enterprise-related business license matters are "first certified and then verified", the applicant promises that the business premises meet the licensing conditions, the examination and approval authority issues the permit first, carries out on-site verification within a certain time limit, further simplifies the process, compresses the time limit for handling, and some business can be completed on the spot. Where the license issued by the provincial government department is obtained by the approval department through data sharing, the applicant is no longer required to submit, and the materials that have been received in the pre-approval process (such as applying for a business license) are no longer required to be submitted repeatedly by the applicant. At present, a total of 120 matters are exempt from submitting business licenses, pre-permits and other materials.

Inter-provincial and cross-border business no longer "turn back"

When enterprises handle business in different places, how should they avoid cross-provincial and cross-border "turning back"? The relevant person in charge of the Guangdong Provincial Market Supervision and Administration Bureau said that the Guangdong Provincial Market Supervision System has signed cooperation agreements with relevant departments of 18 cities (districts) in 8 provinces, autonomous regions and municipalities directly under the Central Government to carry out point-to-point cooperation and docking, and provide "inter-provincial communication" services such as the whole process of online office, off-site collection agency office, and multi-local joint office. Improve the online cooperation mechanism, open a special column for inter-provincial communication offices on the government service network, and provide a unified entrance for off-site affairs. Optimize offline services, through the "separation of receipt and acceptance", enterprises can submit application materials in the local government service hall, and send them to the territorial department to complete business processing through postal delivery and other means to ensure that the rights and responsibilities of the two places are clear and efficiently coordinated. Establish channels for mutual inspection of government service information, bringing about mutual inspection and mutual recognition of market entity information, administrative licensing information, and relevant business file information.

Innovatively launch the "Bank-Government Connect" service in Guangdong, Hong Kong and Guangdong-Macao, relying on the network resources of commercial banks in Hong Kong and Macao, handling the registration business of market entities on behalf of the market, collecting and forwarding application materials on behalf of the enterprise, and realizing the "Bay Area General Office" of enterprise registration. At present, Hong Kong and Macao enterprises and residents can apply for a business license in Guangdong Province through the overseas outlets of 7 commercial banks, including bank of China and China Construction Bank. Shenzhen, Zhuhai, Jiangmen and other places have also implemented the "Shenzhen-Hong Kong Stock Connect Registration Easy", "Zhuhai-Macao Connect Registration Easy" and "Smart Bay Area Pass" services to provide investors with "one-stop" services such as personnel registration, business filing, online remote counseling, etc., to avoid cross-border "turnback runs" for enterprises.

The "commitment system" of tax clearance solves the problem of "difficulty in exiting" of enterprises

With the deepening of the reform of the commercial system, the time for enterprises to start up has continued to be compressed, and market access has become more convenient, but the problem of "difficult exit" caused by the difficulty of liquidation of enterprises is still prominent. In this regard, the Guangdong Provincial Market Supervision Bureau took the implementation of the commitment to inform the certification matters as the starting point, and worked with the tax department to formulate the "Implementation Plan for Deepening the Reform of the Withdrawal System of Market Entities in Guangdong Province", and took the lead in implementing the "commitment system" for tax clearance.

According to the provisions of the Tax Collection and Administration Law, before deregistration, an enterprise must complete the liquidation, submit a tax clearance certificate to the tax department, and handle matters such as clearing taxes, fines, late fees, and paying and canceling invoices. After the implementation of the "commitment system" for tax clearance, if an enterprise applies for tax cancellation, the tax authorities fail to complete the verification within 20 working days or fail to inform the enterprise of the results, and all investors of the enterprise undertake in writing to bear the responsibility for the settlement of the enterprise's debts and taxes, they are exempted from submitting tax clearance certificates, which is difficult to solve the difficulty of enterprise withdrawal. At the same time, we will strengthen the main responsibilities of enterprises and investors, and improve the efficiency of tax cancellation and enterprise cancellation.

In addition, if an enterprise applies for deregistration through the "commitment system" for tax clearance, the market supervision department shall inquire online whether the tax department applies the commitment system to the enterprise before accepting it. If the enterprise has not handled the tax-related matters, has existing tax clearance documents, or the tax department has not completed the tax cancellation application within 20 working days of the enterprise's submission of the tax cancellation application, it may be handled in accordance with the tax clearance commitment system process. After the market supervision department completes the deregistration, the relevant information is fed back to the tax department to achieve two-way information sharing and in-depth business collaboration.
