Guangzhou: Fraudulent registration of real estate will be punished for untrustworthiness

What norms should be followed for the registration of immovable property? How to optimize real estate registration? On October 27, the Standing Committee of the 15th Guangzhou Municipal People's Congress held its 56th meeting to vote and pass the Measures for the Registration of Real Estate in Guangzhou (hereinafter referred to as the "Measures"), which will be formally implemented after approval by the Standing Committee of the Provincial People's Congress.

In terms of optimizing the handling mechanism, the measures propose to establish a unified real estate registration platform in the city, gradually implement the whole process of online processing, optimize the handling process, and provide convenient and efficient services for the parties. The measures also propose mechanisms such as "one-window acceptance and integrated handling" and sharing registration information, approval information, and transaction information to facilitate the handling of real estate.

In terms of the time limit for handling, the measures make it clear that the real estate registration agency shall complete the real estate registration formalities within five working days from the date of accepting the registration application, and the sealing registration and opposition registration shall be completed immediately.

According to the measures, the certificate of immovable property ownership or registration certificate of electronic media has the same legal effect as that of paper media.

Can I register for real estate when buying pre-sale commercial housing? The Measures put forward the provision of "advance notice registration", which makes it clear that if the parties sign an agreement for the sale and purchase of commercial housing or other real estate property rights agreement, they may jointly apply to the registration agency for advance notice registration in accordance with the agreement.

In terms of the registration of the ownership of the common part of the owners that has attracted much attention, the measures also clarify the relevant provisions, and the roads, green areas, other public places, public facilities, property service houses and the construction land use rights within the scope of their occupation that belong to the owners in accordance with the law should be applied for registration as the owners' common ownership.

The measures also clarify the registration requirements for public construction supporting facilities, stipulating that supporting public service facilities transferred free of charge and transferred at cost price shall be recorded in the real estate register.

For acts such as fraudulently obtaining registration, the measures are clear, and acts such as fraudulently obtaining real property registration by submitting false materials, concealing the true situation, or fraudulently obtaining real estate registration through forgery, alteration, or sale of official documents, certificates, and other evidentiary materials, causing damage to others, will not only bear legal responsibility, but will also be punished for untrustworthiness in accordance with law.
