According to official news from FIFA, the FIFA Independent Ethics Committee ruled that Beckenbauer, Theo-Zwanziger and Horst Schmidt had violated the 2006 World Cup, but according to Article 12 of the FIFA Code of Ethics (FCE), the three will not be prosecuted due to the expiration of the prosecution period.

The Independent Ethics Committee's investigation into violations by Beckenbauer and others began on 22 March 2016, when the three allegedly paid a bribe of 10 million Swiss francs to Haman, then a member of the FIFA Executive Committee, on behalf of the Organizing Committee in 2002, in violation of Article 27 of the FIFA Code of Ethics. This amount is related to the allocation of 250 million Swiss francs approved by FIFA to the World Cup Organizing Committee between 2002 and 2006.

However, in calculating the effective time limit, the FIFA Independent Ethics Commissioner ruled that the start time of the allegations of violations by the above officials should not be based on the duration of the entire bribery process (until 2006), but on the exact point in time at which each person violated the rules.

As a result, the Independent Ethics Committee ruled that the indictment against Beckenbauer expired in 2012 and that the time limit for the prosecution of Zwanziger and Schmidt expired in 2016, and that they would not be prosecuted again, taking into account the provisions of Article 12 of the FIFA Code of Ethics Regulations.
