On October 27, the National Health Commission issued the Detailed Rules for the Supervision of Internet Diagnosis and Treatment (Draft for Comments) (hereinafter referred to as the "Opinion Draft"), which listed detailed provisions on the supervision of medical institutions, personnel supervision, business supervision, quality and safety supervision, and regulatory responsibilities, which aroused great concern in the industry.

In the past few years, under the encouragement of frequent favorable national policies, Internet medical care has flourished, and various new formats have blossomed - forming a digital medical track that focuses on providing serious medical services represented by weDoctor and good doctors, a pharmaceutical e-commerce track that provides online health care products, OTC and prescription drug sales, and AI consultation and light consultation that provide simple health consulting services. While jointly promoting the digital transformation of medical care, they are also exploring standardized standards for the development of the industry.

Obviously, the purpose of the "Opinion Draft" is to clearly determine the original vague and confusing boundaries of Internet medical treatment, completely break the previous ambiguous situation of "medicine, medicine and technology", the so-called "medicine to medicine, medicine to medicine, technology to technology", so that Internet medical treatment returns to the essence of "serious medical treatment". China's Internet medical development has been at the forefront of the world, and the industrial investment scale of China's digital health industry has become the second largest country after the United States, which is closely related to the consistent policy encouragement and support in China.

As early as October 2016, the "Healthy China 2030" Planning Outline clearly proposed to "develop Internet-based health services". In April 2018, the "Opinions on Promoting the Development of "Internet + Medical Health"" called for accelerating the development of "Internet + medical health", so that patients can run less errands and be more convenient, so that more people can share high-quality medical services. Since then, a series of documents have been intensively released to regulate Internet medical care in more detail, which has greatly promoted the rapid development of Internet medical treatment.

The Draft Opinions inherit the direction of the state's encouragement of Internet medical treatment. At the same time, a new signal has been released through strengthening supervision - Internet diagnosis and treatment should be "homogeneous" with the diagnosis and treatment services provided by physical institutions to the greatest extent, so that Internet diagnosis and treatment can return to the positioning of "providing serious medical services", which is mainly reflected in three aspects:

First of all, block the online "medicine for medicine" online. The "Draft Opinions" proposes that "the occurrence of problems such as unified parties and supplementary prescriptions" is prohibited, "the personal income of medical and health personnel must not be linked to the income of drugs and medical examinations", the Internet diagnosis and treatment and drug sales behavior are "isolated", the Internet diagnosis and treatment platform is prevented from "alienating" the diagnosis and treatment behavior into a prescription drug marketing tool, and the "Internet drug sales" atmosphere is stopped, so that "medicine" is attributed to "medicine".

Second, prevent the misuse of "AI technology". The Draft Opinions make it clear that "physicians need to undergo real-name authentication before receiving treatment to ensure that they are admitted by themselves." Other personnel, artificial intelligence software, etc. must not fraudulently use or substitute for physicians to receive treatment. This has made a normative restriction on the application of AI technology in Internet medical treatment, limiting AI to be used for physician assistance such as guidance and auxiliary diagnosis, rather than replacing manual services, so that "technology" belongs to "technology".

In addition, put an end to "fish-eyed beads". The Draft Opinions put forward higher requirements for the digital ability of Internet diagnosis and treatment service entities, such as "medical institutions' electronic prescriptions, prescription audit records, and prescription review records should be traceable, and open data interfaces to provincial regulatory platforms", "medical institutions should have special departments to manage the medical quality, medical safety, pharmaceutical services, information technology, etc. of Internet diagnosis and treatment, and establish a corresponding management system", which undoubtedly raises the industry entry threshold as a whole. Whether there is the corresponding Internet medical infrastructure, and related technical capabilities and operation management experience will become an important prerequisite for compliant operation.

The digital medical track focusing on serious medical services has ushered in a positive situation

The timely promulgation of the "Draft Opinions" obviously takes into account the current situation of irregularities, vague positioning, fragmentation and even "edge balls" in the current Internet medical treatment, and supervises Internet medical care according to the standards of serious medical behavior, ensuring service security, raising the industry threshold, ensuring service quality, and returning to the essence of medical services, which obviously brings "spring" to the major platforms of the digital medical track.

Of course, to a large extent, this is also based on the consensus reached in industry practice. Therefore, how to use digital means to leverage the reform of hierarchical diagnosis and treatment is an opportunity for Internet medical treatment to "turn around" and truly exert great value.
