Anti-deception alliance news: In the previous article, we introduced the past matters of crispy early morning, and early morning was executed in the early morning this year, this article we will open the case for the live broadcast of the chairman of crispy early morning, as well as the investigation of the case filing of crispy crackers.
False publicity of the product in the live broadcast room was exposed
In the past two years, live streaming with goods has begun to rise on the Internet. With the popularity of Li Jiaqivia, many companies have also been involved.
It is reported that Li Qingnan, chairman of Liaoning Early Morning Biology, appeared on his e-commerce platform - Nande Zhenxuan's live broadcast room on January 16 this year to personally carry goods.
During the live broadcast, Li Qingnan said in the introduction of a lipstick called Medesi that the product is "a pure natural lip balm imported from Europe".

The Anti-Deception Alliance learned that the product is a Meadows Resort Series Lip Balm (Green Pear Flavor). Through the State Drug Administration cosmetics filing inquiry, we found that the meadow silk lipstick was indeed imported from Europe. The lipstick is produced in the Netherlands and manufactured by Mades Cosmetics Ltd. The main manifestations of this lipstick are: petrolatum, lanolin, white beeswax, ricinus communis (RICINUS COMMUNIS) seed oil, laurate, fragrance, tocopherol (vitamin E), CI 19140, CI 61565.
It is reported that CI 19140 is a lemon yellow, a chemical substance, the English name is KI4. The main role in cosmetics and skin care products is colorants. However, the amount of lemon yellow added to food is limited, and there are safety hazards in large quantities.
Customer service at The South Enders said the lipstick contained edible additives and used "food-grade natural ingredients," seemingly implying that the product was a food-grade cosmetic, thus avoiding the issue of chemicals.
In addition, the food-grade cosmetics implied by customer service are conceptually non-existent.
According to a document issued on the official website of the State Food and Drug Administration on October 18, it is clear that "food-grade" cosmetics are misleading to consumers.
In fact, cosmetics and food are two different categories of products, according to different laws and regulations, the application of different product standards, raw material requirements, production conditions, etc., there is no so-called "food-grade" cosmetics. The safety of cosmetics has nothing to do with whether it is "edible".
According to the Regulations on the Supervision and Administration of Cosmetics, cosmetic labels are prohibited from being labeled with "false or misleading content". The labeling of cosmetics declares "food grade" and "edible", which violates the regulations on the management of cosmetic labels and should be prohibited.
In addition, in the article "Identifying Illegal Claims and False Publicity of Cosmetics" issued by the State Food and Drug Administration, it is shown that cosmetics that only add part of the ingredients of natural products, but declare that the products are "pure natural", are false meanings.
So why is the publicity of "pure natural cosmetics" often seen on the market?
Many consumers take it for granted that natural things are healthier and safer than chemical products. Merchants seized on this consumer psychology to make a fuss, and once hit billboards such as "pure natural", "pure plants" and "no additives". In order to guide consumption and regulate the market, China's newly revised Advertising Law stipulates that it is forbidden to use absolute propaganda words such as "pure plants", "pure natural" and "non-toxic" and "no side effects" in commercial advertisements.
"Crispy biscuits" have been investigated
In fact, not only is there false publicity in cosmetics, but also crispy biscuits have been investigated and punished for false advertising. According to China Medical News, a few days ago, the Market Supervision Bureau of Nanxun District, Huzhou City, Zhejiang Province, seized a case of false advertising of "crispy biscuits" in the rectification of false advertisements for food and health products. The biscuit comes from a biotechnology company in Liaoning.
On the day of the crime, when the law enforcement personnel of the Nanxun District Market Supervision Bureau inspected a shop in the Menghu Community of Linghu Town, they found that the content of a propaganda poster in its store was nominal: "Crispy Biscuits - Specially Challenging All Kinds of Fat That Cannot Be Reduced", "Crispy Biscuits Healthy Weight Loss", "7 Days To Lose 5 to 10 Pounds", "16 to 30 Pounds in a Month", and equipped with "Crispy Biscuit Weight Loss Renderings". Its promotional business card is also marked with the words "Crispy Biscuit Fat Reduction Expert" and "Crispy National Agent Partner", and the promotional materials are printed with "Crispy 100 Questions and Answers of Diseases" and "Symptoms of Eating After Eating of 100 Questions and Answers of Crispy Cakes and Answers".
According to the shop operator, on November 16, 2017, he placed an order from a biotechnology company in Liaoning for 320 boxes of crispy egg ball biscuits at a purchase price of 200 yuan / box and a sales price of 388 yuan / box. The parties mainly obtained the customer's original body fat information through posters, manuals, materials, Tsinghua Tongfang Body Fat Scale and Tongfang Health Technology (Beijing) Co., Ltd. APP, and then sold crispy egg ball biscuits to customers, and regularly collected and registered the body fat information after each customer took it. As of the date of the crime, a total of 190 boxes had been sold.
Law enforcement officers found 25 customers' body fat information record ledgers at the scene, as well as 130 boxes of 15g/bag× 21 bags and 32 boxes of 15g/bag×6 bags of experience-packed crispy egg ball biscuits, so they seized the biscuits and promotional materials suspected of being suspected of problems in accordance with the law.
Since the biscuits sold by the parties are only ordinary food, in the process of sales, they use promotional posters, brochures, publicity business cards, publicity materials, etc. to make functional publicity for weight loss, and their behavior is suspected of violating the provisions of Article 73 of the Food Safety Law, that is, false publicity of food in advertisements. At the same time, due to the suspected other illegal acts in this incident, at present, the Nanxun District Market Supervision Bureau has filed a case investigation against the parties.
postscript:
In fact, since the "Notice" issued by the State Administration for Market Regulation, it is easy to challenge the legitimacy of the acquisition of early morning biology by crispy, but whether the acquisition of early morning biology by crispy is compliant or not still needs to be investigated by the regulatory authorities. In this context, whether the early morning in the market will be affected, the anti-transmission anti-deception alliance will continue to pay attention to it.
