According to the "Anhui Release" WeChat public account news, the Anhui Provincial Government recently approved the "2019•11•15" Large Fire Accident Investigation Report in Longzihu District, Bengbu City, agreeing with the investigation team's determination of the cause and nature of the accident, the handling suggestions for the responsible personnel and responsible units, and the accident prevention measures proposed.
At about 6:57 on November 15, 2019, a fire accident occurred in Building 853, Zhunhe Road Station Xincun, Longzihu District, Bengbu City, causing a total of 5 deaths, 3 injuries, and direct economic losses of 4.522 million yuan.
The investigation report determined that the direct cause of the accident was: the third shop on the east side of the first floor of the 853th building of the station Xincun on the west side of the Railway Station in Bengbu City, the third shop in the bengbu special snack bar did not close the cylinder gas valve after the use of the cylinder, the liquefied petroleum gas leaked, after reaching the explosion limit, the open fire exploded and ignited the indoor combustibles, coupled with the use of non-flame retardant materials such as wooden partition walls and plastic ceilings in each store, resulting in the rapid spread and expansion of the fire.
The indirect causes of the accident are: the main responsibility for safe production of the relevant production and operation units is not in place, the safety supervision of the relevant regulatory departments is not in place, and the local government supervises and guides the relevant departments to perform the fire and gas safety supervision duties of the accommodation and catering industry.
The investigation report pointed out that the person responsible for the accident, Wang Zhaoshui and Wang Miao, have been criminally detained by the public security organs; the 2 responsible persons of the production and operation units related to the accident have been given administrative punishments; and the 11 personnel involved in the accident, such as the government and departments (units), have been given corresponding party discipline and government affairs sanctions and the implementation of organizational handling.
The specific liability determination and handling recommendations are as follows:
(1) Personnel whose public security organs have taken compulsory measures (2 persons)
1. Wang Zhaoshui, the actual payer of the rent of Bengbu specialty snack bar, is responsible for the daily operation of the store. When the store was closed the day before the accident, the liquefied gas cylinder was not closed, and the liquefied gas leak reached the explosion limit and exploded in an open flame, and he has been criminally detained by the public security organs.
2. Wang Miao, the person in charge of Xiaozhou Fast Food Restaurant in Longzihu District, Bengbu City, and the signatory of the lease contract of Bengbu Specialty Snack Shop, has been criminally detained by the public security organs.
(2) Bengbu Anliu Clean Energy Co., Ltd. (2 people)
1. Lu Jianguo, the legal representative of Bengbu Anliu Clean Energy Co., Ltd., the person in charge of the Qiugang ventilation station of Bengbu Anliu Clean Energy Co., Ltd., the company's safety management is chaotic, the supervision and management of the subordinate ventilation stations are not in place, some of the company's subordinate ventilation stations (including the Qiugang ventilation station) have not obtained gas business licenses to engage in gas business activities; the quality of the liquefied gas provided to customers does not meet the requirements of national standards; some liquefied gas cylinders do not have steel seal marks; and the user files of liquefied gas users are not established as required. The publicity and guidance for the safe use of gas by gas users is not in place, and the safety inspection of gas facilities of gas users is not carried out as required, and the main management responsibility for the occurrence of accidents is borne by them. It is recommended that the competent gas department of Bengbu City punish it according to law.
2. Xiao Yimin, shareholder of Bengbu Anliu Clean Energy Co., Ltd., the actual person in charge of the company's operation, and the legal representative of the company's gas business license. The company's safety management is chaotic, the supervision and management of the subordinate ventilation stations are not in place, and the accident is mainly responsible for the occurrence. It is recommended that the competent gas department of Bengbu City punish it according to law.
(3) Zhihuai Subdistrict, Longzihu District (2 people)
1. Liu Juan, a member of the Communist Party of China, a member of the Party Working Committee of Zhihuai Street in Longzihu District (appointed as the deputy director of the District Housing Management Bureau in October 2016, did not perform his duties in the Housing Management Bureau due to staffing problems, and is still working in the street office), participated in the division of labor in the leadership team of Zhihuai Street, in charge of safety production, emergency response and other work. The implementation of national and provincial laws and regulations on fire protection and bottled liquefied petroleum gas safety management is not in place. Supervise and guide relevant departments to carry out ineffective supervision of fire fighting and bottled liquefied petroleum gas safety, and do not implement the deployment of the investigation and management of bottled liquefied petroleum gas safety and accommodation places in catering establishments in the jurisdiction, and have the main leadership responsibility for the occurrence of accidents. According to the provisions of Article 8(5) of the Interim Provisions on Administrative and Disciplinary Punishment of Violations of Laws and Discipline in the Field of Work Safety, it is recommended that a government warning be given.
2. Gu Zhaochun, a member of the Communist Party of China, deputy secretary of the Party Working Committee and director of the office of the Zhihuai Subdistrict Office, is responsible for the overall work of the Zhihuai Subdistrict Office and coordinating public security and other work. The implementation of national and provincial laws and regulations on fire protection and bottled liquefied petroleum gas safety management is not in place. Supervise and guide relevant departments to carry out ineffective fire fighting and bottled liquefied petroleum gas safety supervision for catering and accommodation places, and have important leadership responsibilities for the occurrence of accidents. According to article 3 (3) of the Interim Measures for Conducting Exhortation Talks and Correspondence with Party Members and Leading Cadres, it is recommended to give exhortations.
(4) Longzihu District City Administration Bureau (3 people)
1. Li Wei, a member of the Communist Party of China, is the squadron leader of the Zhihuai Squadron of the Longzihu District Urban Management Bureau, responsible for the urban management and law enforcement work of Zhihuai Street. The safety supervision of bottled liquefied petroleum gas in the jurisdiction is not effective, the supervision of gas business licenses, the supervision and guidance of gas operating enterprises to guide users to use gas safely, and the regular safety inspection of gas facilities and the elimination of hidden dangers are not in place, and they have the main leadership responsibility for the occurrence of accidents. According to the provisions of Article 8(5) of the Interim Provisions on Administrative And Disciplinary Punishment for Violations of Laws and Discipline in the Field of Work Safety, it is recommended that the punishment of excessive administrative record be given.
2. Wang Yinghua, a member of the Communist Party of China, is the head of the Municipal Garden Department of the Longzihu District Urban Management Bureau, responsible for municipal (gas supervision) and garden work. The supervision of gas operation permits in the jurisdiction, the safety supervision and inspection of bottled liquefied petroleum gas operations and the use of liquefied petroleum gas are not in place, and the Qiugang gas exchange station of Bengbu Anliu Clean Energy Co., Ltd. has the main leadership responsibility for the occurrence of accidents for carelessly inspecting and mistaking pipes for gas business activities without obtaining a gas business license. According to the provisions of Article 8 (5) of the Interim Provisions on Administrative and Disciplinary Punishments for Violations of Law and Discipline in the Field of Work Safety, it is recommended that a government warning be given.
3. Sun Xuan, a member of the Communist Party of China, is the director of the Longzihu District Administrative Law Enforcement Brigade (a member of the Party Committee and deputy director of the Longzihu District Administrative Law Enforcement Bureau), responsible for safe production and other work, in charge of the market management office. The safety supervision of bottled liquefied petroleum gas in the jurisdiction is ineffective, and the supervision and guidance department in charge of implementing the gas business license, gas operation and use of safety supervision responsibilities are not in place, and they have important leadership responsibilities for the occurrence of accidents. According to item (3) of article 3 of the "Interim Measures for Conducting Exhortation Talks and Letters of Inquiry to Party-member Leading Cadres," it is recommended that the admonitions be given.
(5) Longzihu District Bureau of Commerce and Foreign Affairs (1 person)
1. Zhang Zhitong, a member of the Communist Party of China, a member of the Party Group and deputy director of the Longzihu District Bureau of Commerce and Foreign Affairs, is responsible for the safety production supervision and inspection of commercial and trade circulation enterprises in the region. Failure to conscientiously implement the responsibility of managing safety in the management industry, ineffective guidance on safe production in the commercial and trade service industries such as the catering industry and accommodation industry in the jurisdiction, and the main leadership responsibility for the occurrence of accidents. It is recommended that it be instructed to make an in-depth written inspection to the Longzihu District People's Government.
(6) Yan'an Police Station of Longzihu Branch of Bengbu Municipal Public Security Bureau (2 people)
1. Zhao Heliang, a member of the Communist Party of China, deputy director of the Yan'an Police Station of the Longzihu Branch of the Bengbu Municipal Public Security Bureau, in charge of fire control work. 2. Long Peng, a member of the Communist Party of China, is the director of the Yan'an Police Station of the Longzihu Branch of the Bengbu Municipal Public Security Bureau, responsible for the overall work of the institute. The leadership and supervision of the fire safety work in the jurisdiction are not effective, and they have important leadership responsibilities for the occurrence of accidents. Article 3 (3) of the "Interim Measures for Conducting Exhortation Talks and Correspondence with Party-Member Leading Cadres" stipulates that it is recommended to give exhortations.
(7) Longzihu District Fire Brigade (1 person)
Zhang Xianwei, a member of the Communist Party of China, is the captain of the Longzihu District Brigade of the Bengbu Fire Rescue Detachment , (from November 2017 to January 2020, he was the captain of the Longzihu District Brigade of the former Bengbu City Public Security Fire Detachment) and is responsible for the overall work of the brigade. The performance of daily fire safety supervision and inspection and publicity and education duties are not in place, the implementation of the supervision and random inspection duties of non-fire safety key units is not effective, and it has important leadership responsibility for the occurrence of accidents. According to article 3 (3) of the Interim Measures for Conducting Exhortation Talks and Correspondence with Party Members and Leading Cadres, it is recommended to give exhortations.
(8) Longzihu District People's Government (2 people)
1. Ma Kaifeng, a member of the Communist Party of China, deputy governor of Longzihu District Government, in charge of the District Market Supervision and Administration Bureau, the City Administration Bureau and other departments. Failed to effectively supervise and guide the market supervision departments and urban management departments in the jurisdiction to carry out the investigation and management of fire protection and bottled liquefied gas safety hazards for catering and accommodation places, and had leadership responsibility for the occurrence of accidents. It is recommended that it be instructed to make an in-depth written inspection to the Longzihu District People's Government.
2. Hu Kuozhu, a member of the Communist Party of China, a member of the Standing Committee of the Longzihu District Party Committee and the deputy head of the District Government, contacted the District Fire Rescue Brigade. Failed to effectively guide the fire department to carry out the investigation and management of fire safety hazards, and had leadership responsibility for the occurrence of accidents. It is suggested that the Longzihu District People's Government should criticize and educate it.
