Many law firms do not have clear regulations on the treatment of trainee lawyers. Recently, I read a very scary message that a trainee lawyer did not get any salary for half a year and had no choice but to go down to deliver takeaways. If this matter is true, I really want to say that this law firm should be held accountable by the corresponding judicial authorities.

Today, some people believe that there is no employment contract relationship between lawyers and law firms. This realization, of course, is wrong!

Article 41 of the Measures for the Administration of Law Firms stipulates: "Law firms shall ensure that their lawyers and auxiliary personnel enjoy the following rights: (1) to obtain the necessary working conditions and labor guarantees provided by them; (2) to obtain labor remuneration and enjoy relevant welfare benefits." "

Obviously, law firms do not have extralegal privileges and can claim that they and their trainee lawyers have not established an employment relationship.

Therefore, to give labor security to trainee lawyers and young lawyers, they must pay salaries and buy social security.

This treatment is even higher than the salary level of ordinary migrant workers. I strongly hope that the municipal bar associations will be able to establish minimum wage standards for lawyers and trainee lawyers that meet the conditions of local economic development.

Of course, as far as specific cases are concerned, I think that in Chengdu, the minimum income of trainee lawyers is 3,000 yuan / month, and the social security should be paid by the law firm in full; the minimum income of young lawyers is 6,000 yuan / month, and they should also pay social security. According to the specific standards, the unit and the employees pay separately.
