An old man in Lanxi voluntarily became a ranger after being sentenced for illegal hunting

"As a volunteer forest ranger in Dongsheng Village, the undertaker is responsible for the ecological environment management of Dongsheng Village, and promises to comply with and publicize the knowledge of forestry and ecological environment-related policies and regulations, wildlife protection regulations..." This is a "Commitment to Ecological Environment Management", and the signatory is the defendant in an illegal hunting case heard by the Lanxi Municipal People's Court.
Recently, the environmental resources trial collegial panel of the Lanxi Municipal People's Court heard a criminal case of illegal hunting. In September last year, in order to prevent wild birds from stealing dates and affecting the harvest, Ni Mou of Xiangxi Town bought a simple fishing net and fenced the jujube trees in his own farmland next to the dam in Dongsheng Village.
However, although the fruit of the jujube tree was preserved, the nearby birds suffered. On November 13, when the police seized the scene, they found that the bodies of 80 wild birds of different species had been entangled in the fishing nets. Later, according to the Lanxi Wildlife Conservation and Management Station, the 80 birds were 2 Dai Sheng, a terrestrial wild animal under key protection in Zhejiang Province, 34 starlings of terrestrial wild animals under general protection in Zhejiang Province, 23 spotted doves, 17 sparrows, 1 egret, 1 white-headed bunting, 1 yellow-browed bunting, and 1 squid.
After the on-site investigation by the public security organs and the multi-party investigation by the procuratorate, the case officially entered the trial stage. In accordance with the relevant provisions of the Criminal Law of the People's Republic of China, the Lanxi Municipal People's Court convicted defendant Ni mou of illegal hunting, sentenced him to six months' imprisonment, suspended for one year, and confiscated the fishing nets of the crime tools.
During the trial of the case, the presiding judge patiently listened to the defendant's confession and defense, and learned that the defendant was elderly and lacked legal knowledge. Therefore, the popularization of legal knowledge on the protection of relevant environmental resources was popularized, and Ni finally realized the seriousness of the matter, took the initiative to admit the illegal facts, and repeatedly expressed remorse.
In order to better fulfill the obligation of rule of law education for the defendant, through case publicity to achieve the social effect of "one piece of education in the trial", the presiding judge and the defendant reached an agreement, the defendant solemnly promised that he would act as a voluntary forest ranger, and took the initiative to sign the "Dongsheng Village Ecological Environment Management Commitment Letter", assume the obligation of ecological environment management in his village, and use his real case to publicize and educate the people around him.
This incident is a microcosm of the Lanxi Municipal People's Court's vigorous promotion of the trial of environmental protection funds, and through the innovative trial mode of environmental protection funds, the masses have experienced the judicial temperature in knowing the law, understanding the law and abiding by the law. For such cases, the Municipal People's Court actively guides the parties to carry out alternative restoration by means of afforestation, provision of labor services, and creation of animal habitats. While protecting wildlife resources, it also gave the defendants the opportunity to reform themselves, which not only restored the damaged ecological environment, but also reflected the criminal policy of blending leniency with severity.
