In this rapidly developing economy, people are no longer stuck in a city, or even a certain country, but more like the world as a stage to study, work and live. In almost every country, there will be a large number of foreigners living for a long time, and China, with its rapid economic development, will not be an exception.
In the past three or four decades, China's rapid economic development has attracted countless foreigners to travel, work or settle down, for example, in Guangzhou, there are tens of thousands of Africans engaged in foreign trade work.
However, with the increasing number of foreigners coming to China, the management of foreigners has also become a major problem. We can also often see in the news that foreigners do not comply with Chinese regulations, such as last year's epidemic period, a Tanzanian man in Beijing did not comply with the regulations on the centralized isolation of foreigners during the new crown pneumonia epidemic, and during the self-isolation period, he did not stop the neighborhood committee and the police to go out many times.
In order to better cope with this situation, on February 27, 2020, the Chinese Ministry of Justice published a "Regulations of the People's Republic of China on the Administration of Permanent Residence of Foreigners" (Draft for Comment) on its website, but it did not expect that as soon as this draft was published, it caused an uproar on the Internet, and more opposition.
Finally, the Ministry of Justice and the National Immigration Administration said that at present, the "Regulations" are still in the stage of soliciting opinions from the public, and will be further studied and improved according to the opinions of the public, and will not be hastily promulgated for the time being. Why are so many people opposed to the implementation of the Regulations? The answer has to be found in the content of the Regulations themselves.
<h1 class="pgc-h-arrow-right" >01 The Ordinance is imperative</h1>
As mentioned earlier, it is an established fact that today's society is more open and inclusive, and a large number of Chinese work or settle abroad, and a large number of foreigners come to China to work or live, and this situation will become more and more common in the future.
When we work or live abroad, we hope that our legitimate rights and interests can be guaranteed, and foreign governments also hope that we can abide by the laws and regulations it has formulated; similarly, foreigners living in China also expect their legitimate rights and interests to be protected, and the Chinese government also wants this group of people to abide by the laws and regulations it has formulated, so such a regulation on the management of foreigners is indispensable.
In fact, it is not the first regulation for foreigners. As early as 1985, China promulgated the Law of the People's Republic of China on the Administration of entry and exit of foreigners, which stipulates the permanent residence of foreigners in China, and this law has been abolished.
In 2004, the Ministry of Public Security and the Ministry of Foreign Affairs promulgated the Administrative Measures for the Examination and Approval of Permanent Residence of Foreigners in China, which for the first time unified the examination and approval criteria for permanent residence of foreigners in China, and began to issue permanent residence permits for foreigners, that is, "China Green Cards".
Later, some policies related to the rights and obligations of foreigners who have obtained permanent residence qualifications in China have been issued successively, and in 2016, the Ministry of Public Security publicly solicited opinions on the Regulations on the Administration of Permanent Residence of Foreigners (Draft), and this time the draft regulations for solicitation of comments are just to continue to promote the promotion of this management system for foreigners.
We are in an era of rapid development, the way of life is changing rapidly, and the management method for foreigners is still in 2004, and it is impossible to meet today's needs, and it is imperative to introduce new policies.
The full text of the "Regulations" is only more than 5,000 words, a total of 53 articles, mainly to determine a standard, who can come, who can not come, what rights those who come, and which rules should be observed, and what obligations to bear.

<h1 class="pgc-h-arrow-right" >02 Why are so many people against it</h1>
From a practical point of view, the emergence of the "Regulations" will help China introduce more high-tech talents and promote the progress of the country; it will also help to create a more harmonious and stable society, so that people living in this land can live and work in peace and contentment.
But if you look at the relevant comments on the articles on the Internet, you will find that people are almost one-sided in opposition, such as:
"Firmly against what perpetual rights! To speak in the head is the Tao, but it is to lure the wolf into the house, regardless of the consequences! ”
"We need foreign goods, we don't need foreigners to live in China for a long time, and we don't need rebels to return home."
"Supranational treatment is a huge threat! Other legally significant hidden dangers. ”
"After all, they are foreigners, and the illegal crimes must be resolved diplomatically, and the consequences are endless."
In fact, from these comments, it can be seen that there are three positions that people oppose:
First, proceeding purely from emotions, based on the fact that foreigners have invaded China in history and caused great harm, they have distrusted foreigners, and at the same time believe that once the Regulations are issued, they will attract more foreigners, and China's culture, race, etc. will be seriously impacted;
The second is to worry and be dissatisfied Chinese the fruits of decades or even hundreds of years of hard work will be easily obtained and enjoyed by foreigners, and even better than Chinese citizens in terms of treatment;
The third is dissatisfaction with some Chinese thinking of ways to obtain foreign nationality, and then passing permanent residence regulations, and the behavior of gold mining in the country.
To sum up, there are two attitudes of people who oppose the "Regulations", one is that no matter what you say, I just don't agree; the other is that the plan given by the "Regulations" cannot be accepted by me, and the latter one is also the reason for the uproar.
<h1 class="pgc-h-arrow-right" >03 What should we worry about the most</h1>
Indeed, judging from the content of the Regulations, there are two problems: one is that the content is too vague and there is no clear quantitative standard, and the other is that the threshold for foreigners to obtain permanent residence is too low, which involves the issue of equal treatment in the country.
Why do you say that the content of the Regulations is too vague? Let's take an example, such as Article 11:
"Foreigners who have made outstanding contributions to China's economic and social development and fall under any of the following circumstances may apply for permanent residence qualification upon recommendation by the relevant competent departments of the State or the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government."
So, what are the criteria for outstanding contribution? Is it to contribute 100 million to GDP, or to provide thousands of jobs? Or did you invent a technology that benefits humanity?
Although there are some interpretations under this regulation, such as the situation of "making outstanding contributions to China's science and technology, education, culture, health, sports and other undertakings", you will find that this interpretation is the same as no explanation, but it only stipulates the field, but does not give a standard for achieving "outstanding contribution".
And finally there is a "nother situation that has made outstanding contributions to China's economic and social development", the word "other" is equivalent to the content of the previous statement is equivalent to white, and the content of this article can also be simplified to "as long as you have made outstanding contributions, you can obtain permanent residence".
As for how to interpret "outstanding contributions", there is a lot of room for play, so will there be more unfair and just phenomena?
Another example is Article 19 of the Regulations:
"Foreigners who need to reside permanently in China for other legitimate reasons may apply for permanent residence qualifications."
What are the "other justifiable reasons"? Does my liking for Chinese culture count? If the standard of this article is followed, it is equivalent to the previous words and nonsense, and when permanent residence does not meet the above scenarios, this reason can be used to explain.
In fact, it is not only this "Regulation" that is too broad, but also many legal documents in our country, and it is precisely because many people in China have suffered losses that this time they are so true, through the form of opposition to a clear standard of measurement.
The purpose of formulating the "Regulations" is to set a standard for people to act, and if there is no clear standard, the whole text is a general language, so why talk about doing things according to the rules?
Let's talk about the issue of equal treatment in China, Article 17 of the Regulations:
"Foreigners who need family reunification and fall under any of the following circumstances may apply for permanent residence qualifications."
In the last three interpretations, it is clarified that the specific persons who need to be reunited in the family are spouses, children under the age of 18, and immediate relatives who have reached the age of 60 and have no immediate family members abroad, and also stipulate that spouses and immediate relatives other than children must live together in China for 5 years.
There are clear standards for this article, but we all know that the management of the household registration system is also different in different regions of the country, especially in first-tier cities such as Beijing, Shanghai, Guangzhou, and Shenzhen, if outsiders want to settle down, the requirements are very strict.
For example, if a foreigner marries a person with a Beijing hukou, he can only get a Beijing hukou after 15 years of marriage with his spouse, and if a foreigner obtains permanent residence in Beijing, his spouse can get permanent residence in Beijing 5 years after marriage.
In this way, the fear of foreigners over Chinese citizens has emerged, which increases the possibility of unequal treatment.
In the past management of foreigners, there are indeed some hidden "supranational treatment" phenomenon, many places do not voluntarily give special care to foreigners, the introduction of the "Regulations" caused so many people to oppose, but also for the previous management of foreigners in China is not very satisfied, worried that once the issuance of documents will aggravate this phenomenon.
This kind of worry is not unreasonable, but we must not waste food because of choking, and we must not blindly oppose the introduction of the policy because of this worry, but we must help it become more perfect, so that it can truly play the purpose of recruiting high-tech talents for our country and realize the ideal of further opening up to the outside world.
