In order to fully implement the decision-making and deployment of the Party Central Committee on the prevention and control of the new crown pneumonia epidemic and the work requirements of provincial, municipal and county party committees, resolutely win the "obstruction war" of epidemic prevention and control, and make every effort to safeguard the health and life safety of the people, in accordance with the Criminal Law of the People's Republic of China, the Law of the People's Republic of China on Public Security Administration Penalties, the Law of the People's Republic of China on the Prevention and Control of Infectious Diseases and other laws and regulations, as well as the "Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, and the Ministry of Justice" issued the "" Opinions on Lawfully Punishing Illegal Crimes Obstructing the Prevention and Control of the Novel Coronavirus Pneumonia Epidemic, the political and legal organs of the whole county will strictly investigate and crack down on relevant violations of laws and regulations during the epidemic prevention and control period in accordance with the law, and are hereby notified as follows:
I. Refusal to implement relevant epidemic prevention and control decisions and orders issued by the county party committee, county government, and their epidemic prevention and control headquarters in accordance with law.
2. Violations of epidemic traffic management regulations do not listen to dissuasion, forced passage, or enter and exit stations, hospitals, shopping malls and other crowded places, as well as key areas such as villages and communities (communities) that adopt closed management measures, do not wear masks in accordance with regulations and do not listen to dissuasion, and refuse to implement epidemic prevention and control measures such as personnel registration, identity verification, body temperature detection, health code inspection, vehicle inspection, etc.
3. Personnel with yellow or red health codes who do not follow provisions for isolation for medical observation or home health testing; those who do not accept health monitoring and management in accordance with regulations after the end of centralized isolation; those who refuse to cooperate with the epidemiological investigation of the epidemic carried out by disease control and public security departments; and acts of not cooperating with disinfection work related to epidemic prevention and control.
4. Persons from high-risk areas of the epidemic or those with or suspected of having the new crown pneumonia epidemic refuse to accept quarantine, isolation or treatment; those who have close contact with patients with the new crown pneumonia epidemic and refuse to accept medical observation; those who know that they have been infected or may be infected with the new coronavirus, deliberately enter public places or conceal contact with others; and people included in the scope of nucleic acid testing do not participate in the unified organization of nucleic acid testing.
5. Fabricating false information related to the COVID-19 epidemic, or knowingly disseminating false information knowingly, thereby seriously disrupting social order; The act of defrauding public and private property under the guise of developing, producing or selling supplies for the prevention and control of the new crown pneumonia epidemic under the pretext of developing, producing or selling supplies for the prevention and control of the new crown pneumonia epidemic.
6. Violations of the state's regulations on market operation and price management during the prevention and control of the new crown pneumonia epidemic, hoarding, inflating prices, making huge profits, seriously disrupting market order, illegally obtaining a relatively large amount or having other serious circumstances.
7. Theft, fraud, robbery, robbery, destruction, encroachment, or misappropriation of relief materials related to epidemic prevention and control; forcibly taking or deliberately destroying or occupying the property of medical and health institutions; producing and selling medical devices and medical hygiene materials that do not meet the standards for the prevention and treatment of the new crown pneumonia epidemic; and producing and selling counterfeit and shoddy prevention and control protective products and materials.
8. Illegally practicing medicine without obtaining a physician's practice qualification, causing serious circumstances such as misdiagnosis and treatment of infected patients, pathogen carriers, or suspected patients, or causing cross-infection; acts of forging, altering, or buying and selling nucleic acid test certificates and other supporting documents, or buying, selling, or using forged or altered nucleic acid test certificates and other supporting documents.
IX. Setting up counseling classes and chess and card rooms in family residences, holding various kinds of theatrical performances, exhibitions, temple fairs, galas and other gathering activities in violation of epidemic prevention and control regulations, and conducting weddings and funerals in violation of epidemic prevention and control regulations, causing the spread of the new crown epidemic.
10. Acts that disrupt the order of epidemic prevention and control work or disrupt the normal order of government organs, enterprises, public institutions, and public places, such as colluding, instigating, or organizing illegal petitions, gathering to cause trouble, attacking government organs or government disease control departments, epidemic prevention departments, and robbing epidemic prevention materials.
11. Intentionally injuring or employing other methods to openly insult, intimidate, or slander medical personnel; conduct that causes disturbances in medical and health institutions, illegally parks corpses, or privately sets up spiritual halls, causing disorder and affecting the normal progress of epidemic prevention and control work.
12. In the work of preventing and controlling the new crown pneumonia epidemic, public servants with responsibilities such as organizing, coordinating, directing, investigating, controlling, treating, transmitting information, transportation, and material support are allowed to allow violations and violations of the epidemic to flow freely, or to ventilate information, protect and shield epidemic-related lawbreakers and criminals, act as backstage and "protective umbrellas".
13. Under the guise of epidemic prevention and control, carry out fraud, extortion, or impersonate state organ staff, medical rescue personnel, and other acts of false identity deception.
14. Organizing and participating in mass gambling activities, illegal sand mining, indiscriminate construction, occupation of roads, and other such conduct.
15. Illegally hunting or killing rare or endangered wild animals under key national protection; illegally acquiring, transporting, or selling all kinds of wild animals and their products; and selling cold-chain food without the testing permission of market supervision departments.
16. Other illegal and criminal acts that hinder the prevention and control of the epidemic. For those who commit relevant violations and crimes during the epidemic prevention and control period, the public security organs shall impose public security administrative penalties in accordance with the law, and the judicial organs shall make discretionary measures as aggravating circumstances when pursuing criminal responsibility, and vigorously punish and deter illegal crimes, maintain the authority of the law, maintain social order, and safeguard the safety and health of the people's lives and property.
