The full text of the circular is as follows:
Liu Wenjie, male, a native of Jianfeng Village, Hujiaying, Nanzheng District, born in February 1998, ID number: 61232119980224 ****, the young man participated in the pre-service training organized by the military service organs before enlistment through online enlistment, physical examination and political assessment, and signed the "Commitment to Serve in The Military According to Law". In September 2020, he was approved by the Recruitment Office to enlist in the military department of the Xinjiang Production and Construction Corps. After his enlistment, he developed the idea of leaving the army, repeatedly expressed that he could not adapt to the collective life of the army, and used a variety of means to refuse military service. The cadres and backbone cadres of the new training camp of the troops have repeatedly done their ideological work, patiently persuaded and counseled, and repeatedly explained to them the laws and regulations on military service refusal and the corresponding punishments, trying to change their erroneous understanding, but Liu Wenjie still clearly expressed his resolute attitude of not wanting to continue military service and expressed his willingness to bear all the consequences. After study by the party committee of the unit where he belonged, it was decided to remove Liu Wenjie from his list.
In order to further solemnize discipline in conscription work, in accordance with the "Military Service Law," the "Regulations on Conscription Work," the "Interim Measures for Resolving the Problem of Conscription of New Recruits Who Resist Military Service," and the "Memorandum of Cooperation on Implementing Joint Disciplinary Action against Untrustworthy Entities in the Field of Performing Military Service Obligations throughout the Province," liu Wenjie, after studying and deciding, will be dealt with sternly with Liu Wenjie, who refuses to perform military service and seriously disrupts the order of military service work.
1. Civil servants (including staff managed with reference to the Civil Servants Law) and public institution staff shall not be employed.
2. In the "service column" of the individual household registration, the permanent words "objector to military service" shall be included in the database of persons who are legally prohibited from leaving the country, and they shall not leave the country (border) for two years.
3. Suspend his or her qualifications for college degree or above within two years, and must not handle the formalities for Liu Wenjie's enrollment and promotion (resumption).
4. Cancel the preferential treatment for its conscripts, and impose a fine of 72,000 yuan according to 2 times the 2020 conscript preferential payment (36,000 yuan per year) in Nanzheng District, which will be implemented by the Hujiaying Town Government, and the fine will be handed over to the district finance (executed within 3 months).
5. It is not permitted to participate in the selection of labor models, moral models, models of the times, May Day Labor Medals, May Fourth Youth Awards, outstanding Party members and league members, etc., and those who have already received honors shall be revoked.
Within two years, they shall not enjoy the policies or subsidies used by the government to support economic and social development, serve specific normal goals or work tasks, have special purposes, and social security funds, and cancel the policy preferences already enjoyed.
VII. Restrictions are to be made in accordance with laws and regulations in the qualification certification work of lawyers, teachers, doctors, certified public accountants, tax accountants, certification practitioners, financial practitioners, journalists, tour guides, and so forth.
VIII. Include information on administrative punishments of untrustworthy entities in the national financial credit information basic database, and financial institutions are to use records of untrustworthiness as an important reference basis when handling personal credit, financing, credit cards, and other such financial services, and strictly examine and approve them.
9. Acts of refusal to perform military service and the results of punishment shall be regarded as negative examples of violations of the Military Service Law and shall be announced to the public in the district news media.
For the act of "objecting to military service", the Military Service Law of the People's Republic of China has detailed penalties.
Article 66 provides:
Citizens who have the obligation to perform military service shall be ordered by the people's government at the county level to make corrections within a time limit if they have any of the following acts; if they do not make changes within the time limit, the people's government at the county level shall force them to perform their military service obligations and may impose a fine:
(1) Refusing or evading military service registration or physical examination;
(2) Where conscripted citizens refuse or evade recruitment;
(3) Reservists refusing or evading participation in military training, performing military service, or conscription.
Those who have committed the acts mentioned in the second paragraph of the preceding paragraph and refuse to make corrections must not be hired as civil servants or staff members managed with reference to the Civil Servants Law, and must not go abroad (abroad) or further education within two years.
If a national defense student violates the provisions of the training agreement and fails to perform the corresponding obligations, he shall bear the liability for breach of contract in accordance with law, and according to the circumstances, the school shall handle the withdrawal from school, etc.; if he refuses to serve active duty after graduation, he shall bear the liability for breach of contract in accordance with law and shall be handled in accordance with the provisions of the second paragraph of this article.
Whoever commits acts mentioned in the second, third or third paragraphs of the first paragraph of this Article in time of war constitutes a crime, shall be investigated for criminal responsibility in accordance with law.
Article 67 provides:
Where a serviceman on active duty refuses to perform his duties or flees the army for the purpose of evading military service, he shall be given sanctions in accordance with the provisions of the Central Military Commission;
Servicemen in active service who have been expelled from the military, expelled from the military, or pursued for criminal responsibility in accordance with law for the acts mentioned in the preceding paragraph must not be hired as civil servants or staff members managed with reference to the Civil Servants Law, and must not leave the country (abroad) or study for two years.
Where it is clearly known that they are servicemen who have fled the army, the people's government at the county level shall order corrections and impose a fine;
