On October 25, the Daowai District Court publicly pronounced judgments on the criminal case of intellectual property infringement by 12 defendants, including Meng X and Yang X, and sentenced Meng X and 12 other defendants to fixed-term imprisonment ranging from two years and six months to five years, and fines ranging from 30,000 yuan to 1.05 million yuan for the crimes of counterfeiting registered trademarks, selling goods with counterfeit registered trademarks, illegally manufacturing and selling illegally manufactured registered trademark logos.
The unique trademarks registered by a meat processing factory in Harbin and the red sausage trademarks acquired by a limited liability company in Harbin are well-known trademarks in Harbin, and the meat processed products produced by the two enterprises are well-known inside and outside the province.
In April 2018, defendant Meng, while in partnership with Zhang (handled in a separate case) to operate Harbin Changsheng Food Co., Ltd., entrusted defendant Zhang and three others to print trademark logos, plastic packaging bags and packaging boxes bearing the red sausages produced by the above two enterprises. The two defendants, together with defendants Yang X, Meng Xiao X, and defendant Si X, sold the red sausages produced by their company to Dong X, Ma X, and Liu X, together with the illegally manufactured outer packaging bags and boxes bearing the trademark logos of the red sausages produced by the above two enterprises. After Dong, Ma and Liu purchased red sausages in Meng, they sold them nationwide through Taobao in the name of food produced by the above two enterprises.
As of the time of the case, Meng and the other defendants sold food and packaging bags counterfeiting the registered trademark of a meat product processing factory in Harbin City totaling 1,495,260.92 yuan, and sold food and packaging bags counterfeiting the trademark of a Certain Harbin Limited Liability Company for a total of 569808 yuan.
According to reports, the Daowai District Court conscientiously implemented the property rights protection system for private enterprises, gave full play to the role of intellectual property rights in criminal adjudication, severely cracked down on crimes of infringement of intellectual property rights, protected the property rights of private enterprises from infringement in accordance with the law, effectively safeguarded the reputation of well-known enterprises and well-known commodities in our city, and focused on optimizing innovation to create a business environment based on the rule of law. Up to now, a total of 9 cases of intellectual property infringement crimes have been concluded, 28 defendants have been sentenced, fines of more than 7.97 million yuan, and recovery of illegal gains of more than 3.12 million yuan.
