Miao Miao is worried that the cost of plastic surgery cannot be borne by herself, but the company promises: "If there is economic difficulty, it is not a problem, the company can assist in handling loans, and will also vigorously support Miao Miao, and after becoming the anchor, the company will repay the principal of this micro-plastic surgery in installments." Miao Miao thought about it for a few days and decided to "sign a contract" with the company.
The agreement loan is a mystery
The contracts signed by Miao Miao and the company are two in total. The first is an "Artist Cooperation Agreement", which stipulates that Miao Miao provides performing arts activities through original singing works or cover works; the cooperation period between the two parties is two years, and it is necessary to effectively broadcast live for more than 10 hours per day, the number of live broadcast days per month is not less than 26 days, and the salary includes basic salary and gift commissions; the company is also responsible for the promotion and marketing of Miao Miao after the performance.
Then there was an "Artist Support Agreement", which stipulated that the company would assist Miao Miao in the "Immediate Loan" company to borrow 45,000 yuan, and after the "Liren Loan" company borrowed 65,000 yuan, and Miao Miao officially became the anchor, the company would help her repay the beauty loan costs in installments.
A few days later, the company sent Li to accompany Miao Miao to two hospitals for cosmetic surgery, under the guidance of Li, Miao Miao first paid 50,000 yuan to the first beauty salon account and underwent surgery, and then paid 60,000 yuan to the second beauty hospital account through pos machine swipe card (this actual account is the personal bank account of Jiang Mou, an investor of the live broadcast company involved in the lawsuit), and the operation content was double eyelid cutting, liposuction and hyaluronic acid surgery. After the operation, Miao Miao went home to recuperate and actively prepared for the anchor work.
Beauty traps are exposed
Miao Miao, who was ready to start a serious live broadcast after the plastic surgery, found that things were getting more and more wrong, and problems in the live broadcast were frequent, but the company rarely managed the affairs of the live broadcast business. Miao Miao signed the contract to handle the loan for only one month, and the anchor work related to the agreement could not continue.
After that, Miao Miao learned that the actual cost of cosmetic surgery was actually only 50,000 yuan, and the difference of 60,000 yuan was taken away by the company. Miao Miao realized that she had been deceived, so she sued the Shanghai Jinshan District People's Court, demanding that the company return the excess 60,000 yuan received.
After trial, the Jinshan court held that the company involved in the lawsuit had improperly occupied the 60,000 yuan loan obtained by Miao Miao from other platforms, and the money had not been returned so far, resulting in Miao Miao suffering losses, and finally ordered the company involved in the lawsuit to return the 60,000 yuan improperly collected and pay interest during the period of capital occupation.
Judge reminds
In this case, Miao Miao was "tempted" by the recruitment information to sign a live broadcast agreement, and was recommended by the company to the loan company to handle the loan, and then guided to the designated beauty hospital for surgery, and finally fell into the "beauty trap" step by step, not only failed to realize the dream of the anchor, but also saddled with a high loan, which can be described as "a bamboo basket to hit the water".
Here, the judge reminded everyone that everyone has the right to pursue beauty, but at the same time, it is more necessary to cultivate a pair of eyes, enhance legal awareness, choose formal channels and platforms when seeking jobs and loans, and carefully check relevant qualifications, so as not to let the desire to "want beauty" become a "fatal" trap.
