Zheng Qingjun, a liquor distributor in Shandong Province, who has been reporting continuously since March 26, 2021, was imprisoned for four years in 1999, and has made significant progress in his acquittal after 21 years of continuous appeals.

At the beginning of this year, after Zheng Qingjun's proposal to the Liaocheng Intermediate People's Court for state compensation was rejected, on July 23, the Liaocheng Intermediate People's Court retried and compensated him for personal freedom of 646,000 yuan and mental losses of 226,000 yuan, a total of 872,000 yuan. At the same time, the court eliminated the impact, restored its reputation, and apologized within the scope of the infringement' influence.

After 21 years of appeal, Zheng Qingjun received a decision on state compensation

Zheng Qingjun is a native of Dong'a County, Shandong Province, born in 1965. According to his introduction, before he was imprisoned from 1997 to 1999, he served as the general agent of liquor in Dong'a County, with an annual operating turnover of more than 30 million. In 1999, when he went to the hotel to reconcile with the Shandong Jingyanggang Supply and Marketing Company, he was directly taken away by the Yanggu County Public Security Bureau and taken into criminal detention.

Zheng Qingjun said that from 1997 to 1999, he successively returned more than 11 million yuan to the Shandong Jingyanggang Supply and Marketing Company, but finally the other party reported that he had defrauded 990,000 yuan.

On March 19, 1999, Zheng Qingjun was criminally detained by the Yanggu County Public Security Bureau in Shandong Province on suspicion of misappropriation, and was released on December 16, 2003. After being arrested and imprisoned, Zheng Qingjun continued to appeal. It was not until December 2020 that the Yanggu County People's Court in Shandong Province acquitted him after 21 years of appeal.

During the investigation by the Huashang Daily reporter, it was found that as early as 2003, the Shandong Provincial High People's Court issued a retrial opinion on the case, finding that the case was an economic dispute and could not be handled as a crime.

However, the Yanggu County People's Court in Shandong Province still insisted that Zheng Qingjun was guilty, only to change his sentence from 15 years to 3 years and 6 months, and by the time the verdict came down, Zheng Qingjun had already been detained for 4 years and 9 months.

At the beginning of 2021, Zheng Qingjun filed a state compensation claim with the Liaocheng Intermediate People's Court, which refused to file the case because it did not comply with the relevant regulations.

On July 26, 2021, after receiving the Liaocheng Intermediate People's Court's "State Compensation Decision", 56-year-old Zheng Qingjun was not at all happy, and he said in an interview with a reporter from Huashang Daily that the next step would be to appeal to the Shandong Provincial High People's Court.

Zheng Qingjun said that although the Liaocheng Intermediate People's Court compensated him 646,000 yuan in compensation for personal freedom and 226,000 yuan (a total of 872,000 yuan) in the State Compensation Decision, and apologized, there is still a big gap between it and the desired result.

The case was proved innocent after 21 years, and the court has apologized and compensated, what else does zheng Qingjun ask for? On July 26, a reporter from Huashang Daily conducted an exclusive interview with Zheng Qingjun.

China Business Daily: When did you get the "State Compensation Decision Letter" from the Liaocheng Intermediate People's Court?

Zheng Qingjun: It was given in the past two days, and the time shown in the State Compensation Decision is July 23.

Huashang Bao: What do you want to say about the Liaocheng Intermediate People's Court's "State Compensation Decision"?

Zheng Qingjun: It is very regrettable that the relevant responsible persons have not been dealt with. In addition, the Liaocheng Intermediate People's Court's judgments at several key points are also problematic.

For example, in response to my case, on February 12, 2003, the Shandong Provincial Higher People's Court issued a "Opinion on the Retrial of Zheng Qingjun's Contract Fraud Case" to the Liaocheng Intermediate People's Court, which clearly determined that the case was an economic dispute and could not be handled as a crime, but the Liaocheng Intermediate People's Court did not change my acquittal. After 21 years of appealing, the Yanggu County People's Court in Shandong Province acquitted me.

Second, at the beginning of this year, I submitted a state compensation request to the Liaocheng Intermediate People's Court, but the court did not file a case because it did not comply with the relevant regulations. After the appeal, the Shandong Provincial Higher People's Court ruled that it should be the organ obligated to compensate, and the Liaocheng Intermediate People's Court only accepted the case.

China Business Daily: What is your state compensation claim this time?

Zheng Qingjun: My request is: compensation for the loss of physical liberty of forcible detention caused by the wrongful judgment is 373.1 * 1733 days = 646,000 yuan; compensation for mental damage is 4 million yuan; the impact is eliminated, the reputation is restored, and the apology is compensated; and the economic loss caused by compensation is 20 million yuan.

China Business Daily: How is the economic loss of 20 million yuan calculated?

Zheng Qingjun: Before I was imprisoned from 1997 to 1999, as the general agent of liquor in Dong'a County, I had an annual operating turnover of more than 30 million. The Shandong Jingyanggang supply and marketing company "Jingyanggang", which represented it, also gave the company more than 11 million yuan in return, but the company reported the case for 1733 days of detention, sentence and imprisonment for 1733 days on the grounds of embezzling 990,000 yuan of liquor, and continued to fight a lawsuit for 21 years in order to prove his innocence.

At that time, when I was sent to the detention center, both children were not yet 10 years old, my family borrowed money to fight lawsuits to seek justice for me, life was a mess, the children dropped out of school at a very young age, and did not receive a better and higher education. After I was released at the end of 2003, I was dumbfounded, laughing at the sight of people, and not even saying a few words in its entirety.

China Business Daily: How do you evaluate this "State Compensation Decision"?

Zheng Qingjun: First of all, this "State Compensation Decision Letter" is an account of my 21-year continuous appeal, and it is also a proof of my innocence after the Yanggu County People's Court in Shandong Province pronounced my innocence in December 2020; secondly, the Liaocheng Intermediate People's Court partially accepted my application, such as compensation for the loss of deprivation of personal liberty in compulsory detention caused by the wrongful judgment caused by 373.1 * 1733 days = 646,000 yuan, eliminating the impact, restoring reputation, and apologizing. Although the court only compensated 220,000 yuan for moral damage, it at least recognized this claim.

China Business Daily: Apart from this "State Compensation Decision", what other demands do you have?

Zheng Qingjun: The State Compensation Decision of the Liaocheng Intermediate People's Court did not support my claim for compensation of 20 million yuan for economic losses, and at the same time did not pursue responsibility for the relevant responsible persons.

The Liaocheng Intermediate People's Court believes that state compensation should strictly follow the statutory principles, and the 20 million yuan of economic losses I request for compensation do not fall within the scope of statutory compensation for state compensation and have no legal basis. At the same time, during the trial, I also requested that the court organize its reconciliation with the Shandong Jingyanggang Supply and Marketing Company, and the court also held that the compensation scope that did not belong to the statutory state compensation was not supported.

But for me, when the Shandong Jingyanggang Supply and Marketing Company reported me to prison for suspected fraud, I now hope to be able to cover up the dispute with the Shandong Jingyanggang Supply and Marketing Company in front of the judge, but unfortunately, the court did not support this request.

China Business Daily: What are your plans for the next step?

Zheng Qingjun: I will appeal to the Shandong Provincial High People's Court to pursue the legal responsibility of the relevant responsible personnel. For 21 years, these 1,733 days of detention have been a nightmare of my life, and someone should be responsible for the case of that year.
