However, the European Southern Observatory (ESO) responded exclusively to each case that Visual China's copyright claim was illegal, that ESO had never and could not transfer the copyright to their images to any other individual or organization, and that Visual China had never contacted ESO about the black hole images.

Visual China even claims to have copyright to the black hole image. In other words, if Visual China takes the copyright of the image, the media or individuals who do not use the image in China through Visual China channels may be regarded as infringing acts by Visual China, and may even be held responsible for commercial use.

Although Visual China subsequently changed the caption to "This image is an editorial image and may not be used for commercial purposes" and marked the source as The European Southern Observatory (hereinafter referred to as ESO), the matter quickly triggered a fierce public opinion discussion, and many people questioned whether Visual China listed a publicly released photo as its own copyright, and if it was to use it, it would need to pay Visual China a fee.

So, is visual China legal to regard ESO's "authorization" as its copyright to sell this image in China? Has Visual China contacted ESO for copyright transfer? Is ESO aware of this?

In response to the Daily Economic News interview request, ESO made it clear that visual China's copyright claim is illegal, that ESO has never and cannot transfer the copyright to their images to any other individual or organization, and that Visual China has never contacted ESO about the black hole image, at least so far no one claiming to be a representative of Visual China has contacted ESO.

The following is the full text of ESO's reply to the "Daily Economic News" reporter:

Our Copyright Regulations clearly state:

"Unless otherwise noted, images, videos and music posted on ESO's website, as well as the text of press releases, announcements, blog posts and headlines, are licensed under the Creative Commons Attribution 4.0 International License and may be reproduced free of charge on a non-exclusive basis, provided that the source of the content is clearly identified and visible to users."

However, if any organization or individual wants to use our materials without paying, the complete image and source must be made available to all users in a clear and easy-to-read manner, and the wording of the source cannot be changed, for example: "ESO/José Francisco (josefrancisco.org). Sources should not be hidden or unassociated from images, and content must be accessible if accompanied by a link.

Except for media use, press releases, announcements, featured images of the week, and illustrations should be attributed to ESO; ESO's materials, images, and videos must not be used to declare and imply endorsement of the product or service by ESO or any ESO employee; and if the image contains identifiable persons, the image will not be permitted for commercial use. ”

The same applies to our recent release of the first photograph of a black hole in human history, which is copyrighted by the Event Horizon Telescope Collaboration (EHT), which we at ESO are affiliated with. Therefore, these images are free to use and can also be used for commercial purposes as long as the source of the images is correctly stated.

ESO has never, and cannot, transfer the copyright to our images to any other person or organization. If Visual China claims that they own the copyright to this black hole image and profit by selling that copyright, this statement is incorrect.

To date, ESO has not received any requests from companies to transfer copyrights. But we did receive questions from companies and individuals about possible restrictions on the use of the black hole image that companies and individuals intend to use for a variety of purposes, ranging from the production of artwork that student projects are in place to make profitable.

Visual China has never contacted us about black hole images, at least so far no one claiming to be a representative of Visual China has contacted us. But yesterday we did receive a question about the use of visual Chinese pictures. But Visual China's copyright claim, we still heard about it for the first time.

Visual China has not asked us for permission to picture the black hole. However, considering the copyright conditions of ESO images, Visual China can use these images without authorization as long as the source is stated. In other words, Visual China does not need to make a claim for authorization at all.

Visual China views the so-called "authorization" as a copyright that it can sell this image within China and profit from, which is illegal. Visual China used this black hole image without informing us in advance, but this does not mean the transfer of copyright. Visual China, or any other company, can use the photo, and they can even use it for commercial purposes as long as the source of the picture is clearly stated.

However, because the copyright of this picture does not belong to them, they cannot sell the copyright of this picture.
