On September 5, the Hanyang court held a public hearing through remote video hearings on two criminal incidental civil public interest litigation cases, namely, wang moujun and wang mouli illegal mining and Liu and Zhang illegally occupying agricultural land.

At 9:00 a.m., a crisp gavel sounded in Court No. 1, and Pan Tao, president of the Criminal Trial Division, Deng Wei, vice president of the Criminal Trial Division, Liu Xianbing, and four people's assessors formed a seven-member collegial panel to hear two criminal incidental civil public interest litigation cases.

The public prosecution alleged that from 2015 to 2017, defendants Wang Moujun, Wang Mouli and others violated the provisions of the Mineral Resources Law by illegally mining stone in a village and a mountain in Jiangxia District, Wuhan City, without obtaining a mining license, causing the destruction of mineral resources. The two made a profit of more than 1 million yuan by selling illegally mined ore, constituting the crime of illegal mining.

In 2011, defendant Zhang contracted part of the land from a village in Jiangxia District, Wuhan City, for stone business activities until February 2016. In May 2015, defendant Liu, after obtaining the consent of defendant Zhang, violated land laws and regulations by leveling and hardening part of the land in the plot contracted by Zhang and renting it out as a freight yard or a construction activity board house for profit, causing serious damage to land resources. The public prosecution charged the two with illegal occupation of agricultural land.

At the same time, the public prosecution filed an attached civil public interest lawsuit against the four defendants in both cases, requesting that the defendant be ordered to reclaim the land damaged by their illegal mining and illegal occupation of agricultural land, and if they could not reclaim it themselves, they would jointly bear the reclamation costs, and at the same time order the defendants to jointly bear the reclamation assessment costs. Among them, the families of the two defendants in the case of illegal mining by Wang Moujun and Wang Mouli have completed the reclamation of all the damaged land and have passed the experience before trial; the families of the two defendants in the case of Illegal Occupation of Agricultural Land by Liu and Zhang have also completed the reclamation of the part of illegally occupied agricultural land before trial.

Presiding Judge Pan Tao presided over the court investigation, evidence presentation, court debate and other litigation links, the trial first on the criminal part, and then the trial of the attached civil public interest litigation part, the four defendants all pleaded guilty in court, the entire trial process is standardized and smooth, and the two cases will be announced at a later date.
