There is an obvious feature of the case composition of the first branch court, that is, there are many major, difficult and complex cases. In recent years, Zhu Feng has successively participated in or hosted a number of influential major and important cases, such as the bribery case of Dai X of "one family, two systems", the bribery case of Chen X, vice president of an aviation group who is "addicted to gambling like life", vividly interpreting the case of Liu X's trafficking and transportation of drugs that "the legal net is restored and neglected without omission", the case of embezzlement, embezzlement of public funds, and illegal operation of similar businesses by Chang X, general manager of a certain financial company who secretly used the "trust plus fund" model, and huang X and Wen X, who are known as "the most cattle retail investors", who manipulated the securities market.
● Dai's bribery case is the first bribery crime carried out by a listed company's equity acquisition and restricted stock incentive plan, and the modus operandi is new and the application of the law is difficult. Because Dai has been in charge of economic work for a long time and is very familiar with company acquisitions and equity replacement, his wife has been engaged in business and run a business for a long time, and was later acquired by a listed company. The family structure of "integrating government and business" and unconventional modus operandi once caused great difficulties in characterizing cases. With the support of the leaders of the court, Zhu Feng formed a complete chain of evidence and conviction logic by guiding supplementary investigation and rigorous and meticulous legal arguments in a targeted manner, and Dai confessed guilt and obeyed the law in front of the evidence and facts, and finally achieved good trial results and social effects.
● Liu's case of trafficking and transporting drugs vividly explains that "the legal net is restored, and there is no leakage". The investigative authorities originally only accused Liu of transporting more than 1,000 grams of drugs. In the process of review, Zhu Feng and his colleagues found that Liu Mou may be the "Ah Niu" behind the other two drug cases previously prosecuted by this court and handled by other investigation organs, so they asked the investigation organs to take supplementary investigation measures such as going to the relevant prison to retrieve the records of serving sentences, and confirmed that Liu was indeed "Ah Niu". But only this evidence is not enough, another co-defendant has the conditions to point out Liu, but because he heard rumors of Liu's murder and extinction, he was worried and wanted to stop talking, Zhu Feng through the prison supervisor police to educate the co-defendants, encouraged him to lay down his baggage, in a way that does not disclose his true identity, identify and testify against Liu, and finally completed the evidence chain, successfully prosecuted Liu's other two major criminal facts of trafficking and transporting drug methamphetamine up to 10 kilograms. The court fully adopted the accusations and sentenced Liu to death. After the case was concluded, Zhu Feng promptly formulated and issued procuratorial suggestions, suggesting that the above-mentioned competent police officers be commended, and that the co-defendants who accused Liu of committing crimes honor their policies and suggestions for identifying them as major meritorious deeds were all adopted, further demonstrating the fairness and justice of the law with the procuratorial responsibility of actively performing their duties.
Vigorously carry out procuratorial duties in aiding Tibet
When it comes to Tibet, Zhu Feng always has endless words. "Half a year's life of aiding Tibet has had a great impact on me, and this is a place where I have measured it with legal love, which of course cannot be separated from the care of the organization and the support of the family."
In the second half of 2018, Zhu Feng was selected to participate in the "Double Hundred Plan" of the Supreme People's Procuratorate and went to the People's Procuratorate of Shigatse City in the Tibet Autonomous Region to engage in Tibet aid work. With an average altitude of more than 4,000 meters above sea level, and the urban area is also at 3,850 meters above sea level, it is the closest place to the sky. Due to the thin air, the oxygen content of the air in Xigaze is only about half that of Shanghai, and the hot water is only 87 degrees, and people are breathless with a little effort. Because of the lack of oxygen, his heart beats faster, it is difficult to fall asleep, a little drowsiness, breathing slowing down is immediately awakened, fall asleep for a while, soon will be woken up again, after getting up is even more swollen head, nasal bleeding. Zhu Feng persevered with a strong will, gradually overcame altitude sickness, and actively participated in the handling of the case.
He participated in the handling of difficult and complicated cases such as Ou's embezzlement of public funds and Chen's and others' transportation of drugs. Among them, Ou Mou's embezzlement case is the highest social concern of the Xigaze Municipal Court in recent years, the amount of money involved is high, the factual evidence is complex, he assisted the director to adjust the accusation thinking and reformulate the trial plan according to the evidence of the case and the main points of the embezzlement case, and finally achieved a better appearance effect. He also went to Gamba County, 4,700 meters above sea level, to guide the handling of a rape case on a case-by-case basis, and clarified the direction of supplementary investigation.
During the period of aid to Tibet, Zhu Feng was also dispatched by the Tibet Autonomous Region People's Procuratorate to participate in the case quality assessment of Ali, Nagqu, Shannan, and Qamdo. In more than a month, he overcame altitude sickness, braved the dangers of mountains and high roads, traveled thousands of miles, and successfully completed the task of reading and evaluating the case file, and the political department of the autonomous regional procuratorate wrote a letter of praise.
In the training on public prosecution business of procuratorial organs at the city and county levels carried out by the Xigaze Municipal People's Court, he conscientiously prepared a course on "Judicial Practice of Job-related Crimes", introduced the key points of examination, difficulties in collecting evidence, and solutions encountered by the Shanghai First Branch in handling a series of job-related crime cases in recent years, which was well received by colleagues inside and outside the system.
Overcome difficulties in the epidemic and grow up
From June to September 2020, Zhu Feng was seconded to the Supreme People's Procuratorate to handle a special case. The case is major, difficult, and complex, and needs to be handled centrally at the case-handling point. During the case-handling period, the rebound of the epidemic coincided with the need to isolate the case-handling point in Beijing, his wife who worked in a prison in Shanghai also had to be closed for management, and his daughter was attending primary school in Shanghai, and the family of three faced the practical difficulties of separating two cities and three places. Because of the epidemic, the school changed to online teaching, and some materials need to be printed by parents themselves, while the elderly at home can only take care of the lives of their children, and they are powerless to operate network equipment and print materials. In the face of difficulties, like many ordinary people during the epidemic, they chose to give up their small homes for everyone and take the initiative to overcome difficulties. In order to minimize the impact on her daughter's studies, her wife rushed to teach her 10-year-old daughter to take classes online, download materials, load paper, print and change ink cartridges before the prison was closed. It is gratifying that the daughter did not pull down her homework during this period, but also changed her previous procrastination habits, learned to go to class by herself, print by herself, and manage herself, and her academic performance did not drop but rose. On the other hand, Zhu Feng, who had no worries about the future, together with the members of the special case team, successfully completed the project handling work after three months of reading the case file, visiting and investigating, and soliciting expert opinions, which was fully affirmed by the leaders of the department. "Through this stage, I suddenly have a new understanding of my child's education and growth - dare to let go, there will be surprises."
Continue to carry forward the spirit of the academy in the inheritance
The First Branch is an advanced collective full of talents, and Zhu Feng has been deeply fortunate to be able to work, study and grow here for fourteen years. When I first started working, I heard the old master of the Public Prosecution Department say that without the bottom of the three hundred cases, it is impossible to become a good prosecutor. Nowadays, Zhu Feng himself has become a teacher for new recruits, and while handling the cases at hand and coordinating the work within the group, he always squeezes out as much time as possible to help young comrades revise their reports, impart their experience in handling cases, help them grow up as soon as possible, carry the responsibility of the guide with the courage of a pathfinder, let the spirit of the academy's training continue to be inherited, do not forget the original intention, live up to Shaohua, and strive to create procuratorial achievements that can withstand the test of practice, the people, and history.
