Problems with mobility Legal aid to help

Recently, the Licang District Bureau of Justice received three thank-you pennants from Wang Jia's (pseudonym) family, thanking the District Legal Aid Center, the Notary Office and Lawyer Liu Yuebo of Xingtuo Law Firm, and thanking the help of the three parties for the successful resolution of Wang Jia's problem within three weeks.

On July 1, 2021, on the occasion of the centenary of the Communist Party of China, the Licang District Legal Aid Center received a call from Wang Jia, a recipient, for help. It is understood that Wang Jia has been disabled in both legs since childhood, has limited mobility, has been unmarried and childless, and has two younger brothers Wang Yi (pseudonym) and Wang Bing (pseudonym), Wang Jia relies on the care of his second brother Wang Yi's family, and his parents died in 2007 and 2020 respectively. After the death of his mother, according to the policy, the state issued funeral expenses, pensions and other payments to the family in three installments, and the three people reached an agreement on the division of the above-mentioned funds, and Wang Yi transferred his due share to Wang Jia, that is, Wang Jia received 2/3 of the total amount and Wang C 1/3. Wang Bing handles the formalities for receiving, and all the money is transferred to Wang Bing's account, and then Wang Bing distributes it according to the agreement. In the first payment, Wang Jia deserved 120,000 yuan, and Wang Bing had paid Wang Jia as agreed. The second payment has been paid in place, but Wang Jia has not received the due money, wang Jia and Wang Yi have repeatedly asked Wang Bing, but Wang Bing has refused. Wang Jia also had no other income and urgently needed to use the money to be admitted to the hospital for treatment, so he called the Licang District Legal Aid Center in the hope of getting legal aid. After understanding the situation, the person in charge of the center led lawyer Liu Yuebo of Shandong Xingtuo Law Firm, who has rich experience in handling cases, to Wang Jia's home to provide door-to-door service. On the one hand, it soothes and channels Wang Jia's anxiety, on the other hand, it uses easy-to-understand language to fully explain the law and reasoning of China's legal provisions on funeral expenses, pensions and inheritance in combination with the facts of the case, comprehensively analyzes the case for Wang Jia, and informs Wang Jia that he can get back his pension through litigation, but it may go through the first instance, second instance and enforcement, the process may be relatively long, and once the lawsuit is filed, the contradictions between the brothers will intensify and the feelings will be completely broken. It is recommended that it first solve the problem through mediation. After obtaining Wang Jia's consent, Director Niu handled the legal aid procedures for him and assigned lawyer Liu Yuebo to undertake it specifically.

The lawyer who undertook the case immediately contacted Wang Bing, and after in-depth understanding, he learned that the mother of the three people had made a will before her death. All the houses he had in his lifetime were designated to be inherited by Wang Bing. Wang Bing was worried that after giving the money to Wang Jia, his mother's will would not be fully executed. Subsequently, the lawyer in charge informed Wang Jia of Wang Bing's worries, and Wang Jia said that he did not want to compete for his mother's inheritance, he did not have the ability to live independently, and it was impossible to return to the old man's house to live. At present, I just want to get money for hospitalization as soon as possible. At this point, the lawyer understood the real thoughts of the two parties, and in essence, the differences between the two sides were not very big, but only in the mutual distrust of each other. The lawyer undertook the communication with Wang Jia and Wang Bing many times, analyzed the advantages and disadvantages, and finally reached an agreement between the two sides, the two sides deposited the money through the notary office, the notary office issued a notarial certificate of Wang Jia's statement of abandonment of inheritance, and then the notary office paid the second payment to Wang Jia. After the main opinions were agreed, there was a dispute between the two parties to the specific terms of the agreement, and the lawyer coordinated and communicated with the two sides many times, revised the agreement many times, and finally the two sides reached an agreement and signed the agreement. The person in charge of the center informed the Licang Notary Office of the situation and hoped to handle it as soon as possible. Director Zhang, the person in charge of the notary office, considered the actual situation of Wang Jia, and the special affairs office carried office equipment to provide services for Wang Jia to provide door-to-door services, and carried out on-site notarization on deposits and declarations. On July 22, 2021, Wang Jia received the second due amount, and Wang Bing also promised to pay Wang Jia's share to Wang Jia within three days after receiving the third payment. At this point, the case has been satisfactorily resolved.
