Han man stabbed people to death more than 80 times with a murder weapon and was sentenced to 30 years in prison

According to South Korean media reports on November 27, Kim Sung-so was charged with murder with a murder weapon in an Internet café in Seoul, South Korea, and was sentenced to 30 years in prison in the second trial, the same as the first-instance judgment.

On the morning of October 14, 2018, local time, Kim Sung-so had a verbal altercation with migrant worker A at an Internet café in Seoul's Gangseo District, and stabbed A more than 80 times with a murder weapon. After being taken to the hospital, A died of excessive bleeding 3 hours after the incident.

In the first-instance judgment, the court sentenced Kim Sung-so to 30 years in prison. At that time, the court explained that although the Magistrate's Office was very distressed about the issue of fixed-term imprisonment, considering the balance with other similar events, 30 years in prison was the maximum sentence for fixed-term imprisonment.

Subsequently, Kim Sung-so filed an appeal on the grounds that the sentence was too heavy, and the prosecution appealed on the grounds that the sentence was too light and conducted a second-instance trial. Prosecutors have also been demanding the death penalty in the second instance.

On the 27th, the Criminal Department 1 of the Seoul High Court upheld the first-instance judgment in the second instance of Kim Sung-so's case and sentenced him to 30 years in prison.

The second-instance adjudication department held that the sentencing conditions had not changed compared with the first-instance trial, and the first-instance sentencing did not exceed the reasonable discretionary range. The parties' appeals were dismissed. At the same time, the court said that although Kim Sung-so admitted to the crime and expressed regret and atonement, considering the motive, means, results, and pain of the survivors of the crime, it is necessary to isolate him in society for a long time to ensure the safety of ordinary people.

In addition, the court acquitted Kim Sung-so's younger brother in both trials. The Referees' Department believes that the younger brother's actions such as crouching behind the victim and pulling his waist should be seen as an attempt to prevent physical conflict rather than a joint atrocity.
