The court ruled in the first instance that Jiang was sentenced to 1 year and 10 months in prison for the crime of accepting bribes from non-state workers and committing the crime of embezzlement of office.
According to the judgment of the case, defendant Jiang Joined Three Squirrels Co., Ltd. (hereinafter referred to as "Three Squirrels") as a logistics warehouse manager in July 2013, and the internal flower name was "Rat Ah Fei", which was changed to "Rat Weiqing" in August 2019. In July 2016, he was appointed as the senior manager of North China DC and the manager of Tianjin distribution warehouse, on September 12, 2019, he was appointed as the director of North China Region and the operation manager of Tianjin 2C delivery warehouse, and from 2020 to the former general staff of the logistics staff department.
Between October 2018 and April 2020, Jiang took advantage of his position to collude with defendant Tong Moulin to take possession of the waste cartons (worth RMB684,000) sold by three squirrels by means of not recording sales or adjusting the weighing table. Among them, Jiang Mou received 344,000 yuan and Tong Moulin received 340,000 yuan.
In addition, the judgment also disclosed the specific circumstances of Jiang's bribery. From July 2016 to March 2020, Jiang took advantage of his position to accept cash 279042 yuan from Wang Mou, the legal representative of a Beijing labor service company. In September 2020, Jiang was afraid of being investigated and punished, and returned the transfer of 69,042 yuan to Wang.
In January 2020, Jiang asked Wang for a BMW car, and Wang paid 429,000 yuan for the purchase of the car. In September of the same year, Jiang Mou was afraid of being investigated and punished, and transferred the car to Wang's wife.
After the incident, Jiang truthfully confessed the facts of the crime of accepting bribes and voluntarily confessed the facts of the occupation of his position that the public security organs had not yet grasped; Tong Moulin voluntarily surrendered and truthfully confessed his criminal facts. Both defendants withdrew all illegal gains. All the money embezzled by the victim unit has been returned.
The court held that Jiang, as a staff member of the company, took advantage of his position to illegally accept and demand property from others worth 708042 yuan in order to seek benefits for others, and the amount was relatively large, constituting the crime of accepting bribes from non-state employees. Taking advantage of his position, Jiang X, together with defendant Tong Moulin, illegally appropriated the company's property for himself, and the amount was relatively large, constituting the crime of occupation of office and a joint crime.
Combined with the circumstances of the two men's confession, voluntary surrender, and withdrawal of all illegal gains, the court ruled in the first instance that Jiang Mou committed the crime of accepting bribes from non-state functionaries and committing the crime of usurpation of office, and decided to carry out a fixed-term imprisonment of 1 year and 10 months and a fine of 100,000 yuan; Tong Moulin committed the crime of usurpation of office, sentenced him to 1 year imprisonment, announced a suspended sentence for 2 years, and fined 50,000 yuan.
