The reporter learned from the Shanxi Provincial High People's Court on the 4th that the Datong City Intermediate People's Court recently publicly pronounced a verdict in the first-instance trial of the criminal case involving 26 people, including defendant Chai Zengming.
The Datong City Intermediate People's Court found that since 2004, defendant Chai Zengming, while working in the City Appearance Squadron of the Datong City Station Front Order Management Office, recruited temporary workers by means of units and other means, and recruited defendants Xu Lihong, Ma Qiyun, Yang Haifeng, Zhang Qiang, and Nie Wei to work for them personally, and gradually gained "prestige" near the Datong City Railway Station by increasing the intensity of fines.
In February 2007, defendant Chai Zengming arranged for defendant Nie Weiping to lead people to seize the "black taxi" and beat yin Shaohua to death. The incident received widespread attention from many media and had a bad impact within the scope of Datong City.
Thereafter, defendant Chai Zengming was the organization and leader, defendants Chai Jijin, Xu Lihong, Ma Qiyun, and 9 others were backbone members, defendants Zhou Lifang, Kong Qingwu, Yang Wenke, and 12 others were active participants, and defendants Wu Yabing, Yang Zhifei, Wang Yao, Li Yingxiang, and others were general participants in a mafia-type organization that gradually took shape.
Through carrying out a large number of illegal and criminal activities in Pingcheng District, Yungang District, Yingxian County, and other places in Datong City, the organization has committed wrongdoing, bullied and maimed the masses, and interfered with and destroyed the normal life, production, and business activities of others. At the same time, it also uses prestige and influence to obtain political status for the members of the organization and serve the organization, resulting in great damage to the legitimate interests of many people and production operators, causing extremely bad influences in relevant regions and industries. The organization has formed illegal control in the fields of construction engineering and transportation, which has seriously undermined the normal social, economic and living order of the local area. Through a series of illegal and criminal activities such as intentional injury, fraud, forced trading, picking quarrels and provoking trouble, collusion in bidding, extortion, etc., the organization forcibly takes over projects, monopolizes operations, obtains high profits, accumulates huge wealth, and uses part of its economic benefits to issue bonuses and benefits to members of the organization, provide vehicles and real estate, settle the incident, deal with the "aftermath", etc., in order to maintain the survival and development of the organization.
The Datong City Intermediate People's Court ruled that defendant Chai Zengming was guilty of organizing and leading a mafia-type organization, intentional injury, fraud, forced trading, picking quarrels and provoking trouble, extortion, collusion in bidding, concealment of accounting vouchers, accounting books, embezzlement, bribery, bribery, abuse of power, and several crimes, and decided to carry out life imprisonment, deprivation of political rights for life, and confiscation of all personal property; the other defendants were sentenced to fixed-term imprisonment ranging from 20 years to one year and one month.
