The market supervision department will strictly punish the units and individuals who illegally engage in the processing and operation of puffer fish in accordance with the relevant provisions of the Food Safety Law of the People's Republic of China; if a crime is constituted, it will be transferred to the public security organ for criminal responsibility in accordance with law.
Brief Facts of the Case:
●At the beginning of 2021, when the Fengxian District Market Supervision Bureau routinely inspected the catering units in its jurisdiction, it found that there were fish labeled "bayu" in the live fish pond of a certain catering unit, with a round body, a brown back, and a pale abdomen.
After discovering the relevant situation, the law enforcement personnel immediately weighed the "barfish" in the pool and carried out the seizure according to law. After investigation, the parties bought the above-mentioned "barley" from the vendors and slaughtered, cooked and sold themselves.
The above-mentioned acts of the parties violated the provisions of Article 34 (12) of the Food Safety Law of the People's Republic of China and constituted the act of dealing in prohibited food. According to Item (5) of the first paragraph of Article 123 of the Food Safety Law of the People's Republic of China, the Fengxian District Market Supervision Bureau imposed an administrative penalty in accordance with the law.
Legal Analysis:
●The unprocessed puffer fish is expressly prohibited by the state to prevent and control puffer fish poisoning accidents and ensure the special needs of consumers to eat safely. The party concerned was not a processing enterprise that possessed the corresponding conditions for breeding puffer fish, and his act of slaughtering puffer fish and selling them in catering services violated Article 34 (12) of the Food Safety Law of the People's Republic of China: "It is prohibited to produce and trade the following foods, food additives, food-related products: ... (12) Food the State expressly prohibits the production and operation of food for the prevention of disease and other special needs; "the provision constitutes the act of dealing in food that is prohibited from being traded."
