After the second instance of the case, the Guizhou High People's Court ruled that the case was remanded for retrial because the public security organs found that Yu Huaying was suspected of other child abduction and trafficking crimes. According to the reporter's understanding, the criminal facts omitted from the original judgment refer to the fact that in addition to the 11 children identified in the original judgment, Yu Huaying was also suspected of abducting and trafficking 6 other children, which means that the number of Yu Huaying suspected of abducting and trafficking children has increased from 11 to 17.
On September 18, 2023, the Guiyang Intermediate People's Court convicted Yu Huaying of child abduction and trafficking in the first instance.
The court held that the defendant Yu Huaying, in order to obtain illegal benefits, abducted and trafficked children many times, and the circumstances of the crime were particularly serious and the harm to society was extremely great. On November 28, 2023, the case was heard in the second instance of the Guizhou Provincial High People's Court.
During the second-instance trial, Yu Huaying had no objection to the facts of the crime of abducting and trafficking 11 children found in the first instance, and pleaded guilty in court, only putting forward the grounds for appeal that the sentence was too heavy; His defender argued that Yu Huaying had confessed and believed that the sentence was too heavy, and suggested a lighter punishment. The agent ad litem in the attached civil case put forward the grounds of appeal that the amount of compensation awarded in the attached civil part was too low.
The procurator of the Guizhou Provincial People's Procuratorate found that the facts found in the first-instance judgment were clear, the evidence was credible and sufficient, the conviction was accurate, the sentencing was appropriate, and the procedures were lawful, and that the appellant Yu Huaying's grounds for appeal could not be sustained, and recommended that the appeal be rejected and the original judgment upheld.
On January 8, 2024, the Guizhou Provincial High People's Court made a second-instance ruling on Yu Huaying's child abduction and trafficking case and remanded it for retrial. The court held that the original judgment omitted the facts of the original trial defendant Yu Huaying's other crimes of abducting and trafficking children, and some of the facts were unclear, and that a retrial should be made in order to clarify all the facts of the appellant Yu Huaying's crimes.
On November 28, 2023, the second-instance trial of the case began, and after the trial, the procuratorate recommended that the case be remanded for retrial on the grounds that the appellant Yu Huaying was also suspected of abducting and trafficking children in Yunnan Province after a preliminary investigation by the public security organs.
