At 10 o'clock on May 31, the divorce dispute case of Xiao Xie, a victim of domestic violence, suing He Moumou, was heard in private at the Wuhou District People's Court in Chengdu, Sichuan Province. The Beijing News reporter learned from Xiao Xie that the judge pronounced the divorce in court, and Xiao Xie obtained custody of the child.

According to Chengdu Daily, the Wuhou District People's Court held that the evidence submitted by the plaintiff Xie Moumou was sufficient to determine that He Moumou had committed domestic violence many times during the existence of the marital relationship, and ruled that Xie Moumou and He Moumou should be divorced. In accordance with the principle of the best interests of the minor children, it was decided that the daughter should be directly raised by Xie XX, and He XX should pay the living expenses of the daughter to the age of 18 in a lump sum at the standard of 2,000 yuan per month, and the daughter's medical expenses and education expenses were borne by Xie XX and He XX 40% and 60% respectively. With regard to the litigation claims such as the division of joint property and damages between the husband and wife, since the relevant cases are still being heard, the court will make a separate judgment after the facts are ascertained.

At 20:30 on May 31, Xiao Xie, who had finished the trial, walked out of the courthouse gate, gave a thumbs up, and said with tears: "I am free from today." ”

Xiao Xie told the Beijing News reporter that in this trial, her main appeal is to divorce her husband He Moumou and obtain custody of her two-year-old daughter, and He Moumou will pay a one-time monthly alimony of 1,500 yuan.

Xiao Xie said that at the trial scene, He Moumou expressed his reluctance to divorce, saying that the relationship had not broken down, and he still wanted to live together and raise children together.

Xiao Xie's claim also involves the division of property after marriage. On suspicion that He Moumou transferred the property to the names of several relatives, Xiao Xie sued He Moumou and his relatives in a separate case for illegally transferring the joint property of the husband and wife. The trial of the five tort liability disputes was completed in the Wuhou District People's Court on May 30, and the verdict was announced at a later date.

In addition to the above claims, Xiao Xie's divorce dispute complaint shows that the plaintiff requested that the defendant be ordered to pay 800,000 yuan in damages for the plaintiff's serious disability and 100,000 yuan in moral damages due to domestic violence.

The Beijing News previously reported that relevant judicial documents show that during the marriage of Xie and He, He Moumou frequently abused and intimidated Xiao Xie for a long time, violently beat him, and committed violence 16 times in two years, causing his body to be injured to varying degrees many times, and he sought medical treatment and called the police many times. During this period, the Jinyang Police Station of the Wuhou District Bureau of the Chengdu Municipal Public Security Bureau twice issued a "Domestic Violence Warning" to He Moumou, but he refused to make corrections, causing Xiao Xie to be mentally frightened and go out to hide.

Xiao Xie and He Moumou signed a divorce agreement on April 15, 2023, but He Moumou repented afterwards and refused to divorce. On April 24 of that year, Xiao Xie submitted a habeas corpus and divorce application to the Wuhou District People's Court, but the court did not accept it due to incomplete formalities. That night, He Moumou found Xiao Xie who went out to hide and violently assaulted him. In the last violence on April 25, 2023, He Moumou's beating caused Xiao Xie multiple injuries all over his body, including four serious injuries of the second degree.

After the incident, He Moumou was criminally detained by the public security organs. In December 2023, the Wuhou District Procuratorate of Chengdu City filed a public prosecution with the Wuhou District People's Court on suspicion of intentional injury and abuse.
