Chapter I: General Provisions
Article 1 These measures are formulated in accordance with the "Budget Law of the People's Republic of China", "Regulations on Preferential Treatment of Military Pensions", "Measures for Medical Security for Disabled Veterans", "Measures for the Management of Medical Security Funds for Preferential Care Recipients", "Implementation Measures for Medical Security for Preferential Care Recipients in Guizhou Province" and other laws, regulations and relevant provisions on budget management, combined with the actual conditions of our province, in order to standardize the management of medical security funds for preferential care recipients, improve the efficiency of the use of funds, and effectively ensure the implementation of medical treatment for preferential care recipients.
Article 2 The term "medical security funds for preferential care recipients" in these Measures refers to the funds for the provincial financial department to implement the medical treatment of preferential care recipients, and the implementation period is temporarily until December 31, 2028. After the expiration of the period, the Provincial Department of Finance, together with the Provincial Department of Veterans Affairs, shall determine the follow-up period in accordance with the current laws and regulations, as well as the relevant provisions of the central and provincial governments, work needs and performance evaluation.
Article 3 The term "preferential care recipients" as used in these Measures refers to disabled veterans, survivors of martyrs, survivors of servicemen who died in the line of duty, survivors of servicemen who died of illness, demobilized servicemen in their hometowns, veterans who returned to their hometowns with illness, and veterans who participated in wars and tests who are registered in the administrative area of each city (prefecture) of this province and enjoy regular state pension subsidies.
Chapter II: Division of Duties
Fourth provincial financial departments. The Provincial Department of Finance organizes the preparation of special fund budgets and reviews the budget proposals submitted by the Provincial Department of Veterans Affairs; The provincial budget and performance targets will be approved to the Provincial Department of Veterans Affairs in a timely manner, and the transfer payment funds and performance targets will be issued in a timely manner in conjunction with the Provincial Department of Veterans Affairs; In conjunction with the Provincial Department of Veterans Affairs, supervise and inspect the budget implementation and use of special funds; Organize and direct performance monitoring and performance evaluation.
Article 5 Provincial-level competent authorities. The Provincial Department of Veterans Affairs is the main body of the department's budget implementation, and performs the main responsibility for the management of the department's special funds. The Provincial Medical Insurance Bureau is responsible for guiding the municipal and county medical insurance departments to implement medical security policies such as serious illness insurance and medical assistance for preferential care recipients, promoting the "one-stop" settlement of medical expenses for preferential care recipients, and cooperating with the Provincial Department of Veterans Affairs to do a good job in matters related to preferential care and medical security funds.
Chapter III: Allocation and Use of Funds
Article 6 The funds for preferential care and medical security shall be allocated according to the factor method. It is calculated and distributed according to the total amount of preferential medical security funds and the total number of preferential care recipients in our province approved by the Ministry of Veterans Affairs and the Ministry of Finance. The allocation of preferential care medical security funds may be appropriately adjusted according to the use of preferential care medical security funds in the previous year, the results of performance evaluations, and the focus of work in the current year.
Article 7 The medical security funds for the recipients of preferential care are mainly used for:
(1) Payment subsidy.
Subsidies will be given to disabled servicemen from grades 1 to 6 to participate in the basic medical insurance for employees. Appropriate subsidies will be given to those who are not employed, do not meet the conditions for participating in urban and rural medical assistance subsidies, and have real difficulties in paying personal premiums to participate in basic medical insurance for urban and rural residents.
(2) Subsidies for medical expenses.
1. For the medical expenses incurred by the preferential care recipients within the scope of basic medical insurance, serious illness insurance, and medical assistance payment subsidies, the remaining part after reimbursement in accordance with the provisions of the medical insurance policy shall be subsidized in accordance with the relevant provisions of the "Guizhou Provincial Measures for the Implementation of Medical Security for Preferential Care Recipients";
2. For those who have not participated in the basic medical security systems such as basic medical insurance for employees and basic medical insurance for urban and rural residents, and the preferential care recipients who have a heavy burden of personal medical expenses will be given subsidies in accordance with relevant provisions for drugs and services that meet the scope of medical insurance;
3. Subsidies shall be given in accordance with relevant provisions for the medical expenses of disabled servicemen who are disabled in the line of duty due to war or work for which their units are unable to pay or who do not have a work unit;
4. Subsidies for other medical expenses provided by the people's governments of provinces, cities (prefectures) and counties (cities and districts) in accordance with the Regulations on Preferential Treatment of Military Pensions.
Article 8 Recipients of preferential care with dual or multiple identities shall enjoy medical treatment in accordance with the principle of high status.
Article 9: The medical security funds for the recipients of preferential care shall be included in the budgets of governments at all levels.
Article 10 The Provincial Department of Veterans Affairs shall submit a letter to the Provincial Department of Finance every year according to the number of relevant preferential care recipients and the medical security budget of the preferential care recipients approved by the Ministry of Veterans Affairs. The Provincial Department of Finance, in conjunction with the Provincial Department of Veterans Affairs, shall determine the fund allocation plan and regional performance targets, and reach the financial and veterans' affairs departments of each city (prefecture) and county (city, district) within the specified time limit.
Article 11: All levels of finance, veterans' affairs, and medical security departments are responsible for the authenticity, accuracy, and completeness of the data provided in accordance with the principle of "who provides it, who is responsible".
Article 12 The financial departments at all levels shall, in accordance with the relevant provisions on budget disclosure, promptly disclose the arrangements for medical security funds for the recipients of preferential care, and accept social supervision.
Article 13 In the implementation of the budget, the Provincial Department of Veterans Affairs, in conjunction with the Provincial Department of Finance, shall guide the departments of veterans' affairs and financial departments of cities (prefectures), counties (cities and districts) to monitor the achievement of performance targets and ensure that regional performance targets are achieved as scheduled.
After the implementation of the budget, the veterans' affairs departments at all levels shall, in conjunction with the financial departments at the same level, organize the self-evaluation of the performance of the medical security funds of the preferential care recipients, and submit the use, balance and performance self-evaluation report of the medical security funds of the preferential care recipients in writing to the higher veterans' affairs department in accordance with the procedures. The Provincial Department of Veterans Affairs and the Provincial Department of Finance shall carry out the key performance evaluation of the medical security funds of the preferential care recipients in a timely manner, and the performance evaluation results shall be used as an important basis for budget arrangements, policy adjustments and improved management.
Article 14 The financial and veterans' affairs departments at all levels shall strictly follow the scope of expenditure provided for in these Measures, implement special management, and earmark funds for specific purposes. It shall not be mixed with subsidies for preferential care recipients, urban and rural medical assistance, and other funds, and shall not be used for expenditures such as subsidies for living difficulties, subsidies for medical institutions, basic medical insurance handling agencies, and veterans' affairs departments, and shall not be used in any form to crowd out, misappropriate, withhold, or retain funds.
Article 15 The departments of finance and veterans' affairs at all levels shall take measures to effectively accelerate the progress of budget implementation and improve the effectiveness of budget implementation. The management of the carry-over balance funds shall be carried out in accordance with the relevant provisions of the central and provincial governments.
Article 16 The medical security funds for the preferential care recipients shall be used to subsidize the payment of basic medical insurance for employees of disabled servicemen from the first to the sixth grade, and shall be verified and confirmed by the regional veterans' affairs department in conjunction with the medical security department at the same level after verifying and confirming the number of insured persons and the required funds in accordance with the policy, and shall be handled in accordance with the relevant procedures for the payment of basic medical insurance for employees, and shall be included in the special account of the basic medical insurance fund for employees in the special financial account; The medical security funds for the recipients of preferential care used to subsidize other matters shall be reviewed and allocated by the overall regional finance department in accordance with the fund plan provided by the veterans' affairs department at the same level.
Article 17: The medical security funds for the recipients of preferential care shall be managed in accordance with the relevant provisions on direct funds. Strictly implement the centralized payment system of the state treasury, pay funds to the ultimate payee through a zero-balance account in accordance with the budget indicators, fund payment needs, fund payment application agreements or contract agreements, and the actual progress of the project, and strictly prohibit the transfer of funds to the actual fund accounts of budget units, the accounts of local financing platform companies and condominium accounts in violation of regulations, and the misappropriation of financial funds. Where government procurement is involved, it shall be implemented in accordance with government procurement laws, regulations, and relevant systems.
Article 18: Local departments of finance, veterans' affairs, and medical security shall formulate measures to establish and improve financial management systems, comprehensively promote the "one-stop" settlement of medical expenses for recipients of preferential care, and formulate measures for the timely settlement of medical expenses for recipients of preferential treatment.
Article 19 The Provincial Department of Veterans Affairs is responsible for the use and daily supervision and management of the medical security subsidy funds for the preferential care recipients, regularly dispatches the progress of the funds, and strengthens communication and cooperation with the municipal and county veterans' affairs departments, establishes an information sharing and coordination mechanism, as well as a fund disclosure mechanism, discloses the relevant information of the special funds, and ensures the timely allocation, compliant use and efficient operation of the special funds.
Chapter IV: Supervision and Inspection
Article 20: All levels of finance, veterans' affairs, and medical security departments shall allocate and use funds in accordance with laws and regulations, strengthen process control, implement the separation of incompatible posts (duties), strengthen risk prevention and control, as well as the management and supervision and inspection of the use of medical security funds, and actively cooperate with relevant departments to do a good job of auditing and other work.
If there is any violation of the provisions of these Measures, as well as other violations of laws and regulations such as abuse of power, dereliction of duty, favoritism, etc., in the allocation, review, use, and management of medical security funds for preferential care recipients, and their staffs, they shall be held accountable in accordance with the Budget Law of the People's Republic of China, the Civil Servants Law of the People's Republic of China, the Supervision Law of the People's Republic of China, the Regulations on the Punishment and Punishment of Financial Violations, and other relevant national regulations; and where a crime is suspected, it shall be transferred to the relevant organs for handling in accordance with law.
Chapter V: Supplementary Provisions
Article 21: Local departments of finance, veterans' affairs, and medical security may, on the basis of these Measures, and in conjunction with relevant departments, formulate detailed implementation rules in conjunction with relevant departments.
Article 22 These measures shall be interpreted by the Provincial Department of Finance in conjunction with the Provincial Department of Veterans Affairs and the Provincial Medical Insurance Bureau.
Article 23: These Measures take effect on January 1, 2024. The notice of the Provincial Department of Finance, the Provincial Department of Veterans and the Provincial Medical Insurance Bureau on Printing and Distributing the "Guizhou Provincial Measures for the Management of Medical Security Funds for Preferential Care Recipients" (Qiancaishe [2020] No. 133) shall be repealed at the same time.
