Home Buying Reminder

In order to prevent the risk of buying a house, safeguard the legitimate rights and interests of buyers and sellers of commercial housing, and avoid disputes over the sale and purchase of commercial housing, the precautions for purchasing pre-sold commercial housing are hereby reminded as follows:

1. Carefully check the relevant documents

Before buying a house, please check whether the project is developed by a real estate development enterprise and whether the "five certificates" are complete, namely:

(1) "Real Estate Development Enterprise Qualification Certificate"

(2) State-owned Land Use Right Certificate (or Real Estate Property Certificate)

(3) "Construction Land Planning Permit"

(4) "Construction Project Planning Permit"

(5) Construction Permit for Construction Projects

(6) "Commodity Housing Pre-sale Permit Certificate"

The qualification certificate of real estate development enterprises and the "five certificates" can be viewed at the sales site through the publicity content. If you purchase a pre-sold commercial house through a brokerage agency, you also need to check the power of attorney of the real estate development enterprise, the business license of the brokerage agency, and the record certificate of the real estate brokerage agency within the validity period. If the developer fails to provide the "five certificates" on the grounds that the formalities are being processed, the buyer shall refuse to purchase and shall not blindly pay any money.

2. Precautions for signing a contract

Before buying a house, it is necessary to have a on-the-spot understanding of the real estate, and it is recommended that buyers pay attention to the following points when viewing the house and signing the contract:

(1) Understand the nature of the house (residential, commercial, other properties), price, area (in the suite and in the pool), house type, orientation, surrounding environment, unfavorable factors and quality assurance.

(2) The delivery time of the basic supporting facilities such as water supply, power supply, and gas supply of the house should be clarified, and the greening, sewage, and pre-property of the community where the house is located should be consulted in detail.

(3) Confirm the commitments of the real estate consultant and other relevant parties in writing to avoid disputes in the future.

(4) Carefully sign the "Subscription Agreement" of the house, in case of disputes, it is difficult to guarantee the rights and interests of the buyer.

(5) There should be clear and specific agreements on the delivery time, delivery conditions, liability for breach of contract and the handling of real estate ownership certificates.

(6) In case of promotional terms such as "pay a deposit (deposit) and enjoy discounts", "preferential treatments" and "buy a house and send home appliances", we must be cautious.

(7) Do not buy houses that have not obtained the "Commercial Housing Pre-sale License".

(8) For projects that have obtained the "Commercial Housing Pre-sale License", the buyer must check and verify whether the purchased commercial housing is within the scope of the pre-sale permit, and whether there are any restrictions on rights such as mortgage and seizure.

(9) When accepting the house, the buyer shall check whether the house delivered by the real estate development enterprise meets the delivery conditions agreed in the contract against the signed "Commercial Housing Sales Contract". At the same time, when the house is delivered, the relevant handover certificate should be signed, and the "Residential Quality Assurance Certificate" and "Residential Instruction Manual" should be requested from the real estate development enterprise.

(10) Understand the comprehensive strength, integrity and reputation of the development enterprise in many aspects.

If you encounter an "abnormal" sales model or sales method in the process of buying a house, please carefully screen and contact the competent department where the project is located in time to verify the relevant situation.

3. Read the contract agreement carefully

Before deciding to buy a home, be sure to review the terms of the contract and agreement in detail (never accept any promise that is not outside the contract or agreement). When choosing a pre-sale fund supervision project, please carefully check the pre-sale fund supervision bank and account information indicated on the "Commercial Housing Pre-sale License", and all payments (including deposits, down payments, installments, one-time payments and bank mortgage loans, housing provident fund loans, etc.) must be deposited into the project pre-sale fund supervision account. If the transfer is made through the POS machine, it is necessary to carefully check whether the transfer account is a pre-sale fund supervision account, and go through the online signing procedures at the same time as paying the purchase price.

In order to ensure your rights, please consciously comply with the regulations, and ask you to supervise the development company, and do not pay the purchase money to any other account that is not the pre-sale fund escrow account.
