The Labor Insurance Regulations are repealed

The Decision of the State Council on Amending and Repealing Some Administrative Regulations was promulgated, and 13 administrative regulations, including the Labor Insurance Regulations, will be repealed and will come into force on May 1, 2024.

Promulgated and implemented by the former Government Council in 1951, the Labor Insurance Regulations were the earliest social security system established for workers in mainland China, laying a solid foundation for the modern social security system. However, with the development of the times, the provisions of the labor insurance regulations have gradually been replaced by laws and regulations such as the Social Insurance Law, the Regulations on Work-related Injury Insurance, and the Special Provisions on the Labor Protection of Female Employees. The repeal of the labor insurance regulations not only marks the continuous improvement of the mainland's social security system, but also clearly defines some important concepts in the handling of labor relations.

1. Personal rights and interests are not affected, and it is important to pay social security on time

For individuals, the repeal of the Labor Insurance Regulations will not have a material impact on their rights and interests. It is important to note that individuals are required to pay social insurance on time. Only by ensuring that you pay social security every month can you enjoy all kinds of protection, including pension and medical benefits.

2. Impact on sick pay

There are two legal bases for sick leave pay at the national level: one is the provisions in the Labor Insurance Regulations and the draft amendments to the Detailed Rules for the Implementation of the Labor Insurance Regulations. The second is the provisions in the "Opinions on Several Issues Concerning the Implementation of the Labor Law of the People's Republic of China".

However, due to the inconsistencies in the relevant legal bases, in practice, different bases are selected or referred to when different regions stipulate the standard of sick leave pay in legislation.

Later, some provinces and municipalities issued local regulations, such as Hebei Province, Shanghai Municipality, Shenzhen City, etc.

After the repeal of the Labor Insurance Regulations, the provisions on sick pay standards in the Opinions on Several Issues Concerning the Implementation of the Labor Law of the People's Republic of China have become the sole legal basis at the national level. Unless otherwise specified by the local government, the standard of sick pay is not less than 80% of the minimum wage.

3. The inevitability of social progress

The repeal of the Labor Insurance Regulations is considered to be an inevitable consequence of social progress. With the development of the times, the old system may no longer be able to adapt to the changes and needs of society. Therefore, the repeal of this regulation means that society will usher in a new change and development in terms of labor security, which is essential to improve people's quality of life.

The minimum wage standard has been raised!

1. Shenyang City

The Shenyang Municipal Human Resources and Social Security Bureau issued a notice clarifying that from May 1, 2024, the monthly minimum wage standard in Shenyang will be carried out.

The monthly minimum wage standard for Heping District, Shenhe District, Tiexi District, Huanggu District, Dadong District, Hunnan District, Yuhong District, Shenbei New District and Sujiatun District was adjusted from 1,910 yuan to 2,100 yuan, an increase of 9.9 percent, and the minimum wage standard for part-time working hours was adjusted from 19.2 yuan to 21 yuan, an increase of 9.3 percent.

The monthly minimum wage standard in Liaozhong District, Xinmin City, Faku County, and Kangping County was adjusted from 1,640 yuan to 1,900 yuan, an increase of 15.8 percent, and the minimum wage standard for part-time working hours was adjusted from 16.5 yuan to 19 yuan, an increase of 15.2 percent.

2. Dalian City

Recently, the Dalian Municipal Human Resources and Social Security Bureau issued the Notice on Adjusting the Minimum Wage Standard in Dalian, clarifying that the minimum wage standard will be adjusted from May 1, 2024.

The Notice is clear:

The monthly minimum wage for full-time employees of all employers has been adjusted from 1,910 yuan to 2,100 yuan.

The hourly minimum wage for part-time workers was adjusted from 19.2 yuan to 21 yuan.

Among them, the monthly minimum wage standard does not include wages for extended working hours, allowances for medium shifts, night shifts, high temperatures, low temperatures, underground, toxic and harmful and other special working environments and conditions, and labor welfare benefits stipulated by laws, regulations and the state.

3. Anshan City, Liaoning Province

In early April, Anshan City, Liaoning Province, issued the Notice on Adjusting the Minimum Wage Standard in the City, clarifying that the minimum wage standard will be adjusted from May 1, 2024.

The Notice is clear:

1. Monthly minimum wage

Tiedong District, Tiexi District, Lishan District, Qianshan District, High-tech Zone, Economic Development Zone, and Qianshan Scenic Area were adjusted from 1,710 yuan to 1,900 yuan;

Haicheng City, Tai'an County, and Xiuyan County were adjusted from 1,580 yuan to 1,700 yuan.

2. Hourly minimum wage

Tiedong District, Tiexi District, Lishan District, Qianshan District, High-tech Zone, Economic Development Zone, and Qianshan Scenic Area were adjusted from 17.2 yuan to 19 yuan;

Haicheng City, Tai'an County, and Xiuyan County were adjusted from 15.9 yuan to 17 yuan.
