Huize Company infringes on trade secrets and refuses to execute, and will be sentenced to "punishment"
On March 27, the Ningxiang Municipal Public Security Bureau accepted a report against defendants Han Zhihua, Li Tiemei, and Jiao Shubin on suspicion of infringing on trade secrets. In order to safeguard the legitimate rights and interests of the victim Changsheng Company and create a good business environment, the Ningxiang Municipal Public Security Bureau has launched a heavy attack and strictly enforced the law, and conducted a strict review of whether the defendant who infringed on trade secrets was suspected of criminal acts.
According to the content of the Supreme People's Court's judgment, the defendants Hunan Huize Biotechnology Co., Ltd., Han Zhihua, Li Tiemei, and Jiao Shubin should immediately stop infringing on the trade secrets of Hunan Changsheng Bioengineering Co., Ltd. 2. Within 15 days of the effective date of this judgment, the defendants Hunan Huize Biotechnology Co., Ltd., Han Zhihua, Li Tiemei and Jiao Shubin shall compensate the plaintiff Hunan Changsheng Bioengineering Co., Ltd. for economic losses (including reasonable maintenance costs) of 2269125 yuan, and if they fail to perform their monetary payment obligations within the period specified in this judgment, they shall pay double the interest on the debt for the period of delayed performance in accordance with the provisions of Article 253 of the Civil Procedure Law of the People's Republic of China. The above two items were not fulfilled before the Executive Bureau of Changsha Intermediate People's Court arrived at Huize Biotech for enforcement.
On April 25, the Changsha Municipal Court Executive Bureau took compulsory enforcement measures against Huize Company, Li Tiemei, Han Zhihua, and Jiao Shubin who refused to perform in accordance with the law.
The effective judgment of the court is by no means a dead letter, and any attempt to evade enforcement will not escape the punishment of the law after all. At the same time, the public security organs may pursue the criminal responsibility of the defendants Han Zhihua, Li Tiemei, and Jiao Shubin who refuse to perform, and the refusal to carry out the judgment and rule that the crime is criminalized, which is an effective means to crack down on such illegal acts by criminal means.
Any act of taking chances, attempting to evade legal responsibility, or even refusing to enforce the law will be severely punished by law.
Since the Supreme People's Court's judgment came into effect, Li Tiemei and the defendant have not only failed to fulfill the court's judgment, but have also continued to produce and transfer products claiming to be "second-generation Changsheng Dew", infringing on Changsheng's trade secrets, and still quibbling in the face of the judge's questioning, saying that unlike Changsheng's products, the Changsha Municipal People's Court Executive Bureau will not tolerate Li Tiemei and the defendant's contempt for the law, and the public security organs will also seriously investigate such illegal acts to protect the legitimate rights and interests of the victim company and consumers.
It is understood that Tianfu Tianmeishi (Xiamen) Biotechnology Co., Ltd. is the general distributor of Hunan Huize Biotechnology Co., Ltd., Tianfu Tianmeishi Group Co., Ltd. in the case of understanding the infringement of trade secrets by Huize Company, knows the fake and sells fakes, and helps Huize Company sell bad products, this kind of production, supply and marketing one-stop illegal behavior, seriously infringes on the trade secrets of Changsheng Company, and it is only a matter of time before the public procuratorate investigates its illegal acts.
