In order to further strengthen the supervision of the electricity market and maintain a fair and just electricity market order, in accordance with the "Notice of the National Energy Administration on Printing and Distributing the Key Points of Energy Supervision in 2024" (Guo Neng Fa Gui [2024] No. 4), the National Energy Administration has decided to organize and carry out special supervision on outstanding problems in the electricity market order nationwide. The relevant matters are hereby notified as follows.

1. Regulatory objectives

Thoroughly implement the spirit of the 20th National Congress of the Communist Party of China and the Second Plenary Session of the 20th Central Committee of the Communist Party of China, implement the deployment of the Party Central Committee and the State Council on accelerating the construction of a unified national market, focus on the overall situation of serving the high-quality development of electric power, focus on the outstanding problems in the market-oriented trading and market operation of electricity, carry out special supervision of outstanding problems in the electricity market order, put forward targeted regulatory opinions and suggestions, effectively maintain good market order, protect the legitimate rights and interests of market members, and promote the acceleration of the construction of a unified and open, orderly competition, safe and efficient, A well-governed national unified electricity market system has achieved optimal allocation of resources on a larger scale.

2. Regulatory basis

3. Regulatory content

Carry out special supervision of outstanding problems in the order of the electricity market nationwide, focusing on the supervision of the following situations。

(1) Implementation of trading rules. Focus on the reasonableness, compliance and fairness of market operating institutions in various market transactions since 2023. Specifically, it includes: the formulation and revision of the implementation rules for trading, and the implementation of the trading rules for the whole process of electricity market-based trading.

(2) Restricting market competition. Focus on the intervention of market operators in the market since 2023 and the compliance of market trading entities. Specifically, it includes: illegal intervention in the electricity market by market operating institutions, unfair competition, market manipulation, collusion in quotations and illegal transactions by market trading entities, cross-provincial and cross-regional transactions of users participating in wholesale electricity energy transactions, and the operation of the power purchase mechanism of power grid enterprises.

(3) Information disclosure and reporting. Focus on the information disclosure and reporting of the electricity market carried out by market operating institutions and power grid enterprises since 2023. Specifically, it includes: market information management, information disclosure system construction and platform construction, data interface openness, etc., the timeliness, accuracy and completeness of information disclosure, and the connection between power trading, dispatching agencies and power grid enterprises in terms of data interaction.

(4) Other outstanding problems in the order of the electricity market。 Other outstanding problems in the electricity market order that may exist in the jurisdiction discovered by the power regulator through daily supervision, feedback from market entities, and complaints and reports。

Fourth, regulatory steps

(1) Start deployment (April). The National Energy Administration has prepared and issued a special regulatory notice, clarified the regulatory content and requirements, and initiated special supervision on outstanding problems in the electricity market order。 In accordance with the requirements of the notice, each dispatched agency shall organize relevant units within its jurisdiction to make specific work arrangements in combination with the actual situation of the region and the daily supervision situation.

(2) Self-examination and self-correction (May). In accordance with the notice and the requirements of the local dispatched agencies, the relevant market operating institutions and power grid enterprises shall carry out a comprehensive self-inspection against the regulatory content, and promptly rectify the problems found, and submit the self-inspection report to the relevant dispatched agencies before May 31. The contents of the self-inspection report include, but are not limited to: the overall situation, the main problems found, the corrective measures taken, and the next step considerations.

(3) On-site supervision (June to mid-July). Each dispatched agency will form a working group to go to market operating institutions, power grid enterprises and relevant power trading entities in their jurisdictions to carry out on-site supervision by means of regulatory discussions, access to materials, inquiry records, verification of account books, questionnaires, etc. On-site supervision is problem-oriented, and according to the needs of the work, in response to outstanding problems, extended supervision of market entities can be carried out, and the relevant situation can be fully verified and verified. In order to effectively reduce the burden on the grassroots, for areas that carry out comprehensive supervision in the field of electric power, on-site supervision will be included in the comprehensive supervision work.

(4) Problem handling (late July to mid-August). According to the problems found in the on-site supervision, each dispatched agency shall sort out and form a list of problems, and may take measures such as ordering rectification, supervising interviews, and administrative punishments as appropriate. Each dispatched agency shall prepare a summary of the regulatory work according to the regulatory situation and submit it to the Market Supervision Department of the National Energy Administration before August 10.

(5) Summary specifications (late August to September). The National Energy Administration organizes relevant dispatched agencies to systematically sort out the special supervision work in various places, form special supervision reports, and release them according to the procedures. For issues that may involve the State Grid, the headquarters of China Southern Power Grid, the Beijing Electric Power Trading Center, and the Guangzhou Electric Power Trading Center, the organization will be extended to relevant units for further verification and handling.

5. Relevant requirements

(1) Enhance ideological understanding. Carrying out special supervision of outstanding problems in the order of the electricity trading market is an important task to accelerate the construction of a unified national electricity market system, which is conducive to maintaining the market order of fair competition and protecting the legitimate rights and interests of market members. All relevant units should earnestly improve their ideological understanding, fully understand the importance of special supervision work, do a good job of communication with relevant units and departments, and form a joint work force.

(2) Actively cooperate with supervision. All relevant market operating institutions and power grid enterprises shall, in accordance with the requirements, comprehensively carry out self-inspection and rectification work according to the content of the work, and submit self-inspection and rectification reports on time; they should actively cooperate with the special supervision work, appoint special personnel to be responsible for docking with the working group, and provide relevant materials and data in a timely, accurate and complete manner as required.

(3) Strive for the effectiveness of supervision. All dispatched agencies should always adhere to the problem-oriented, focus on the outstanding problems of the electricity market order, explore the development of digital supervision and penetrating supervision, and promote the solution of outstanding problems in the construction of the electricity market from the source and at a deep level, and at the same time, innovate and carry out credit supervision, strengthen the application of credit information of market members, and further improve the efficiency of supervision. In the process of on-site supervision, it is necessary to strictly abide by the spiritual requirements of the eight central regulations, and effectively prevent formalism and going through the motions.
