In the event of a statutory holiday, should the employer pay the salary in advance?
The payment of wages has nothing to do with the "May Day" holiday, because the employer pays wages according to the original set payday, as long as there is no arrears, it is not illegal. If the payday falls on a holiday, the employer should pay it in advance.
According to Article 12 of the Regulations of Guangdong Province on the Payment of Wages, the employer and the employee shall clearly stipulate the wage payment cycle and payment date in the employment contract. The employer shall pay the wages of the employee on the agreed date, and in the case of statutory holidays or rest days, it shall pay the wages in advance on the nearest working day.
ask
Can wages be delayed or delayed?
According to Article 10 of the Regulations of Guangdong Province on the Payment of Wages, an employer shall pay wages in full in monetary form in accordance with the fixed wage payment period, and shall not be in arrears or withheld.
Where monthly, weekly, daily, or hourly wage systems are implemented, the wage payment cycle may be determined on a monthly, weekly, daily, or hourly basis.
Where a piece-rate wage system is implemented or wages are calculated and paid based on the completion of certain tasks, the wage payment cycle may be agreed upon according to the piecework rate or the completion of work tasks, but if the payment cycle exceeds one month, the employer shall pay wages every month in accordance with the agreement.
If the annual salary system is implemented or wages are paid according to the appraisal cycle, the employer shall pay the wages every month in accordance with the agreement, and shall settle and pay the wages in full at the end of the year or at the end of the appraisal cycle.
ask
How to calculate the salary for overtime during the "May Day" holiday?
According to this year's holiday arrangement, those who work overtime on May 1 will be paid three times their wages, and those who work overtime from May 2 to 5 will be paid twice their wages.
According to Article 20 of the Regulations of Guangdong Province on the Payment of Wages, if an employer arranges an employee to work overtime or extend working hours, it shall pay the employee the wages and remuneration for the overtime or extended working hours according to the following standards:
(1) Where a worker is arranged to work longer hours on a working day, a wage remuneration of not less than 150 percent of the worker's daily or hourly wages for normal working hours shall be paid;
