Fake seeds pit farmers, causing losses of more than 40 million yuan

An agricultural technology company in Bayannur City produced and sold more than 20 tons of fake and shoddy corn seeds, involving an amount of more than 1,000 yuan, and Suo XX in Ulanchabu City produced and sold fake and shoddy sunflower seeds, resulting in an empty shell of 1,600 mu of sunflowers.

The criminal gang in Tongjiang City, Jiamusi, produced and sold more than 70 tons of counterfeit corn seeds; Xu Moumou in Baoying County, Yangzhou City, used commercial grain as seeds, with a total sales amount of more than 240,000 yuan; and Lu and Li Moumou in Tianquan County, Ya'an City, sold fake and shoddy seeds and exported them to more than 10 cities.

The Inner Mongolia Autonomous Region, Heilongjiang, Jiangsu, Sichuan and other places have announced a number of typical agriculture-related cases, and the public security organs have always maintained a high-pressure and hard-hitting posture on the crime of making and selling fake and inferior agricultural materials, so as to create a good production order for agricultural production and spring plowing and preparation.

1. Case of production and sale of fake and shoddy corn seeds by an agricultural technology company in Bayannur City

At the end of 2023, the public security organs of Bayannur City received clues from the departments of agriculture, animal husbandry and science and technology, and successfully detected a case of making and selling fake and shoddy seeds, arrested 7 criminal suspects, seized more than 20 tons of fake waxy corn seeds, and the amount involved was more than 1,000 yuan, and handed over 2 criminal suspects to the public security organs in other places. After investigation, an agricultural science and technology service company used bulk corn seeds without trademarks and labels to sell waxy corn seeds with a well-known trademark, selling a total of 45,160 kg of seeds. After identification, the germination rate of counterfeit seeds does not meet the national standards and is an unqualified product, resulting in a loss of more than 4,000 yuan in agricultural production.

2. The case of Suo XX series of production and sale of fake and shoddy sunflower seeds in Ulanchabu City

In February 2024, the public security organs of Ulanqab City received reports from the masses and cracked 3 cases of making and selling fake sunflower seeds in a row, and arrested 4 criminal suspects. After investigation, Suo Moumou, Lin Moumou and other 4 people privately sold expired sunflower seeds stored for more than 10 years to Xilin Gol League, Ulanqab City, Bayannur City, Hebei Province, Xinjiang and other places. Inner Mongolia a certain sub-Co., Ltd. sales director Suo Moumou, the 2013 production of sunflower seeds at a price of 50 yuan per bag for sale, the company's salesman Gao, Lin and others know that the seeds sold expired, deteriorated, still shoddy sold to farmers, inferior sunflower seeds led to 1600 acres of sunflower shells, resulting in a loss of more than 200 yuan for farmers.

3. Case of Jiamusi Tongjiang City criminal gang making and selling counterfeit corn seeds

"Comrade police, the seeds I bought through WeChat are fake, and more than 300,000 yuan are all hard-earned money, what can I do!" On March 18, the Jiamusi Tongjiang City Public Security Bureau received a report from the public, saying that the corn seeds they bought were found to be fake seeds after inspection. After careful investigation, the people's police launched an arrest on March 21, successfully smashed a criminal gang that produced and sold fake and shoddy products, smashed one den for the production and processing of fake seeds, and seized more than 70 tons of finished counterfeit corn seeds, involving an amount of more than 300 yuan.

4. Case of production and sale of fake and shoddy seeds by Xu Moumou in Baoying County, Yangzhou City

Before 2024, a farmer approached the agricultural department and reported that there was a problem with the seeds he bought: "I bought 50,000 yuan of rice seeds from the family of a boss surnamed Xu, and he claimed that the germination rate of this batch of seeds was more than 90%, but the germination rate of the rice I planted was less than 50%!" "We ordinary people farm just to make some money, how good is the germination rate so low!" It turned out that the farmer bought a batch of seeds from Xu Moumou, and after sowing them, he looked forward to the seeds germinating every day. But time passed, and his land was still bare. At this point, he muttered, "Is there a problem with the seeds?" With such a question, he approached the agricultural department, hoping to give himself an explanation. To this end, the agricultural department immediately launched an investigation. After investigation, the boss surnamed Xu reported by the farmer is a large local farmer in Baoying, and all the grain cannot be sold successfully after the harvest every year. In order to "reuse" the surplus commercial grain at hand, Xu Moumou actually started the idea of the surrounding farmers. From 2021 to 2023, without obtaining a crop seed production and operation license and crop seed production filing procedures, Xu Moumou used commercial grain as seeds and sold them to many surrounding farmers at a price of about 2 yuan per catty lower than the regular seeds in the market, with a total sales amount of more than 240,000 yuan. The Baoying County Agriculture and Rural Bureau determined that the seeds produced and operated by Xu Moumou without labels were fake seeds.

5. Lu and Li in Tianquan County, Ya'an City, sold fake and shoddy seeds

At the beginning of 2023, Lu, who sells bulk rice seeds, aimed at the rice seed market needed for planting by a large number of farmers in Renyi Town and the surrounding areas, and sold rice seeds without national approval under the guise of "high-end services" such as preferential agricultural assistance and door-to-door delivery. In just a few days, 80 farmers have purchased seeds, and more than 210 acres of rice seeds have been sold.

However, a few months after the villagers planted the seeds with hope, they found that some of the rice only had seedlings and no ears, and some of the rice did not bloom even though they had ears. At the time of the autumn harvest in 2023, the fertile fields that should have harvested more than 200,000 catties of grain were not harvested.

After receiving the report, the Tianquan County People's Procuratorate visited seven villages, including Yongxing Village, Shiqiao Village, and Xikou Village, Renyi Town. In the field, the prosecutors learned that although Lu had signed a letter of commitment to pay compensation with the farmer, he had been refusing to fulfill the promise of compensation under various excuses.

The prosecutor also found that the case involved the failure of the relevant regulatory departments to perform their duties, in response to the fact that the Tianquan County Agriculture and Rural Bureau had not imposed an administrative penalty on Lu for more than 3 months and neglected to perform administrative law enforcement duties, in January this year, the procuratorate issued a procuratorial suggestion, and at the same time urged Lu to fulfill his commitment to compensation. With the efforts of all parties, Lu finally fulfilled his promise of compensation to 80 farmers.

After the Tianquan County People's Procuratorate sent the rice seed involved in the case to the judicial appraisal, it was found that the rice seed did not meet the national standards and was a fake and shoddy seed. According to Lu's confession, the rice seed was an experimental rice seed of a rice research and development center in Anhui, and he purchased the goods from a seed dealer in Leshan, Li. This batch of seeds is not only sold in Renyi Town, Tianquan County, but also exported to more than 10 cities such as Leshan and Shanghai.

In view of the fact that Lu's behavior has been suspected of the crime of selling fake and shoddy seeds, the procuratorate urged the agricultural and rural departments to promptly transfer the case to the public security organs for filing and investigation. In March 2024, the Tianquan County Public Security Bureau took compulsory measures against Lu and Li on suspicion of selling fake and shoddy seeds, and a gang selling fake rice seeds across multiple provinces was dismantled.
