There have been many discussions on the issue of "face brushing", and many consumers have expressed that they have been suffering from "face brushing" for a long time. At the beginning of this year, the community where the author lives silently installed a face recognition access control system at three entrances and exits and opened it, but it was not connected to the original access control switch, and a few months later suddenly notified the residents that they needed to apply for a new access control card with face recognition...... Stations, campuses, parks, hospitals, museums and other areas require countless scenes that require face brushing.

Why is there so much attention about the ban on forced face brushing?

Security is at the top of the list. In several similar cases in 2023, fraudsters took advantage of the vulnerability of the bank's facial recognition system and intercepted the verification code of the mobile phone to transfer the money in the victim's account. From the perspective of actual life, if a criminals obtain a video of a person's name + mobile phone number + ID card + face recognition, they can basically transfer the money in the person's bank account as if they were in a no-man's land.

In the era of big data, the abuse of facial information is easily used by criminals, causing losses to people. As the main means of identity verification, facial information is very important for the security of consumers' personal property. Because of its unique, immutable properties, it is almost impossible to remedy a leak. At present, it is widely collected, forced or covert, and once it is not properly managed, the risks brought by it cannot be ignored. At present, many face brushing in various scenarios violates the provisions of the Personal Information Protection Law, excessively collects personal information, and does not clearly indicate how to store, use, and protect face information, and the security of face information is very worrying.

Consumers' facial information must not be excessively collected. Article 23 of the Regulations for the Implementation of the Law on the Protection of Consumer Rights and Interests, promulgated on March 15 this year and to be officially implemented on July 1, stipulates that "when providing goods or services, business operators shall not excessively collect consumers' personal information, and shall not use methods such as one-time general authorization or tacit authorization to compel or indirectly compel consumers to consent to the collection and use of personal information that is not directly related to business activities." ”

Operators and managers of railways, airports, hotels, communities, hospitals, parks, etc., should take the initiative to draw inferences from one another, and should strictly abide by the relevant provisions of the "Consumer Rights Protection Law" and the "Personal Information Protection Law", and return the right to consent to the collection of facial information to consumers. At the same time, consumers should also strengthen their awareness of personal information protection and bravely say "no" to the forced collection of facial information.
