It is formulated in accordance with the Constitution in order to prevent and punish terrorist activities, strengthen counter-terrorism efforts, and safeguard national security, public safety, and the safety of people's lives and property. Adopted by the 18th Session of the Standing Committee of the 12th National People's Congress of the People's Republic of China on 27 December 2015. This law consists of 10 chapters and 97 articles.

On January 1, 2016, the Counter-Terrorism Law of the People's Republic of China came into effect, which is a law that is closely related to each and every one of us. What is terrorism and terrorist activities?

Terrorism refers to the propositions and behaviors that create social panic, endanger public safety, infringe on persons and property, or coerce state organs and international organizations to achieve their political, ideological and other goals through violence, sabotage, intimidation and other means.

What is Terrorism?

(1) Organizing, planning, or preparing to carry out activities that cause or intend to cause serious harm to society, such as casualties, major property losses, damage to public facilities, or disorder of social order.

(2) Advocating terrorism, inciting the commission of terrorist activities, or illegally possessing items advocating terrorism, or forcing others to wear clothing or symbols advocating terrorism in public places.

(3) Organizing, leading, or participating in terrorist organizations.

(4) Providing support, assistance, or facilitation such as information, funds, materials, labor, technology, and venues for terrorist organizations, terrorist personnel, or terrorist activities or terrorist activity training.

What are the common terrorist attacks?

Conventional means

1. Assault

2. Hijacking

4. Cyber terrorist attacks

Using the Internet to disseminate terrorist information, organize terrorist activities, attack computer programs and information systems, etc.

How do you evacuate quickly in the event of a terrorist incident?

(1) Maintain calm, determine the location, and see the evacuation route.

(2) Be good at choosing safe passages, do not use elevators, and do not blindly follow the crowding.

(3) Keep your pouch on your chest and don't return to a dangerous situation because of your belongings.

(4) When evacuating, you should turn sideways, stick to the wall, slip sideways, and crawl forward, and use items to cover the vulnerable parts of the body and not close to the window glass, do not go against the flow of people, and avoid being pushed to the ground.

(5) Obey relevant commands and do not blindly crowd to avoid causing greater harm.

What is an act that endangers national security?

Article 4 of the National Security Law stipulates that acts endangering national security refer to the following acts endangering the national security of the People's Republic of China carried out by foreign institutions, organizations or individuals, or carried out by instigating or funding others, or carried out by domestic organizations or individuals in collusion with foreign institutions, organizations or individuals:

(1) Conspiring to subvert the government, split the country, or overthrow the socialist system.

(2) Persons participating in espionage organizations accepting tasks from espionage organizations and their agents.

(3) Stealing, spying, accepting or buying, or illegally providing state secrets.

(4) Instigating, seducing, or bribing state employees to defect.

(5) Carrying out other sabotage activities that endanger national security.

Legal liability for violating network security regulations

Article 285 of the Criminal Law stipulates that anyone who violates state regulations by intruding into computer information systems in the fields of state affairs, national defense construction, and cutting-edge science and technology shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.

Article 286 of the Criminal Law stipulates: Whoever deletes, modifies, adds, or interferes with the functions of a computer information system in violation of state regulations, causing the computer information system to fail to operate normally, and the consequences are serious, shall be sentenced to fixed-term imprisonment of not more than five years or short-term detention;

How are those who organize, lead, participate in, or finance terrorist activities punished?

Article 120 of the Criminal Law stipulates that "whoever organizes or leads a terrorist organization shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment;

Where the crimes in the preceding paragraph are committed and crimes such as homicide, explosion, or kidnapping are committed, punishment is to be given in accordance with the provisions on combined punishment for multiple crimes.

Individuals who finance terrorist organizations or carry out terrorist activities are to be sentenced to fixed-term imprisonment of not more than five years, short-term detention, controlled release or deprivation of political rights, and a concurrent fine;

Where a unit commits the crime in the preceding paragraph, the unit is to be fined, and the directly responsible managers and other directly responsible personnel are to be punished in accordance with the provisions of the preceding paragraph.

How to punish those who endanger public safety by dangerous means, such as arson, flooding, explosions, and the release of dangerous substances?

Articles 114 and 115 of the Criminal Law stipulate that "whoever endangers public safety by arson, breaching water, exploding, disseminating poisonous, radioactive, infectious disease pathogens, or other substances or by other dangerous means, and has not caused serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years;

Whoever commits the crime in the preceding paragraph by negligence shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years;

How to punish the destruction of vehicles, transportation facilities, power equipment, and inflammable and explosive equipment?

(1) Article 116 of the Criminal Law stipulates that "whoever destroys trains, automobiles, trams, boats, or aircraft is sufficient to cause the train, automobile, tram, boat, or aircraft to be in danger of overturning or destruction, and has not yet caused serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years." ”

(2) Article 117 stipulates that "anyone who destroys tracks, bridges, tunnels, highways, airports, waterways, lighthouses, signs, or carries out other sabotage activities that are sufficient to cause the danger of overturning or destroying trains, automobiles, trams, ships, or aircraft, but has not yet caused serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years." ”

(3) Article 118 stipulates that "whoever destroys electricity, gas or other inflammable or explosive equipment, endangers public safety, and has not caused serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years." ”

(4) Article 119 stipulates that "whoever destroys means of transportation, transportation facilities, electrical equipment, gas equipment, or inflammable or explosive equipment, causing serious consequences, shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment, or death." ”

(5) Whoever commits the crime in the preceding paragraph by negligence shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years;

How to deal with the illegal manufacture and sale of firearms and the illegal carrying of firearms, ammunition, controlled knives, and dangerous goods that endanger public safety?

Article 126 stipulates that "if a firearms manufacturing or sales enterprise designated or designated in accordance with law violates the regulations on the management of firearms and commits any of the following acts, the unit shall be fined, and the person in charge and other persons directly responsible shall be sentenced to fixed-term imprisonment of not more than five years; if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years; and if the circumstances are especially serious, shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment:

(1) Manufacture or distribute firearms in excess of the quota or in accordance with the prescribed varieties for the purpose of illegal sales.

(2) Manufacture of unnumbered, double-numbered, or falsely numbered firearms for the purpose of illegal sale.

(3) Illegally selling firearms or selling firearms manufactured for export within the territory.

Article 130 stipulates that anyone who illegally carries firearms, ammunition, controlled knives or explosive, flammable, radioactive, poisonous or corrosive substances into public places or public transportation and endangers public safety, and the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, short-term detention or controlled release.

How to call the police correctly?

(1) Stay calm and do not let panic affect normal judgment.

(2) Determine whether they are currently in danger, and if so, do a good job of personal protection, and quickly leave the dangerous area or shelter in place.

(3) First, report the most important content, including the place, time, what happened, the consequences, etc. For example, the location of the shooting, the number of suspects, physical characteristics, clothing, the number of casualties, etc.; the arson incident clearly states the location of the fire, such as which district, which road, which residential area, the first few buildings, how many floors, and whether there are dangerous objects nearby.
