Article 8
Smoking is prohibited in indoor workplaces, indoor public places, and public transport.
Smoking is prohibited in the following outdoor areas:
(1) Outdoor areas of education or activity venues that primarily provide education, teaching, or activity services for minors;
(2) Outdoor teaching areas of schools and training institutions other than those provided for in item 1;
(3) Outdoor areas of parks, medical and health establishments, and social welfare establishments that primarily provide services for pregnant women and children;
(4) Other outdoor areas other than those provided for in paragraph 3 of medical and health institutions, cultural and museum units, parks, tourist attractions, and other places that are not smoking points;
(5) Outdoor audience seats and competition venues in stadiums and sports and fitness venues;
(6) Within 5 meters of the pedestrian entrance and exit of public transport stations, as well as the area where the outdoor platform and waiting queue of public transportation vehicles are located;
(7) The area where the waiting queue is located and the outdoor ticketing area on the outside of the pedestrian entrance and exit of the places specified in items 1 to 5 of this paragraph;
(8) Municipal and district people's governments in accordance with the needs of holding large-scale activities, temporary addition of non-smoking places;
(9) Other places where smoking is prohibited as provided by laws and regulations.
Article 10
Operators and managers of places where smoking is prohibited shall perform the following duties:
(1) Establish a management system for prohibiting smoking, carry out publicity and education on tobacco control, and assign tobacco control inspectors;
(2) Devices related to smoking or items with tobacco advertisements shall not be allocated;
(3) Set up no-smoking signs and supervision and complaint telephones at the entrances of non-smoking establishments and other conspicuous locations;
(4) For those who smoke in places where smoking is prohibited, the staff of the establishment shall require them to extinguish or stop using tobacco products; if they do not extinguish or stop using them, they shall be persuaded to leave; and if they do not obey the dissuasion and do not leave the premises, they shall report to the relevant departments.
Article 36 (1).
Anyone who violates the provisions of these Regulations by smoking in a place where smoking is prohibited shall be ordered to make corrections by the competent health department and the relevant departments provided for in Article 32 of these Regulations in accordance with the scope of their duties, and shall be fined 50 yuan and confiscated on the spot; those who refuse to make corrections shall be fined 200 yuan; and those who obstruct law enforcement shall be fined 500 yuan.
