On April 19, the Fangshan People's Court held a press briefing on typical cases of "disputes involving rural neighboring relations" in Xiaozhuang Village, Yancun Town, Fangshan District, to guide villagers to legally and reasonably exercise their rights and fulfill their obligations through case interpretation, guide rural governance with rule of law thinking, and strive to give full play to the big effect of "small cases", promote the core values of socialism, and help the construction of beautiful villages.
In recent years, with the continuous acceleration of urbanization, the renovation and expansion of homesteads in rural areas in the suburbs of Beijing have been frequent, and the disputes over adjacent relationships have been on the rise. The Fangshan People's Court comprehensively sorted out the new characteristics and trends of cases involving disputes involving neighboring relationships from 2021 to 2023, and sent the press briefing to the villages, so that villagers could experience and understand the judiciary "from zero distance".
Several articles in the Civil Code refer to "providing necessary facilities" and "not violating the provisions" or "not endangering safety", which are all manifestations of the "duty of tolerance" that is limited by the use of immovable property for others between owners of adjacent immovable property.
"To build a harmonious and friendly neighborhood relationship, it is necessary for neighboring parties to consciously practice the core values of socialism, reasonably limit their rights, correctly handle neighborly relations with a friendly and harmonious attitude, and jointly build a good-neighborly and friendly neighborhood atmosphere and a harmonious and friendly living environment. Xiao Jing, a member of the party group, director of the political department and spokesperson of the Fangshan Court, said.
Li Yali, president of the Doudian People's Court, released four typical cases involving the boundaries of adjacent rights such as lighting, drainage, access, and privacy, and interpreted the cases in combination with the gist of the judgment and typical significance. Li Yali suggested that when dealing with disputes over neighboring relationships, villagers should advocate the socialist core values of civility, friendliness, and mutual assistance, take into account the interests of neighboring rights holders, and resolve disputes fairly and reasonably.
After the briefing, Gao Zhanlin, deputy mayor of Yancun Town, and Li Yali jointly unveiled the "Law Popularization Station" in Xiaozhuang Village. Li Yali said that the Fangshan Court will rely on the working mechanism such as the "Law Popularization Station" to strive to "extend the judicial function to where the demand for legal services is", so that there are more and more "people who understand the law" and fewer and fewer disputes in Xiaozhuang Village, so as to provide strong judicial services for neighborhood harmony, rural tranquility and social stability.
"The work of popularizing the law has gone deep into the very end of rural communities, which is conducive to leading rural governance with the rule of law thinking. Wang Baoyi, secretary of the Party branch of Xiaozhuang Village, said after the event that with the help of the "Law Popularization Station" platform, villagers and grassroots polling organizations can obtain professional guidance and legal support from judges to help the people in the jurisdiction solve many problems.
