Case 1

Special operators in the electrical industry have not been trained in special safety operations and obtained the corresponding qualifications in accordance with the regulations.

Law enforcement personnel did not inquire about Wu's special operation certificate through the "Special Operation Permit Inquiry" platform of the Ministry of Emergency Response. According to Article 3 (2) of the "Judgment Standards for Major Accident Hazards in Industry and Trade Enterprises" (Order No. 10 of the Ministry of Emergency Response), special operations personnel who have not undergone special safety operation training in accordance with the regulations and obtained relevant qualifications to work are major accident hazards.

The above behavior violates the first paragraph of Article 30 of the "Work Safety Law of the People's Republic of China", which states that "the special operation personnel of the production and business operation unit must undergo special safety operation training and obtain the corresponding qualifications in accordance with the relevant national regulations before they can take up their posts." In accordance with Article 97 (7) of the Work Safety Law of the People's Republic of China" If a production and business operation entity commits any of the following acts, it shall be ordered to make corrections within a time limit and shall be fined not more than 100,000 yuan; if it fails to make corrections within the time limit, it shall be ordered to suspend production and business for rectification and shall be fined not less than 100,000 yuan but not more than 200,000 yuan, and shall be fined not less than 20,000 yuan but not more than 50,000 yuan for the person in charge and other persons directly responsible for it: (7) Special operations personnel have not been trained in special safety operations and obtained corresponding qualifications in accordance with the provisions to take up their posts. On January 30, the Yangpu District Emergency Bureau imposed an administrative penalty on the company.

As of January 31, the company had paid the fine to the designated bank and transferred the operator Wu Moumou from his job. Case II

Special operations personnel working at heights have not been trained in special safety operations and obtained corresponding qualifications in accordance with the regulations.

On January 23, 2024, the administrative law enforcement personnel of the District Emergency Bureau went to No. 1300 Jungong Road to conduct a safety inspection and found that Ran Moumou, an operator of Anhui Longnu Construction Engineering Co., Ltd., was engaged in high-altitude operations without holding a valid special operation certificate for high-altitude operations. Through the Ministry of Emergency Management's "Special Operation Certificate Inquiry" platform, law enforcement personnel did not find Ran's special operation certificate. According to Article 3 (2) of the "Standards for Determining Major Accident Hazards in Industry and Trade Enterprises" (Order No. 10 of the Ministry of Emergency Response), if the special operation personnel fail to undergo special safety operation training in accordance with the provisions and obtain relevant qualifications to work, it is a major accident hazard.
