Work Guidelines on Further Implementing the Main Responsibilities of Purchasers and Strengthening Procurement Services for Engineering Projects

These work guidelines are formulated in order to implement the requirements for carrying out special rectification work on outstanding problems in the fields of bidding and bidding for engineering projects and government procurement, to further standardize the order of the government procurement market, to continuously optimize the business environment, to fully implement the main responsibilities of purchasers, to clarify work standards, to facilitate actual operations, and to improve the quality and efficiency of procurement.

First, the project entrustment stage

(1) Submit a letter of commitment for procurement. When the purchaser entrusts the National Procurement Center to carry out the procurement of engineering projects, it shall submit a letter of commitment (Annex 1), promising to strictly implement the "three major and one large" decision-making procedures in accordance with the requirements of the unit in key matters such as the announcement and document release, the selection of the purchaser's bid evaluation representatives, and the confirmation of procurement results.

(2) Strengthen project demonstration. The purchaser shall organize the procurement activities of engineering projects in accordance with the law and fully perform the project construction management duties, demonstrate the construction drawings and the maximum bid price, ensure the quality and safety of the project, and strengthen the main responsibility.

(3) Disclosure of procurement intentions. The purchaser entrusts the national procurement center to the separate procurement project, in principle, no later than 30 days before the start of the procurement activities in the Chinese government procurement network to disclose the procurement intention, which according to the "People's Republic of China Bidding and Bidding Law" must be tendered procurement projects, the purchaser should also log in to the Beijing public resources trading service platform 30 days before the first release of the bidding announcement of the project to publish the bidding plan.

(4) Determination of procurement methods. Before entrusting the National Procurement Center to carry out procurement, the purchaser shall determine the procurement method according to the project approval. If the approval does not specify the procurement method, the main responsibility of the purchaser shall be fulfilled in accordance with relevant laws and regulations and the actual situation of the project, and the procurement method shall be determined independently. Regarding the application of laws related to government procurement projects, the purchaser shall follow the provisions of the "Reply to the Application of Law and Application for Construction Permits for Government Procurement Projects" (Guo Fa Ji Cai Han [2015] No. 736) and the "Reply to the Application of Law Related to Government Procurement Projects" (Cai Ku Ban Han [2020] No. 385) and other documents.

Second, the document preparation stage

(1) Submit the performance of similar projects. If the purchaser entrusts the National Procurement Center to purchase engineering projects separately, if it requires the submission of similar project performance in the procurement documents, it shall clearly stipulate that the source of information on the performance of similar projects shall be subject to the data of the National Construction Market Supervision Public Service Platform of the Ministry of Housing and Urban-Rural Development (hereinafter referred to as the "Four Libraries and One Platform").

1. Standardize channels for determining the performance of similar projects. Similar project performance certification materials should be realized by submitting screenshots of the webpage of the "Four Libraries and One Platform". The screenshot of the webpage of the "Four Libraries and One Platform" shall reflect the main information details (such as the project name, project construction unit, construction scale, contract amount, start and completion date, and the name of the project leader) in the bid winning notice or contract agreement, project acceptance certificate (or completion acceptance registration form or completion acceptance record of project quality of the unit). If the relevant information of the "four libraries and one platform" is incomplete, the respondent (bidder) shall supplement other supporting materials according to the above content. From June 1, 2024, performance from other sources will not be used as proof of project performance.

2. Standardize the performance setting standards of similar projects. The performance of similar projects shall not be higher than 80% of the characteristics of the procurement project (construction scale). When setting the performance of similar projects as a quantitative evaluation factor, the full score performance of similar projects of the enterprise shall generally not exceed 3, and the term requirement shall generally not be less than 3 years, and the special projects with complex technology and high technical difficulty such as museums and gymnasiums shall also appropriately extend the life limit according to the actual situation of the project;

(2) Construction organization design. In order to further streamline the construction project response (bidding) documents and standardize the preparation requirements, the construction procurement documents should be clear that the construction organization design of the response (bidding) documents should be aimed at the key technologies, processes, key points and difficulties of the project, and the specific content of the existing national and local standards, specifications, procedures and construction methods does not need to be included in the construction organization design, except for the use of new processes, new technologies, new construction methods or special requirements in the bidding documents. The purchaser shall specify the requirements for the number of pages of the construction organization design in the procurement documents, and the number of pages of the general project construction organization design shall not exceed 150 pages, and for projects with particularly complex technology and construction technology exceeding the national standard, it shall not exceed 200 pages. The purchaser shall clearly deduct points or reject the response (bidding) documents that exceed the number of pages of the construction organization design specified in the procurement documents.

(3) Scoring criteria setting. For construction projects that do not belong to the "People's Republic of China Tendering and Bidding Law" that must be tendered, if the bid evaluation method adopts the "comprehensive scoring method", when setting the bid evaluation criteria and score composition, specific bid evaluation factors and score composition and bid evaluation standards shall be established in accordance with the "price score, objective score and subjective score". Among them, the total weight of the price score, objective score and subjective score is 100%, the weight of the price score in the total score is 10%-30%, and the weight of the objective score in the total score is not lower than the subjective score. If the purchaser restricts the low-price bid, it may add a low-price clarification requirement to the document. If the performance is used as a qualification condition, it will no longer be used as a factor in the evaluation.

3. Project review stage

(1) Standardize the selection of bid evaluation representatives of purchasers. The purchaser may independently select the purchaser's bid evaluation representative to participate in the bid evaluation work, and the selected bid evaluation representative shall generally be an in-service person who is familiar with the relevant business of the unit, familiar with the relevant laws and regulations of bidding and procurement, has experience in the evaluation of similar projects, and can fully exercise the rights of the purchaser and fulfill its obligations. If the purchaser is unable to send a representative for any reason, it shall issue an "Explanation for the Purchaser to Abandon the Dispatch of Evaluation Representatives" (see Annex 2) and bear the relevant responsibilities.

(2) The matters to be complied with in the evaluation of the purchaser's bid evaluation representatives. Abide by the work discipline of the bid evaluation site, maintain the order of the review, and keep the review secret. Treat the review work seriously and meticulously, perform their duties objectively and fairly, abide by professional ethics, and assume personal responsibility for the review opinions put forward. It is not allowed to express tendentious opinions on the review items, and it is not allowed to hint at or induce expert review.

Fourth, the procurement results confirmation stage

According to the provisions of the Government Procurement Law of the People's Republic of China and relevant laws and regulations, the purchaser shall confirm the procurement results in writing within 5 working days after receiving the notice of procurement results and the evaluation report.

Fifth, the procurement results publicity stage

(1) Publicity of procurement results. When the procurement results are announced, the content of the publicity is added to the "Respondent (Bidder) Business Information Publicity Form" (see Annex 4), including the similar project performance of the enterprise submitted by the respondent (bidder) and the "project under construction or newly undertaken" (if any), and the information on the performance, qualifications and working years of similar projects to be assigned to the project leader and the project technical leader. Among them, the performance content of similar projects should include the project name, project construction unit, construction scale, contract amount, start and completion date, name of the project leader, etc. When the procurement results are announced, the above-mentioned business information shall be publicized in the form of a list as an attachment.

(2) Perform oversight duties. In the process of handling complaints, reports and review (bid evaluation) results, the purchaser shall fully implement the main responsibility, perform supervision duties, make decisions on relevant issues in the process in accordance with the "three major and one large" decision-making procedures, and submit relevant materials.

(3) Verification of response (bidding) documents. Before signing the contract, the purchaser shall verify the authenticity of the relevant information in the bidding documents of the winning bidder (transaction) supplier on the qualifications of the enterprise and personnel, the relevant project performance, and the project manager's implementation, and report to the relevant administrative supervision departments of Beijing in a timely manner if any problems are found, or apply for financial supervision.

6. Other matters

(1) Cancel the project entrustment. If the project is not started for more than 60 days after the project entrustment is accepted, the purchaser shall issue a "Letter of Cancellation of Entrustment" (see Annex 5) to cancel the project entrustment and wait until the conditions are ripe before proceeding.

(2) Handle construction permits. Implement the primary responsibility of the construction unit for the quality of the project, and engage in the construction, decoration and decoration of various types of housing construction and its ancillary facilities and the installation of supporting lines, pipelines and equipment, as well as the construction of urban municipal infrastructure projects, and the construction unit shall apply for a construction permit before the start of construction (except for construction projects with an investment of less than 1 million yuan or a construction area of less than 300 square meters).

These guidelines shall come into force on the date of promulgation.

This guide will be dynamically updated and adjusted according to the actual implementation.

The procurement of goods and services related to the project shall be carried out with reference to this guideline.
