Basic facts of the case
In March 2024, this court accepted 387 housing lease contract disputes, and after understanding, in April 2016, 387 plaintiffs signed a shop entrustment operation and management agreement with the defendant Inner Mongolia Commercial Management Co., Ltd., entrusting the shop to the company for unified operation and management for a period of eight years, and the company paid rent to the owner as agreed.
After the official operation of the real estate, the rent promised by the company to be paid regularly was delayed again and again, and the landlord repeatedly demanded the rent from the defendant to no avail, so the 387 owners had no choice but to sue the Huimin District People's Court, requesting the court to order them to pay the rent.
Mediation process
In the face of the possible risk of group litigation, after the Huimin District People's Court learned about the relevant situation, the leaders of the court actively implemented the supervision responsibility, assigned the series of cases to excellent mediators, and deployed to carry out pre-litigation resolution work. Relying on the people's congress deputies' studios, CPPCC members' studios, and specially invited retired judges to serve as mediators, effectively integrate the multiple dispute resolution forces of "people's congress deputies + CPPCC members + retired judges", and organize people's congress deputies, CPPCC members, and retired judges to mediate as soon as possible, so as to improve the efficiency of dispute resolution.
Deputies to the National People's Congress, members of the Chinese People's Political Consultative Conference (CPPCC) and retired judges and mediators took the initiative to contact the representatives of both the owner and the company, and organized face-to-face mediation between the two parties for many times during the mediation period, so as to explain the focus of the dispute in the case. After many times of communication, patient reasoning and guidance, moving with emotion, understanding with reason, starting with a "small incision", after communicating and negotiating with both parties, taking into account the interests of all parties, putting forward a reasonable mediation plan, and finally promoting the proper resolution of group disputes, and signing a mediation agreement.
At present, through the joint efforts of many parties, 387 disputes have been resolved in a package before litigation, which has played a good role in guiding and demonstrating the subsequent handling of related disputes.
Pre-litigation mediation "small incision" to resolve "big disputes" involving people's livelihood. This case is just a microcosm of the many series of cases, and the Huimin District People's Court continues to promote the construction of a "court + N" pluralistic co-governance pattern, continues to explore a new path of justice for the people, guides more dispute resolution resources to the front-end resolution of disputes, and contributes to the modernization of social governance capabilities.
