As we all know, on April 2, many media reported that the Chinese communications giant Hytera was banned globally by the US court, which was implemented on April 2, and not only the global ban, but also put forward several requirements.
For example, a fine of US$1 million per day until the ban is fully enforced, for example, the ban must be publicized on the official website, and there is no enforcement of any orders and judgments of any Chinese court.
Many people are still very angry about this ban, and all kinds of bloody speeches say that they must resist or something.
At the same time, many people feel that Hytera may really admit it this time, because Hytera has announced the ban on its official website, and the e-commerce platform has also removed Hytera's products......
However, things reversed relatively quickly, and on April 17, Hytera issued an announcement saying that the U.S. Court of Appeals for the Seventh Circuit had revoked the previous injunction, and Hytera's production resumed global sales.
For a while, people were very surprised, why the ban was only implemented for 15 days, and Hytera was lifted, what is the reason?
In fact, this matter is still more complicated to say, there is no ban for no reason, and there will be no solution for no reason.
The matter first began in 2017 when Motorola sued Hytera for infringement of its trade secrets, and later in 2018 it claimed that Hytera infringed its patented technology.
Later, Motorola filed lawsuits against Hytera in Australia, Germany and other places around the world.
Later, in 2020, a U.S. court found that Hytera had violated Motorola's rights and fined Hytera $765 million (about 5.3 billion yuan, compared to 6.1 billion yuan in revenue in 2020, equivalent to one year's revenue).
Later, Hytera appealed in the United States and filed a lawsuit with the Shenzhen Intermediate People's Court in 2022 for the company's H series products not infringing on Motorola's rights.
In fact, the cause of the matter is here, the US court thinks that Hytera can do anything mentioned above, which is a normal means, but you went to the Shenzhen Intermediate People's Court to make such a show, and you don't trust our judgment.
And the key point is that after Hytera filed a non-infringement lawsuit in a Chinese court in June 2022, the U.S. court did not learn of this news until more than a year later, and Hytera did not notify the U.S. court.
As a result, the U.S. court was very angry, so it made such an injunction, imposed big sanctions on Hytera, and at the same time demanded that Hytera not obey the judgment of the Chinese court.
After the April 2 injunction was issued, Hytera appealed on the one hand, and on the other hand, tried to withdraw the lawsuit from the Shenzhen Intermediate People's Court to meet the requirements of the US court.
Later, the Shenzhen court had already approved Hytera's request to withdraw the lawsuit in an oral hearing on April 7, and Hytera suspended the sale of two-way radio technology products as required and appealed to the U.S. Court of Appeals for the Seventh Circuit, so the U.S. court revoked the injunction.
Therefore, the case itself is still quite tortuous, the core problem is not only the cause of infringement, but also the reason why some people in the United States have a distrustful attitude towards China's judiciary.
