On April 9, a Chao News reporter came to this health care project called "Spring Breeze Long Stay".

The project is located on a slope in Zhengjiawu Town, Pujiang County, and the houses are in the Chinese style with white walls and black tiles, with beautiful scenery surrounded by green mountains, which is very livable.

But when you get closer, you will find that the interior of the project is actually a bit "messy".

The most prominent thing is the variety of yards, which are different from each other. Some have erected fences and are still under construction, while others have completed construction, but the style is not uniform, the courtyard walls have metal railings, wooden fences, solid fences, etc., and the landscape layout inside and outside the courtyard is also different.

After looking at the house several times, Mr. Zhu decided to buy it.

It is understood that the price of the house is about 20,000 yuan/㎡, which is about twice the housing price in the central city of Pujiang at that time. Mr. Zhu's house has three floors, two floors above ground and one floor underground, with a total estimated construction area of 216.63 square meters and a total price of 4264749 yuan.

After Mr. Zhu paid for the house, the signing of the purchase contract was delayed. Like most owners, he did not sign a purchase contract with the developer until the end of 2021, "We didn't see the complete contract at the time, and it was about a month after it was signed." ”

Why is the million-dollar mansion "not the right goods"?

Why does a "luxury house" bought with so much money "not the right goods"? How can it still "violate regulations" when renovating one's own yard? With the questions of the owners, this reporter found the Pujiang Changzhu Huazhen Real Estate Co., Ltd., the developer of the "Spring Breeze Long Stay" project, and the property owner, Zhejiang Dingyi Property Service Co., Ltd.

It is understood that the "Spring Breeze Long Stay" is part of the health and wellness project in Zhengjiawu Town, which was listed as the third batch of "Slope Villages and Towns" pilot projects in Zhejiang Province in 2017, integrating residence, education and health tourism.

Li Shanjun, the person in charge of the "Spring Breeze Long Stay" project, said that they have never sold the project as a villa, and the "point land supply" is already a "special house", and the marketing video provided by Mr. Zhu is not an official promotional material, "Our own videos will be marked with the company's logo, and this video should be shot by a third-party intermediary." ”

As a pilot project, the "Spring Breeze Long Stay" adopts the "point land supply" model, with the residential area occupied by "construction land" and the front and rear yards "agricultural land". When the owner buys a house, he also signs two contracts with the developer, one is the contract for the sale and purchase of commercial housing, and the other is the contract for the transfer of the right to operate the agricultural land in the yard.

According to the laws and regulations related to land management, large-scale construction cannot be carried out on agricultural land, "the gatehouse and the fence itself cannot be built, and it is a fact that the fence of our project was demolished by the government in the process." However, the model house is also posted with a 'non-delivery standard', which is only used as a display intention, and there is a clear agreement in the contract. Therefore, if there is an owner who renovates and builds on his own, he will also be posted with a "Violation Rectification Notice".

After the magnificent yard "disappeared", the developer has communicated with the owner many times to see if it can be replaced with a metal fence within the scope permitted by the policy.

The reporter learned that one of the reasons why the owners did not agree was that they needed to bear the cost of building the yard.

After many investigations and interviews, the reporter learned that the biggest controversy among the owners of the "Spring Breeze Long Stay" project is still the wall, door and courtyard part of the house. Are these houses villas or not? As a pilot project of "sloping villages and towns", can the "Spring Breeze Long Stay" build walls and doors?

In this regard, the reporter interviewed Pujiang County Natural Resources and Planning Bureau, Housing and Urban-Rural Development Bureau, Zhengjiawu Town Government and other relevant departments.

In 2018, the General Office of the Zhejiang Provincial People's Government issued the "Several Opinions on Promoting the Construction of Ecological "Sloping Villages and Towns" in the Development and Utilization of Low Hills and Gentle Slopes", which clearly mentioned that the construction of "sloping villages and towns" prohibits industrial projects and villa real estate development projects, and strictly controls other real estate development projects.

Relevant departments have unanimously stated that the "Spring Breeze Long Stay" project does not involve villas.

The reporter saw from the commercial housing sales contract of an owner that the nature of the house is "other types of commercial housing".

The relevant person in charge of the Pujiang County Natural Resources and Planning Bureau said that the nature of the land for the "Spring Breeze Long Residence" project is commercial, residential, public management and public service facilities, and in order to balance the project funds, the provincial department allows some residential plots to be divided and sold.

As for whether the fence and gate can be built, the person in charge said that the "sloping villages and towns" project is a "point land supply", and no fence shall be set up outside the red line of the transfer.

The reporter learned from Zhengjiawu Town that a total of 6 model houses were built in the first phase of the "Spring Breeze Long Stay" project, which was completed in September 2019. In May 2020, the Joint Conference on Promoting the Construction of Ecological "Sloping Villages and Towns" in Zhejiang Province carried out the evaluation of the pilot project of "sloping villages and towns" construction and the verification of related issues, and found that some of the walls involved encroachment on agricultural land, so they were demolished.

On April 11, Zhengjiawu Town, together with the Pujiang County Natural Resources and Planning Bureau, the Construction Bureau, and the Law Enforcement Bureau, discussed again and formulated a disposal plan for the stock of illegal construction in the "Spring Breeze Long Residence" community: before April 18, the relevant households will be issued a rectification notice within a time limit, and the householders who have violated the construction will be notified to rectify themselves within 15 days of receiving the notice, and the organization that does not rectify within the time limit will be demolished in an orderly and centralized manner, and the solution will be promoted as soon as possible.

In addition, many owners have disputes about the planning changes of the "Spring Breeze Long Stay" project in 2021, why did the first phase of the project increase from 53 buildings at the beginning to 82 buildings later?

Later, the developer carried out "residential to commercial" for 29 houses, and there was no possibility of changing the villas, and there was a benchmark of no less than 20,000 square meters of land area, which could not be divided into a separate phase, so it was approved and added to the first phase of the project.
