In order to further strengthen the protection of minors and the prevention of juvenile delinquency, to preserve the lawful rights and interests of minors, to create a positive social environment for the healthy growth of minors, and to thoroughly carry out the "Sword and Bud" special action, on the basis of the "People's Republic of China Law on the Protection of Minors", the "People's Republic of China Compulsory Education Law", the "People's Republic of China Law on the Prevention of Juvenile Delinquency", the "People's Republic of China Law on the Promotion of Family Education", and other provisions, the relevant matters are hereby announced as follows:
I. Strengthen family guardianship duties for minors
Minors' parents or other guardians shall respect minors' right to receive education, pay attention to minors' physical, psychological, and emotional needs, strengthen education on safety in areas such as the prevention of bullying, drowning, fraud, trafficking, and sexual assault, and must not allow school-age minors to leave school or drop out of school at will. Minors of appropriate age must not be refused to receive compulsory education for any reason.
Minors must not be allowed to smoke, drink, indulge in the Internet, enter bars, KTVs, internet cafes, or other venues that are not suitable for minors. Domestic violence against minors must not be abused, abandoned, or committed.
Minors' parents or other guardians must not leave minors under the age of 8 or who need special care for physical or psychological reasons unsupervised, or place them in the temporary care of persons who lack civil capacity, have limited civil capacity, suffer from serious infectious diseases, or are otherwise unsuitable. Minors' parents or other guardians must not allow minors under the age of 16 to live alone from their guardianship.
Where public security organs, people's procuratorates, or people's courts discover in the course of handling a case that the parents or other guardians of minors who have committed serious negative conduct have not lawfully performed guardianship duties and violated the lawful rights and interests of minors, they are to reprimand the parents or other guardians on the basis of the circumstances, and may order them to accept family education guidance.
2. Strictly implement laws and regulations on compulsory education and strict school management
Compulsory education schools must not expel or covertly expel students, and must not deprive students of their right to receive and complete compulsory education in school through methods such as long-term suspensions or persuasion to leave school. Compulsory education schools shall implement systems for the management of student status, complete systems for reporting and filing for students who have dropped out of school, suspended school, or taken leave for a long period of time, and shall promptly persuade students who have dropped out of school to return to school.
Schools shall emphasize the comprehensive development of minors, and on the basis of the characteristics of minor students' physical and psychological development, carry out guidance on social life, mental health counseling, adolescent education, and life education, and strengthen education on the prevention of sexual assault. For minors with serious negative conduct, 'one person, one file' shall be established for key management, and effective measures shall be employed to carry out assistance and education.
Schools shall establish systems for the prevention and control of student bullying, carry out education and training on the prevention of student bullying for faculty, staff, students, and so forth, and promptly give psychological counseling, education, and guidance to relevant students. Students must not be allowed to engage in bullying at will, and schools must not conceal serious bullying conduct, and shall promptly report it to the public security organs and administrative departments for education, and cooperate with relevant departments to handle it in accordance with law.
3. Strictly implement the mandatory reporting system
Medical and health establishments, educational establishments, hotels, for-profit entertainment venues, bars, aid management bodies, village (neighborhood) committees, and other such establishments, industries, and their employees, as well as other units and their staffs that have close contact with minors, should strictly implement the mandatory reporting system for cases of violations against minors, and in the course of their work, they shall immediately report or report to the county public security bureau where they discover that minors have suffered or are suspected to have suffered sexual assault, abuse, bullying, abandonment, trafficking, organized begging, or other unlawful violations.
Units with reporting obligations and their staff members are strictly held accountable for their failure to perform their reporting duties, as well as for public employees' negligence in fulfilling the requirements of the mandatory reporting system.
IV. Strictly implement the "five musts" requirements for minors to stay in hotels in accordance with law
Hotel operators accepting minors should strictly implement the "five musts" requirements:
The identity of the resident minor must be checked, and the relevant information must be truthfully registered and reported;
The contact information of the minor's parents or other guardians must be asked and recorded for future reference;
The identity and relationship of the people living with the same household must be inquired about and recorded for future reference;
It is necessary to strengthen safety patrols and visitor management to prevent illegal violations against minors;
Suspicious circumstances must be immediately reported to the public security organs, and the minor's parents or other guardians must be contacted in a timely manner, and appropriate security protection measures must be taken at the same time.
5. Minors are prohibited from entering for-profit entertainment venues
For-profit entertainment venues, bars, internet cafes, and other venues unsuitable for minors' activities must not be set up in the vicinity of schools and kindergartens. Operators of for-profit singing and dancing entertainment venues, bars, internet cafes, and other venues for activities that are not suitable for minors must not allow minors to enter, and operators shall set up signs prohibiting minors from entering in conspicuous locations. Where it is difficult to determine whether they are minors, they shall be required to present their identity documents.
VI. Minors must not be instigated, coerced, or enticed to carry out negative conduct
Minors must not be instigated, coerced, or enticed by any organization or individual to carry out negative conduct, serious negative conduct, or illegal or criminal conduct, as well as providing conditions for minors to carry out the conduct described above.
Minors must not be instigated, coerced, or enticed to participate in illegal or criminal activities such as "stealing", smuggling, or telecommunications network fraud. The above personnel who violate the provisions of laws and regulations shall be severely punished in accordance with the law.
7. It is strictly forbidden to provide tattoo services to minors
Enterprises, organizations, and individuals must not provide tattoo services to minors, and tattoo service providers shall set up warning signs prohibiting tattoos for minors in conspicuous locations on their business premises. Where it is difficult to determine whether they are minors, they shall be required to present their identity documents.
8. It is forbidden to sell tobacco, alcohol, lottery tickets, and controlled knives to minors
Schools, kindergartens shall not be set up around tobacco, alcohol, lottery sales outlets. It is forbidden to sell cigarettes, alcohol, lottery tickets to minors, or to redeem lottery prizes. Tobacco, alcohol, and lottery operators shall set up signs in conspicuous locations that do not sell tobacco, alcohol, or lottery tickets to minors.
It is prohibited to provide or sell controlled knives or other equipment that may cause serious injury to minors. Where it is difficult for proprietors to determine whether they are minors, they shall be required to present their identity documents.
9. Ensure the safety of minors traveling
It is strictly forbidden to provide vehicle rental services to minors. Minors under the age of 16 are not allowed to drive e-bikes on the road. At the same time, minors are not allowed to drive motorcycles, small cars, and other motor vehicles.
10. It is strictly forbidden to recruit minors for employment
Minors under the age of 16 must not be recruited by any organization or individual, except as otherwise provided by the state. For-profit entertainment venues, bars, internet access service business sites, and other venues that are not suitable for minors must not recruit minors.
Minors are the hope of the motherland and the future of the nation. The County Public Security Bureau, the County Culture and Tourism Bureau, the County Market Supervision and Administration Bureau, the County Health Bureau, the County Human Resources and Social Security Bureau, the County Tobacco Monopoly Bureau and other functional departments will carry out normalized rectification and joint law enforcement on hotels, inns, KTVs, slow shake bars, Internet cafes, tobacco hotels, tattoo shops and other places and industries within their jurisdiction. If the operator of the relevant industry venue violates this announcement, the competent department of the industry shall impose a heavier penalty in accordance with the law.
Actively encourage the broad masses of the public to report and expose conduct that infringes on the lawful rights and interests of minors and violations and crimes committed by minors, to create a positive social environment for the healthy growth of minors.
