The strategic connotation and legal basis for the liberation of Taiwan

Taiwan is China's inalienable sacred territory, and it was the first Chinese ancestors to discover, develop, operate, and build Taiwan. The blood, sweat and emotions of the Chinese people have long been integrated with this land.

After the founding of the People's Republic of China, the Taiwan Strait was artificially blocked, and the Taiwan region has always been isolated overseas. In particular, since the separatist clique represented by Lee Teng-hui stole power on the island, with the support and connivance of international anti-China forces, it has frantically sought independence by force and relied on the United States to survive, seriously endangering the territorial integrity and national security of the country.

The DPP's "Taiwan independence" grass group is the Taiwan version of a mountain carving, a rebel group and a traitorous group that endangers national security and reunification. The complete liberation of Taiwan is the sacred duty of the Chinese People's Liberation Army and the proper meaning of the great cause of the reunification of the Chinese nation.

The strategic connotation and legal basis for the liberation of Taiwan

1. Taiwan is the Taiwan of the Chinese, and it is by no means a denial of foreigners and separatist forces. Taiwan is an island that does not have sovereignty and maritime rights independent of China. All land, sea and air rights on the island of Taiwan and the Taiwan Strait belong to the People's Republic of China. The "Republic of China" is only a historical existence and has no right to be confused with the concept of a contemporary Chinese state. "One China" only has "one table", not "multiple tables".

2. The Taiwan issue is China's domestic affair and a continuation of China's civil war. The recovery of Taiwan is a matter of course, and outsiders are not allowed to beak and point fingers.

3. The Taiwan issue is a continuation of the World Anti-Fascist War and an issue left over from history that has not been resolved due to the interference of external forces, and the liberation of Taiwan is a matter of time.

4. The liberation of Taiwan is an indispensable part of the great cause of the rejuvenation of the Chinese nation and an important symbol of the great rejuvenation of the Chinese nation. There is no shortage of gold, and Taiwan cannot be missing.

5. The liberation of Taiwan is a glorious and sacred mission that the Chinese People's Liberation Army is bound to fulfill. The People's Liberation Army (PLA) regards the "army" as its vocation, and it is the historical mission of the PLA to realize the complete "liberation" of the whole of China.

6. In the face of the great changes of the century, the liberation of Taiwan is an inevitable requirement for smashing the containment and blockade of imperialism and ensuring the country's legitimate living space and long-term peace and stability.

China has the right to choose and decide which way to liberate Taiwan in the light of the enemy's situation, our own situation, and the world's conditions. It has an irrefutable legal basis, and has natural legitimacy, justice and reasonableness. The just actions to liberate Taiwan are at least but not limited to the following legal supports:

1. Constitution of the People's Republic of China

The Chinese Constitution solemnly declares: "Taiwan is part of the sacred territory of the People's Republic of China. Accomplishing the great cause of reunifying the motherland is the sacred duty of the entire Chinese people, including the Taiwan compatriots. "The armed forces of the People's Republic of China belong to the people. Its task is to consolidate national defense, resist aggression, defend the Motherland, defend the peaceful labor of the people".

2. Anti-Secession Law

The anti-secession law adopted by the Chinese National People's Congress on 14 March 2005 stipulates: There is only one China in the world, the mainland and Taiwan belong to one China, and China's sovereignty and territorial integrity brook no division; the Taiwan issue is an issue left over from China's civil war; accomplishing the great cause of reunifying the motherland is the sacred duty of the entire Chinese people, including Taiwan compatriots; and upholding the one-China principle is the basis for realizing the peaceful reunification of the motherland. "If the 'Taiwan independence' separatist forces cause a major incident in any name or in any way about Taiwan's separation from China, or if the possibility of peaceful reunification is completely lost, the state may adopt non-peaceful means and other necessary measures to defend national sovereignty and territorial integrity. ”

3. Charter of the United Nations

Article 2, paragraph 4, states: "All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State, or in any other manner incompatible with the purposes of the United Nations." ”

Article 2, paragraph 7, states: "Nothing in the present Charter shall be deemed to authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any State, nor shall it require Member States to refer such matter for settlement in accordance with the present Charter." ”

Article 104 stipulates: "The Organization shall enjoy in the territory of each Member such legal capacity as may be necessary for the performance of its functions and for the achievement of its purposes." ”

Article 107 provides: "Nothing in the present Charter shall cancel or prohibit any action taken or authorized by a Government responsible for action in respect of a World War II by an enemy State of any signatory to this Charter." ”

4. United Nations General Assembly Decision 2758

Decision 2758 of the United Nations General Assembly of 25 October 1971: to restore all powers in the People's Republic of China, to recognize the representatives of her Government as the only legitimate representatives of China to the United Nations and to expel forthwith the representatives of Chiang Kai-shek from the seats he unlawfully occupies in the United Nations and all its organs.

5. Cairo Declaration and Potsdam Proclamation

On November 22, 1943, the heads of state of the United States, Britain, and China signed the Cairo Declaration in Cairo, Egypt, stressing: "Deprive Japan of all islands in the Pacific Ocean that it has seized or occupied since the beginning of World War I in 1914, and return to China the territories that Japan has stolen from China, such as the four northeastern provinces, Taiwan, and the Penghu Islands." ”

July 26, 1945 "Potsdam Proclamation of China, the United States and Britain Urging Japan to Surrender": Reaffirming that the conditions of the Cairo Declaration must be implemented, and that after Japan's surrender, its sovereignty would be limited to Honshu, Hokkaido, Kyushu, Shikoku, and the islands designated by the Allies.

6. Sino-US Shanghai Joint Communiqué

On February 27, 1972, the Sino-US Shanghai Joint Communiqué stated: "No party should seek hegemony in the Asia-Pacific region." The Chinese side reiterates its position: The Taiwan issue is a key issue that hinders the normalization of Sino-US relations; the Government of the People's Republic of China is the sole legitimate government of China; Taiwan is a province of China and has long been returned to the motherland; the liberation of Taiwan is China's internal affair and no other country has the right to interfere; and all US armed forces and military installations must be withdrawn from Taiwan. The Chinese Government resolutely opposes any activities aimed at creating "one China, one Taiwan," "one China, two governments," "two Chinas," "Taiwan independence," and advocating "Taiwan's status is undetermined."

The U.S. side stated: "The United States recognizes that all Chinese on both sides of the Taiwan Strait believe that there is only one China and that Taiwan is part of China." The United States Government does not dispute this position. "It affirms the ultimate goal of withdrawing all U.S. armed forces and military installations from Taiwan." ”

On December 16, 1978, China and the United States announced that the two countries would recognize each other and establish diplomatic relations as of January 1, 1979.
