On November 9, 2023, the Gulou District People's Court of Nanjing City, Jiangsu Province, announced a case of a dispute over liability for damages caused by a fire caused by a sacrifice.
On the winter solstice day of 2022, Wang and his wife burned paper in the community where they lived, and due to the strong wind that day, some of the unburned pieces of paper were blown into the carport of the battery carport, and smoke came out of the carport. When Mr. and Mrs. Wang saw it, they fetched water to deal with it. However, due to the fact that the embers were not extinguished, the fire intensified, and 12 battery cars and other items parked in the carport were burned.
After trial, the court held that if the actor infringes on the civil rights and interests of others due to his fault and causes harm, he shall bear tort liability. As for the loss of the 12 plaintiffs, the court made a discretionary determination based on factors such as the time of purchase and the price of the vehicles. To sum up, the court ruled that Wang should compensate the 12 plaintiffs for damage to their vehicles totaling more than 25,000 yuan within seven days from the effective date of the judgment.
